good morning my name is Marty Rivers I chair the economic development
partnership board and I will call this meeting to order at 1103 a.m. and before
we get to our agenda items today I would be remiss if I didn't bring up
Caroline first meeting without her line I'm sorry I know she meant a lot to the
staff and all the people on the board and if we could have a moment of silence
I think that would be appropriate thank you
all right on a lighter note we have a new guest here Erica Pangburn is the new
president of the Chamber of Commerce and I hate that stores if I can't make that
segue any better than that but I wanted to make sure everybody had a chance to
meet Erica I think you'll find out she'll be very delightful and exciting
we're glad to have her here so you like to say a few words again thank you for
inviting me into your community I am excited to be here I am in week two of
my Denton world tour total immersion I just congratulations on everything that
you're doing here I've been a tourist in your community since 2003 and watching
the exciting things you're doing and experiencing that from without having
skin in the game was a different kind of fun but I really appreciate you guys
welcoming me into your community and into your circle congratulations on all
of the intense work that you're doing and the progress that you're making here
I'm excited to be a part of it please come see us at the chamber if you need
anything if you want to talk about what the chamber is doing or where we're
going and where we're planning to go I would love to share that with you I have
cards please contact me anytime thanks Erica all right our first item before we
get started we're going a little bit backwards today you probably noticed on
your agenda that we do have a closed session item to talk to you because it's
closed session we'll do that at the end of our agenda so we're gonna look at our
first item is EDP 19 - 0 1 4 to consider approval of the minutes from our
February 13th meeting so I'll take a motion if anybody is so inclined
approval as previously distributed to the board motion and a second all those
in favor say aye aye any opposed all right I asked earlier and I hate to keep
skipping staff reports we do have a long agenda on the city staff reporters or
anything that that we must talk about or we need to bring up I don't want to miss
anything if there's something on there but all the information is in your file
to take a look at it's really good information so hopefully everybody's had
a chance to look at that Adam same thing do you have anything you'd like to bring
up any questions on the report anybody have any questions on any any of the
reports that you thoroughly read thank you staff I know you're doing a lot of
work and I hate to keep skipping that but we do have a long agenda all right our
first item we're going to get to talk about is to receive a report hold
discussion and give staff direction on our economic development partnership
business award nomination nominations and selection process that's item EDP 19 -
11 and looks like Michelle is up to visit with us about that thank you it's
deja vu all over again to quote Yogi Berra each year the economic development
partnership board has selected a company to recognize at the annual mayor council
business breakfast award and they have looked at the company's public private
partnerships and very much a focus on the growth and success of the company
as a result of this over time the EDP board has recognized predominantly
larger businesses and I think most of our our stellar we're lucky that we have
so many wonderful businesses in Denton and a great number of them have been
recognized however last August the EDP board had expressed their interest in
developing some criteria that would allow the board to present maybe a second
or an instead of type of recognition to smaller business and in looking at that
we wanted to make sure that we were not replicating the efforts of the Denton
Chamber of Commerce because for years the Chamber of Commerce has also
provided a small business award so the difference between those would be that
the typically for the chamber they look at the company having been a chamber
member in good standing with greater than you know at least or greater than
two years of business within Denton and in good standing they look at their
business history and their overall management and their work environment and
a lot of times whether they've had to overcome hardship or not as a course of
their business operations and how they've managed to that so that has been
a great deal of that focus I know this board has been very interested and always
asks what the company is going to do for the community when you've looked at
incentives and things along those lines and I think that the prior criteria
which are included here in your backup and exhibit to these are the criteria
that you've used for the larger businesses and what we've attempted to
do is to adhere to those as closely as possible but make them much more
flexible so that they could encompass some things that were more typical of
private or in smaller companies so if you look at exhibit three these are the
proposed criterion for considering smaller business and I'm sorry exhibit
three oh I'm sorry page 33 thank you and just ask you we will have the Mayor
Council business breakfast award either the first or second week of September
again and so we'll be coming back to you and asking you for nominations in June
for businesses that you would like to consider once again staff will put
together to make the matrix for you to do comparisons within the criteria for
large and for small business if that's what you decide so that you can make a
determination in August July or August if he'd like to award in in September so
that's kind of the time frame for this but if you take a look at exhibit three
those were the the aspects that we thought would be of interest to you and
we just ask you for feedback on those or if those look good to you so Michelle
who decides whether they meet their criterion or not well within the
category they the company has researched and that material is put in that matrix
so anything that they have accomplished or or done goes in that matrix for you
to compare side-by-side it's been a big spreadsheet in the past and that's
provided to you ahead of time Jill jester I didn't see a definition and
maybe I just missed it when I reviewed the packet earlier of the definition of
a small business has that been established it not really and that's
great it's established different ways with the small business administration a
lot of times it depends on what type of business that you're in whether it's a
small business or not I think that what's been the stumbling block here is
that the criterion for comparison previously had very much focused on the
number of jobs and the investment the tax investment in the community and so
quite typically everyone who has been awarded in the past has had over a
hundred employees and often well over a hundred employees so I would say that a
hundred employees and less and I know that Texas Workforce Solutions in their
grant composition has one structure for companies over a hundred employees and
another one for less than a hundred so really that would be up to you we're not
doing either or so it really could just be a business award that's up to you
whether you want to present two awards or one you could certainly present to a
larger business any smaller business and then that wouldn't more specific today
is not an action item this was just an idea it was not the board coming forward
and voting and saying this is what we wanted to do it was a discussion and
that's still where we are today correct with some more input that was asked from
the staff is that correct yes so I think this is great and of course this is
something that that I brought up a while ago and I'm glad that we're having this
conversation I I would like to keep it to separate awards because I think it's
different criteria and I that's where I'm coming from and I think we have
plenty of businesses to fill both of those categories that need to be
recognized okay
any other comments or questions
do we need to at some point then decide if we're gonna do one or two and put
that on if we're gonna nominate folks we need to know what the criteria
difference with whether we want to as a group or not and or if we do move forward
we need to have some kind of correct I think you need to officially decide
whether you want to do one or two and certainly there's no reason you can't do
two I think that had been the prior discussion too and I need to have
specified in here stating what constitutes a large versus a smaller
business something that that would then be meets criteria as a smaller business
so I would be looking at probably a hundred or fewer employees as being a
small business if if that meets with the group's approval and certainly someone
has other criteria they want to use that would be something we need to vote on it
had to be on the future agenda yes so that we don't waste the staff's time does
everybody interested in moving forward with looking at a small and large
business or not comments I don't know that I'm against it I would say that you
know I just don't want to dilute the top you know what we do is business of the
year it does seem a little duplicative with the chamber doesn't give out a
large a small or I mean it's only a small business award so I don't know
that I'm seeing a large difference between the criteria in those two these
are just my thoughts it is noted in our backup though that that award has to go
to a chamber member and so there are some businesses that aren't necessarily
chamber members that I think should be recognized eventually
Erica so if this helps the first week of May every year is national small
business week so going forward in the chamber we hope to starting next year
really tout that and draw attention to small businesses during that week so I
don't know how this works on your schedule of offering that awards but if
you were going to offer to national small business week would be a good time
to celebrate all of our small businesses and offer something specifically for
them and then you could set your business of the year
my two cents are typically it's been larger businesses because they make a
bigger impact on it's easier to make a big impact on employment numbers and
those kind of things that being said we've got plenty of businesses to
recognize or a lot of them doing some good things I don't know what it would
hurt to have an additional business from from us do that all that does is spread
good cheer and and help recognize some some folks so I'd be for that
I don't know that we can I don't know that we can vote on an agenda item that
wasn't on I mean to create a new small business awards is it wasn't on the
agenda to vote on my name is Tony point down the chief financial officer I have
stepped in in an interim to run economic development what I'm hearing is some
consensus from you saying come back to the board with these two criteria and
applications we'll come back to you and it will entertain at that point we'll
make those action items and we'll have the criteria for you and you can then
debate on how you want to do that and if the if the committee doesn't want to do
the small business application prefers that we do something different as Eric
has suggested we can certainly discuss that at that point as well but I'm hearing
a consensus I think that'd be great okay thank you thanks Michelle all right we
have two recommendations from our downtown economic development task force
to consider today and the first one is item 19 - 16 to hold a report give
discussion on a grand amount of $10,000 for 111 Industrial Street Julie I do have
with me some copies of the scoring sheet this kind of came up at the last council
meeting if you would like to have these in your hands you can kind of see in a
large it's on this it's on here but in a larger format kind of what the scoring
is that might help you these projects are reviewed with the following
considerations in mind these are in the grant policy that the project increases
property valuation or increases the sales tax we it is looked at for
historical accuracy or design quality improves capacity of water waste water
or electric service so we have some confusion about that what that means is
you are going from a two inch water pipe to a four inch water pipe which might
help serve the entire area you're increasing from a phase two to a phase
three transformer which might benefit the entire area improvements to health
and safety results in significant increase in downtown population that is
foot traffic day or night or both and then the other impacts could include
partners with another business like shared parking is a target business like
a grocery store or pharmacy and promotes the development of arts and
entertainment downtown so now and we have recently changed this this may be
the first one you're seeing with the new criteria these first few are were in the
old one the facade rehabilitation and building renovation awnings and signage
impact fee reimbursement utility upgrades which falls under what I just
talked about the increases and then we added after the fire at the mini mall
last year we added interior and code improvements which includes as space to
asbestos removal lead paint removal and the addition of fire suppression systems
so we have discovered that's an important thing so this is the sheet
that I just handed out to you it's not very readable right here but you can see
it in your hands the recommendations up there you can see the score 25 to 30 is
up to 25,000 20 to 24 is up to 10,000 recommendation 15 to 19 up to 5 and
then under 15 does not qualify so this is 111 industrial street this is the
Steve's current location at 219 is East Hickory I'm sure none of you have ever
been there this is a map showing that location where it is just so you get a
feeling it is right there what we in the heart of what we call our entertainment
district and this is the this was the front it doesn't look like this right
now this was the front of seniors in motion this is the area that they're
going to move into this will about double their space and give them an
opportunity to have a patio and a real stage area right now they have music
several nights a week but as you walk in the musicians are immediately to your
left and so they have noticed that some people oh there's people playing we
shouldn't go in you know under so they're gonna have a real stage at another
location not by the front door they'll have a nice patio in the back as well
this is kind of a layout of the interior this is also in your backup if you need
to see it a little closer so they're going to have a private tasting room an
office humidor as well this will also give them an opportunity for their
cigar smokers to go out on the patio and enjoy their cigars stage will be over
here and the bar is right about there so their eligible expenses are
improvements to the facade are 20,000 awnings are 10,000 signs 13,000 the
impact fees is an estimate it's probably a low estimate of 5,000 utility upgrades
are 20,000 for a total of 68,000 we estimate that project is probably
already above that amount the total cost is always above the amount when they
first turn it in they are requesting $25,000 Steve severance the owner and I'm
sorry Roger I Roger Anderson I looked over there and thought it was Tim baby
from a distance so I need my glasses checked they are here to answer any
questions if you have questions of them the previous review back in September
the downtown task force looked at this and recommended $10,000 that was a
unanimous vote their average score was 24 so that score of 20 to 24 gives them
a recommendation of up to $10,000 so we are seeking a recommendation to pass on
to City Council regarding this when we changed the grant back in October we are
now taking every grant to City Council and that will be going forward as
well because of the TIF board being involved I will tell you right now this
money is still in general fund right this moment in that fund there's a
hundred and eight thousand five hundred and thirteen dollars we do have five
grants that are in process if all five of those grants go through at the amount
that they've been recommended that will leave that balance at thirty eight
thousand five hundred and thirteen dollars including today's including today's
including the two today so they would you like to say anything Steve you can
get up and say anything he has a question I'm sorry well yeah I'm glad
that you asked that I wanted to clarify if that included these two as well and
so just for more clarity this is not into the TIF just yet these funds are
still from what we have left right these are still in the general fund from the
previous balance that we had before the council said use this fund first then
once this fund is gone we will go to the hundred thousand in the TIF fund and
designated especially for this purpose right and and state law is pretty pretty
stringent about the TIF district and what can be done so any anything that
receives a grant out of the TIF fund has got to be located in the TIF map in the
district just so you know Steve if you want to say something you'll have to
come to the microphones our large studio audience can can hear what you'd like to
say and thank you for allowing us to come in and speak to you I love the
Yogi Berra reference at the beginning one of the things that I always heard is
one of the stories I heard is Yogi Berra was asked about his favorite Italian
restaurant out in New York and he goes I don't know nobody goes there anymore
because it's too busy and that's the way we feel you know we have as Julie had
mentioned we have people walk by the front door they look in they go my gosh
I can't fit in there there's no place to sit and so I'm amazed and just you know
two and a half years we've approached that and I'm so pleased of the support
that the city's given us and I hope that today we'll get a little extra support
financially but as Julie implied we have pretty much blown through that 68,000 and
have a lot of fun things going on there Roger Anderson has been a big help on
moving the project forward TAVC has been an interesting organization to work with
once again but overall you know we're moving forward our plan right now is if
at all possible to get our CEO this month and get ready to move in assuming
TAVC issues my dual license in May so sometime mid-may we'll get there so
we're really close we're really excited and look forward to making that move so
any questions for me will you be doing any kind of I guess insulation for sound
for separating the businesses so I know there's another location just at the end
that does live-blog music yep are you yes we're not we're not we're not doing
a whole significant build out of a sound system or repression system in there
right now because we do jazz we're not bringing in rock bands we're not doing
all the you know the big heavy stuff so it tends to be more acoustical and so we
didn't do any type of sound evaluation to see if we would impact primarily
text office who you know where the sound is going to be coming from the the
stage is essentially on the wall with text office we have not done any sound
testing to see if that would impact their business but initially based on
what we experienced over in our current place I don't think it will be in a
dramatic impact and if it is we'll take care of that. Anybody else? Thanks Steve.

Step two of three. Thank you. All right our next agenda item is 19-17 and it
is for a grant request on 101 West Hickory and you may know that as the
former Abby Ian. So this the Steve's was originally on the March agenda so this
I'm just going to go through these slides really quickly because we just
covered them so I just had two presentations because they were originally
on separate agendas. So 101 West Hickory and here's the map again located right
there at the corner of Hickory and Locust right across from Wells Fargo
Bank. So this is how it looked a couple of months ago it does not look like this
right now it's got scaffolding all over it and they're busy making changes.
They're also doing the facade on more fun comics so it won't match. I would
tell you that they're going to I guess they're covering up the tilt wall
building that's what we call it tilt wall aggregate stone that's on there at
this point. It's actually kind of a it's a it's on the side is more that tilt
wall the front's been plastered I think but they are going to use a brick
veneer. They have looked at historic photos of this building from the 1940s
and earlier and decided it needed some decoration on the top. There will be
windows added on the side and this is kind of a side view and if this is the
top is the side view the bottom is the front view which kind of separates these
two storefronts a little bit gives them their own distinctive look. And just
another elevation here this is the backside and what used to be known as
the Abbey Underground down there to the bottom left. So their
eligible expenses are $144,165 for facade and $15,000 for awnings which
gives them an allowable expense of $159. Total cost of the project I'm sure is
more than this right now too because we've discovered this is like HDTV show
once you get into it you find other things. So the original total cost of the
project was estimated at $500,000. They're asking for $25,000. Alex Payne
who is one of the partners in this is here today to answer any questions you
might have. Valentine's Day downtown task force looked at this and unanimously
recommended a $25,000 grant. Their average score was 27.57 which was
rounded to 28 and that gave them a grant recommendation up to $25,000. So again
we are seeking a recommendation to City Council to move forward with this and if
you have any questions we can get Alex up to answer if we need. I have a
question about the two separate buildings more fun comic because I saw
that I was like what's happening I thought they were going out of business
and then I so we're making them look the same is it I guess it's the same owner
and just originally one of the elevations that was shown previously the
last one was was the original I guess construction when it was redone back in
2007 but this was the old white furnitures building which was from my
memory enough people refer to as Cravens and so it was built in the 70s one big
tilt wall building it was one one storefront entry and in 2007 or six and
seven I was actually part of a group that that bought it and renovated it and
can it created what appears to be two storefronts here but if you really it's
really just a facade that made it look like two storefronts so you know this
again was an earlier project for us and we I'm not I never was real happy and
thrilled with how the way it turned out that was kind of cheap looking the brick
the fake brick veneer and so when we actually bought this back from Tim at
the Abbey Inn and hired an architect I said I wanted to make it actually look
more historic historically accurate so what we're doing is is like there's
other examples of buildings on other corners of the square like the caddy
cornered from us at where the tattoo place is for instance and I can't
remember who's right next door I believe that's this yeah but I'm just I guess
what I'm saying is it was an original building and it looks like one building
but there's two separate storefront entries so that's kind of what we're
doing in this case where it's gonna say every the same brick it'll have slightly
a different and it's not pink so the brick that's on more fun is what you're
saying will be on the whole just be moving just continuing the same
architecture across it'll have a slightly different you know look at the top of
the building but it'll be the same brick we're you know again their signage will
go back up they're not going anywhere in fact what isn't represented here or part
of the request is their interior modifications the tenant that signed the
lease for the former Abbey is making quite a few interior renovations to the
space I'm gonna reopen it's the lion and crown pub they've got two other three
other locations in DFW and then again we expanded part of the back for for more
fun to give them more room in the back there are that's already done and they've
they've opened that portion of the space the we felt like it needed windows and
cut you know cut windows in the side of the building that's done now adding you
know there's read the old version was was kind of a fake a fake brick and then
like EFIS throughout what we're going we're actually going over from here
forward with an actual thin brick it is I mean it's real bricks that are just
cut down real thin and so that's being applied to the existing surface kind of
hard you can peek in there if you walk by but it's really good-looking it's
gonna be more of a more of a maroon brownish color than than what's shown
here in this in this scan we're actually adding some of the some of the features
that you see there are are using that EFIS product but actually along the base
here I was fearful because EFIS can get kicked or punched or hit and like you'll
you'll see it you know you'll see the styrofoam and so we actually ended up
going and using an actual cast stone at the base of the building a lot of detail
the architect we hired is that I think highly qualified in historic architecture
and I met him because he did the architecture at Parker Square and in park
in Flower Mound and did the newest Midwestern State University campus
there and if you haven't been by there again very good job of it like creating
new buildings that look historically accurate. So on the grant it's per
building right so are we is the the 25 that's being asked for I guess more or
less is going to be used in for two or which one does it apply to you it'll
just apply to the one building it's one it is one building it's just an interior
demising wall that separates we get this task force confused a lot to me it's
it's one our number you know a tax ID number it has two two physical addresses
just because it has two storefronts and that postal company gives it two
different addresses 101 and 103 Hickory but it's it's one building okay I'm just
curious because there's a certain amount that each building is allowed to go up
to and I didn't know if it was so I could have asked for 50 take it yeah but
thank you for that clarification the other questions or comments when do we
expect the line and crown to open against my good wishes they intend to
open the basement level first and I think they're gonna try and do that
within probably a week or two and enter from the back but we actually think we'll
be out of the out of the scaffolding me down and everything be done by the end
of the month so the upstairs probably won't open to me they they've got some
more construction to do upstairs but yep the downstairs I walked through
yesterday it's actually looking really good what they did inside just FYI is I
always felt like with the last tenant you you might have known there was a
downstairs but there was no good way to get there you either went down this
fire escape or you went outside to the alley you went in and it wasn't a very
inviting entrance so they've actually taken and blown out the wall where that
fire exit stair was and then proved that making it where you when you're upstairs
you see downstairs and then you get downstairs you're they've opened it up
and built out of space that had never been finished and now it's much more I
guess inviting environment better lighting it doesn't feel like a dungeon
down there anymore and so but that's that's still going to be a stage area
it'll have like pool and darts and that kind of stuff like you might expect in a
pub upstairs will still be mostly just a restaurant so are you guys reworking the
back wall also painting it to kind of mimic the the color of the brick and tie
in and then here some remnants of the yeah there'll still be some remnants
because I can do it here so that's the this is the current and so that that was
the the tilt wall panels and then so here we're adding adding some some some
brick and an ethos bands to just kind of break it up and give it some character
along the top and then painting some of the existing panels not adding windows
so that's actually in the kitchen but kind of giving us so much where a window
might be but and then the back facing facing walnut I guess is is just going to
be painted and then replacing and fixing awnings the awning up front was
completely rotted out so replacing the metal panel putting new roofing material
on it we have already replaced the roof but yeah it's exterior exterior related
cost we are pushing that five hundred thousand dollar number and then interior
I don't know exactly what the tenants spending on their portion but we have
spent quite a bit more on that expanding the comic book store yes ma'am do you
know is this a contributing building any other comments or questions anybody you

are also fortunate enough today to have some of our planning and zoning staff
here today to give us a report item number 19 - 12 and they're here to talk
about the didn't development code update and draft zoning map
make sure and ask about your letters make sure ask about your letters sir give me
two seconds here to pull up our PowerPoint presentation yes ma'am
I just thought I would let the board know that in the past I've spoken and as
representative of the downtown task force as chair of that for the past year
and a half or so of which Alex is vice chair however due to some additional
community commitments I have resigned and they are voting a new chairperson in
the next meeting just wanted to let you know we're gonna I'm gonna make a
request for our next economic development board meeting that we discussed the
downtown task force and the chair and how all that's gonna work going forward
so that may be I think Alex connect does and you did not know that so that's a
future agenda agenda item but how it's gonna work so they meet is it next week
yeah and I'm out of town next week I won't be there but first thing on their
agenda is electing a new chairperson so there'll be someone at the home all right
good morning this is a little different I've never seen this set up but it's a
little more daunting that you all are sitting at the table but my name is Ron
Mingida I'm with development services a principal planner they're working on our
update to the Denton development code and draft zoning map which I hope you've
heard about and we appreciate the opportunity to talk to you all we been
working on this for some time I know I've seen some of your faces in other
meetings and in other events so hopefully these what you're gonna see
today is not new but for those that I have not been able to speak with again
appreciate the opportunity and please let me know if you have any questions so
today is really just a summary of what we're doing we're gonna go over the
schedule and we're pretty close to the to the end zone here we've got another
couple weeks till we get to City Council we're gonna talk a little bit about some
highlights of what's being proposed as far as the update to the development
code and what our next steps are and then we can have a question and answer
session after that so as far as the process we started this back in summer
of 2017 where there were several modules modules were broken into different
categories module one was the districts and uses the zoning districts and uses
module two was your administration and your procedure chapter and then three
were your development standards we went through that through spring of 2018 and
then in spring I'm sorry winter of 2019 we consolidated that and presented a
revised draft of the consolidated draft and through all this out throughout this
process there was a number of public meetings on meeting with neighborhood
groups development community we met at the chamber a number of time with the
DCDA group going over our proposed code so what's the path to adoption as I said
earlier we we've been working on this for some time really with the
consolidated draft here February of 2018 I'm sorry 2019 working through the
couple of iterations we've held a number of work sessions with the Planning
Zoning Commission and City Council taking each chapter by chapter our hope
is to get to the April 10th which is today the Planning Zoning Commission and
making a presentation to them and getting their consideration or
recommendation that they will then forward to that we will forward to City
Council on April 23rd April 23rd is a couple weeks away from now and that is
when the city is going to be considering both the draft zoning code and the draft
zoning map so again I wanted to highlight that public outreach is still
available although we're at the April 10th and close to the April 23rd we
still welcome comments we still welcome input from the public we still welcome
comments from this board if you have not had the opportunity to review the draft
it is online in the own designated web page it's den code 2030 calm in there
you'll see the draft code and as well as the draft zoning map the draft zoning
map is an interactive map where you can click on your parcel you can search your
parcel your property or properties type in your property address it'll zoom
right into your parcel you click on the parcel it'll have your existing zoning
what's being proposed as well as links to what is proposed as far as new uses
new standards and all of the other stuff that's that's part of the development
code so the project goal is really to implement the den plan 2030 I think most
of you have been involved or have heard of the den plan 2030 one of the action
items from that plan was to update our development code and as it relates to
the development code also revisit our zoning map and so that's what we are
currently doing and again I'm not gonna read this list here but really is just
to implement our den plan 2030 so what that looks like is that we have a den
plan 2030 with a future lane use map and it's my understanding that we are
scheduling another item for this board at a later time to talk about the future
lane use map but that map as well as the entire develop I'm sorry the den plan
2030 is informing what we're proposing with the development code update and the
zoning map so you see the arrow pointing in that direction and that's
where we're getting our information the den plan 2030 has a number of chapters
and again just kind of restating some of the things that I've already stated that
these chapters are what we are looking at when we're looking at the development
code from lane use to parks to mobility to housing all of which inform how we
craft and draft this code update so economic development is a big part of
that as well the future lane use map informs you know where economic
development is suitable for future development and again in an upcoming
board meeting we will talk about that one in particular is the business
innovation area and the industrial center that is west of town and that's
an important area and that's identified not only in the plan but also in the
future lane use map as a city we want to grow compactly meaning that we want to
make sure that we grow within our means grow with purpose grow our assets so
what we have today we want to make sure we use them grow resourcefully grow with
character so any areas such as the downtown and such as any other areas that
have character the areas around the universities the neighborhoods all of
which have character we want to make sure that we can continue that as well
as preserve and in encourage more of those types of developments and then grow
with balance the future land use map is our tool we see residential in the areas
we see commercial in the areas we see industrial and we see business in other
so we want to make sure we we have a city that has balance and not just one
particular land use so how have we taken that and improve our development code
update so one of the things that we're working on and have been working on is
making it more user-friendly using more charts using more graphics and making it
just easier to understand and again I encourage you to look at your if you
have an opportunity to go online look at the draft code you'll see a lot of what
is shown here it's more concise more clear and then that's the goal we want
to make sure that as anyone that comes in and wants to develop in the city they
understand the code and they can go through it without confusion we
understand that there's different sorry different development standards
throughout the city we've got the the square area and I think you you guys
heard a little bit about what's going on with the previous item we also have
corridors the loop and brinker corridor areas that we we want to develop
standards for and i-35 specifically but we also have those character areas the
the hickory and Welch and historic districts and other character areas we
want also develop design stands for and also the industrial area the industrial
park by the airport those are different as well so they should be treated
differently so we've got development standards that are tailored for those
particular areas again I want to just emphasize that we're trying to make it
more user-friendly we've got additional charts that make it easier to follow
this in particular this chart will be here list all of the different uses I'm
sorry applications it identifies what's required who makes the decision is it P&Z
is it City Council is it the zoning Board of Adjustment so again if anybody
wants to apply for an application they understand who reviews it who makes the
decision and what the process is so really really helpful and again try to
make this document a more user-friendly plan document okay I'm going to run
through these really quickly these are the key changes to the sub chapters and
I won't spend too much time on it but I just really want to share with you some
of the key changes chapter one again is our general standards just discusses our
nonconformities it talks about how we transition from the old code to the new
code talks about how it's organized in some of the enforcements that are part
of the process chapter two I already talked a little bit about the chart it
has procedures that speak to common procedures that every application has to
follow but there's also specific procedures that are also applied to
specific application there is a section in this sub chapter that talks about
citizen participation I think that's a City Council initiative or policy that
we want to make sure that we have citizen participate in the process so
we've added this process to ensure that anybody that's wanting to know more and
want to be involved in provide input they are able to so again try to make
this as user-friendly as possible PDs how many of y'all have heard of PDs
before I've been involved in PDs so you know in 2002 they were no longer allowed
we're bringing you back so with a little bit more criteria so it's not just apply
for a PD for whatever you want so there's going to be a criteria when you
are able to and that's spelled out in the code so PDs for those that don't
know is an ability for a property owner or developer to submit an application
apply for a PD and deviate from the code but at the same time providing more
enhancement so it's a give-and-take ropes and ranches a PD some of the
residential developments on the southeast portion of the city are PDs so
those those are what you are looking at as far as peace and those are coming
back as part of this PD if City Council approves this on April 23rd we're also
building in more flexibility and relief procedures to again provide the
development community and business owners the opportunity to develop in a
more flexible but at the same time with standards that come with it so we're not
just saying you can develop but there's going to be some flexibility in the form
of allowing them to not necessarily do this but you can do this so giving them
options is what we're saying okay zoning district this is probably one of the
biggest chapters what we did here we currently have 23 or 24 zoning districts
if you all can imagine that your dr1 dr2 our CR 1 all these zoning districts we
are combining those down to 14 this chart and you I apologize for the size
of this but you should have a copy of this in your handout or your
presentation this one is a little bit updated but not not too much the middle
column is the existing zoning districts the farther right is the proposed zoning
district and you see that for the majority the single-family zoning
districts or residential zoning districts that is are going to transition from in
our to an R so for example in our one is going to go to our one not a
significant change the design standards are not going to be significantly
different the council committee that's helping with this process and Healy is
part of that committee basically said keep it as low impactful to the
residential districts as possible so the nr2 is going to be r2 the nr3 is going
to be our three but that doesn't apply to all of the zoners we we have other
zoning districts that we're going to consolidate and the ones that you see
there that are consolidated are the ones that have multiple zone districts that
are going into a single zoning district for example the dr1 dr2 our CR 1 in our
CR 2 are now going to be zoned as far as this chart of this chart on our seven so
if if a person a property owner owns a dr1 their zoning district is going to be
an r7 and but in similar with the other ones DCN and DCG will go to an MD RC our
and an RC our D I'm sorry our CCD will go to an MR and so on and so forth the
master plan communities the existing 15 or so PDs will transition to PDs they'll
just be called PDs those zoning cases that were approved by City Council that
have conditions that were approved with them will be called PDs because they're
treated differently because they're not going to be transitioned to a straight
zoning because they've got those conditions therefore we're calling them
PDs and they'll be identified on a map as PDs and when someone clicks on it or
refers to it there'll be an ordinance number so that they can refer to the
conditions that are signed to that particular property so does anybody have
any questions I know I've been rambling here for a bit I want to make sure I
answer anybody's questions I'm saving them up saving all of our hey I've got
Jim over here is gonna help me with those again graphics and charts I'm just
gonna skip through this one overlay districts these these overlay districts
are your fry Street overlay districts these are the oak Hickory historic
district your West Oak historic district nothing is going to change to those the
only point that I want to make here is that the razor ranch overlay district is
going to be carried forward as an appendix to the development code so it's
not going to go away it's just going to be an appendix to development code it's
just so large in in in number of pages so we're can we're just going to move it
from where it should have been or it's proposed to be in four as an appendix
but nothing's going to change to that overlay district it's going to remain
the same as well as the other overlay districts we're just we're just putting
it in a new subchapter use regulations this relates to the zoning map what that
zoning is allowed is based on this use chapter this use regulation subchapter
so when you flip over to the subchapter you have this table and as you can see
this is just one of I want to say six or seven pages starting with residential
it goes down to commercial it goes down to industrial and in other uses you can
see that looking at the column here single family and the P stands for
permitted it's permitted in all of the residential zoning district is also
permitted in the MN which is the mixed-use neighborhood district but you
can see that if it does not have a P or an S it's not permitted in the other
zoning district if you look down here the next one down town homes it's
permitted in the R3 R4 with a specific use permit that's what the S stands for
if there is a plus that means that you have to refer to a use specific standard
that's identified here and listed as such so this use table is similar to what we
have today we're updating it we're adding new uses we're deleting some that
are not you know used as much but really it's just again clear up and as you all
know if a developer comes in and they wanted to say they want to do this use
and we don't have it well we can't really approve it unless the director
has the ability to make it consistent with another use but if it doesn't we're
we have to do code amendment so what we're doing is we're adding those uses
that we've heard over the years so we're making sure that we address those and
some of those are these here tiny home development I know that's something
that we've heard a lot about we're adding that let's see here bourbon farm
community garden you know to clarify we want to make sure we have a use
identified in the table to make sure we we know where they belong in what use
specific standards would be allowed short-term rental is another one that's
something new so we've added that use in the chapter I think outdoor storage is
another one that we've added that's significant so again this is just a
short list of the ones that we've added or a modified there's a laundry of other
lists of uses that's part of that subchapter so I encourage you to look at
that and let us know what you guys think development standards this is where all
the development standards are grouped into won't spend a whole lot of time on
this essentially we provided more flexibility in when I say flexibility
more options for the community to to get to where they want to be hopefully it
goes to where they're able to develop at the same time meeting the goals of the
community and the plan 2030 the council recently approved a landscaping in tree
or conservation ordinance recently and that is being folded in to this draft
code we've also added some standards more standards that is and more options
for walls and fences and then we also last year the City Council approved some
parking minimums and maximums that are being reflected into this development
code update too so sub chapter 7 deals with subdivisions won't bore you about
that it's more about platting subdivisions
criterias and development standards one in particular part of that is the option
for cluster development and this map helps illustrate what that means the goal
here is to protect as much open space and environmental areas as possible so
we are giving the option where if you preserve this area here I believe it's
30% you're given the option to lower or lessen your lot size in order to
accomplish that conservation or preservation and develop more of a
subdivision so much of what you see here versus one that's here where they
basically impacted the open space area that again the goal is to protect so
this is just an option it's not a requirement if someone wants to develop
with a cluster development they can and again that's something that this plan or
this code will have available chapter 8 which is the last chapter and that is
the definition section I think is one of the most important chapters in my
opinion as well in that in order to make decisions we have to know what they mean
what what each term means and so we're making sure that every use that you have
identified or we've identified there's a definition so we know what we're talking
about every term that we refer to that may not be clear we want to make sure we
define and provide a definition for so that's included in this chapter sub
chapter a couple more slides here now I'm done and getting ready for all those
questions the opportunity for input is still open we're gonna receive input
until April 23rd and probably even past that so there is there is there's plans
on approving or considering the development code as one item and then
the zoning map as a different item but the point is we're still welcoming input
from the public so what happens here after adoption we'll have a period we'll
have an adoption date hopefully April 23rd and we'll have an effective date
and word saying is October 1st so between April 23rd and October 1st the
development community has an opportunity to use the old code or use the old the
new code whatever that is but have to stick to one or the other it also gives
us an opportunity to visit and see if there's any changes that we may have
missed or any proposals that was approved that we may have to rein back a
little so this gives us the opportunity to do that this document is a living
document it's to be updated you know again I don't know how many of you all
have been part of the 2002 update back in 2002 when when they did this back then
but I understand that there were a lot of changes since you know then so I
anticipate that hopefully not as many but we hope that we have addressed as
much as we can with this version and we know that there's going to be additional
updates or amendments coming forward with that that concludes my presentation
I'll be happy to any answer any questions and our consultants here that
have been working on this document are also present so if I can't answer that
hopefully they can any questions all right anybody no questions about letters
so
any change in the parking per bedroom in this new development code so they the
parking standards was was approved back in May of 2018 and so so it was carrying
that forward so this has not changed anything I can tell you that is with
that adoption and I can make any multifamily development has to provide a
space for each bedroom over two unit over two bedrooms or more so if you're
one-bedroom unit it's 1.25 bedroom spaces if you're a two-bedroom or more
you have to provide a parking space for each bedroom in addition if you've got
ten units or more you have to provide a visitor parking of ten percent of the
total required parking so we're trying to address parking by making sure that
these multifamily developments that have more than ten units provide not only
parking for each bedroom if they're two bed two units two bedrooms per unit or
more and for visitor parking that does that help or I don't know where you're
going with that one if that was the question you had great thank you Rana
you mentioned the term grow compactly and sometimes which is a great idea but
sometimes the code and the requirements don't quite match up with planting
trees and fire codes and the more parking spaces so like sometimes you want
to be downtown but then you supposed to plant ten trees on a lot when a lot of
urban areas you don't have that kind of thing so was that addressed right and I
think that slide that showed the Taylor development standards you know for
downtown for corridors and for periphery I think we we have addressed that in
making sure that there are options so the options that we're talking about if
you're in the downtown and you're required to provide this much of say
screening or landscaping well there are other options that you can do to meet
that requirement tailored to your site
well and I was trash fire truck access all those kind of things that you don't
have room because the lots are smaller and you're trying to build up and all
that stuff so right and then just a point again try to help make this stock
in a little bit more concise a lot of those design standards for solid waste
and for fire are covered either in a fire code or a criteria manual so it's
if it's in here and it belongs in their criteria manual it was it was removed
and we've been placed into a criteria manual so to address your question yes
there there are some standards that I know our solid waste folks and our
engineering department our fire department have already updated to
reflect those concerns about access by widening the street requiring wider
streets so yes that's been done citizen participate more citizen
participation which always sounds good except if I'm trying to do something my
property and you're inviting a lot of more people to tell me what to do on my
property would you expand sure we mean by that we we just want to make sure
people are aware of what's being proposed it would it would only be and
it's not a requirement it is a encouragement recommendation is that
different like I notice it's on my SUP process and preliminary plot process you
have to have citizen input different than having a neighborhood meeting that
essentially that's what it is it's just another name for neighborhood meeting we
call it citizen participation and it should just be for any application that
requires a public hearing or a significant application such as a zoning
case or a specific use a couple of the new terms or uses you have in there's
short-term rental yes and accessory dwelling so short terms I like somebody
trying to do Airbnb and Airbnb yes and how do you are we trying to I don't know
how you would know what somebody's using one or house for and they're trying to
keep people from doing that no we're trying to do is trying to make sure we
understand where they are and we're gonna require them to register the
short-term rentals so and so that's that's where units are being leased a
full unit those are what we're considered for less than 30 days that's
the definition again going back to the definition it's important to know what
these are and so the definition has a clear definition for it so less than 30
days and a lease of a unit you know for for whatever time period and what the
goal is is we're trying to make sure we understand and where they are and
register them as well as apply some standards now noise is going to be
covered under the noise standards other you know code related stuff are going to
be covered in other ordinances we're just trying to put a place in a use in
their development code so we have a way of understanding where they are and how
they're treated
I mean we'll be able to tax them for renting the room and that that's the
plan yes sir that can wait a moment yeah yeah we're missing a lot of taxes from
one I understand because we don't do that currently
it's not that wouldn't apply to someone just renting a room it's a unit it's it
would be a right that's the difference right so when you're renting out the
full unit a full house of the entire house that's that would be concerned you
know like an ARB but if you're say renting and if it's a longer than 30
days it's it's a different category again going back to the definitions we
want to make sure that they meet that definition I don't know that's one of
the things that wasn't in the 2002 code you had to deal with correct and so
we're treating that as something that we need to anybody else any questions on
those letters I thought where's a talking about the letters that were mailed out
yes sir everybody get one okay do you have you've been noticed so this
definitely seems much more user-friendly it sounds like the way that you've
reached out to the Development Alliance and other groups to get input I've just
I'm really impressed with the comprehensive study and implementation so
appreciate that appreciate that thanks wrong thank you all right our next item
is any concluding items before we go into a closed meeting and I would like
to add for discussion an agenda item at our next scheduled meeting to discuss
our downtown economic development task force that's that's a subcommittee so to
speak or task force of this board as Jill mentioned earlier she was needed to
resign from that position we've always had somebody that's chaired that
committee from this board or co-chaired that that's not anything that's written
down and so given that we're winding down the downtown grant process from that
board I think it would just be a good and given the vacancy it would be a good
time for us to discuss the purpose a little concerned that the people that
are have been been involved in that stay involved in the city process well that's
through this through this board or some other board or what's going on there I
just think it'd be good time to discuss what what we expect as a board or city
to keep those folks involved and how they're going to move forward so if we
could do that please does anybody have anything else they want to visit about
we had preliminaries preliminarily scheduled a joint City Council EDP board
meeting for June 3rd we're going to postpone that until we have new staff
hired and in place think that'd be a probably a wise thing to do so stay
tuned on that anybody else have anything that we need to visit about in line film
