>> Good afternoon and welcome to the city planning and zoning commission meeting for Wednesday, March 29, 2023. This is our work session and with a quorum present we will call the meeting to order at 5.36 p.m. Let the record show Commissioner Smith, Commissioner Anderson and Commissioner Villarreal are absent at this time. First item is citizen comment on consent agenda items. I do not see anyone here for that. So we will move on to clarification of our agenda. First item is our minutes for March 15th. Does the commission have any questions, concerns on March 15th? Minutes? Okay. Okay. How about the consent agenda? We'll go with 3A. Any questions on 3A? No? How about 3B? Okay. 3C. Commissioner Cole is going to have to recuse himself because of proximity of his residence. So we will look to approve the consent agenda with removing that item to individual consideration and then Commissioner Cole can vote on consent and then we'll hear that first on items for individual consideration if we have a quorum. Okay. Any questions on 3D? Okay. So items for individual consideration 4A, let's see. That's Ashley's. Let's put her through a quick -- >> Good evening. >> Hello. >> Looks like we don't have any screens. >> Yeah, we have no screen today. That's interesting. >> So I will just talk through one. >> Sounds good. >> So now we have screens coming. >> Oh, tech support is here. Screen coming shortly. Thank you. Thank you. >> Okay. This is PP23-0007. This is a preliminary plat for a multifamily use on approximately 1.8 acres on the west side of Johnson Street, south of Collins Street. We are currently recommending denial since it does not meet the criteria for approval, but we have no objection to the requested extension to April 26, 2023. >> Great. April 26th. >> Any questions for Ashley on that? Okay. Thank you. That will get us to 4B. >> Hello. >> Hello. >> You get the screen. >> Yes. I get the screen. Thanks, Ashley. So this is PP23-0003. This is located on the southwest corner of May Hill and University Drive for a light industrial use. Staff is recommending denial at this time, but staff has no objection to the requested extension of April 26, 2023. >> Thanks. Any questions? Thank you very much. 4C. >> Hello. >> Hi. Good evening, everyone. Angie Manglars, senior planner. This is a replat for Glenwood Meadows phase two. This is a residential replat creating 42 residential lots and two open space lots. At the time, staff is recommending denial as it fails to meet our criteria for approval, but we have no objections to the recommended extension or the requested extension of April 26th. >> Great. Any questions? Thank you very much. With 4D, I'm assuming commissioners got that email, but basically we will not need to take action on that as they were able to approve that minor plat administratively. So no action will be needed on our part. Public hearings for tonight, 5A, the applicant has requested to postpone this item. That is a public hearing that has remained open. So we will continue that public hearing and postpone that to April 12th. Also with 5B, it's not listed on the agenda, but the applicant has requested to postpone that to the 29th -- I'm sorry, today's the 29th -- to the 12th of April due to the fact that we are missing two commissioners. That is our reconsideration item. The goal of the reconsideration was to have a full commission and we have less of a commission than we had the first time we heard that. That would be something I think that we should do to honor that post moment because that was the reason for that. But certainly can entertain discussion with regard to that if anybody has anything. Okay. In that case, that will end our agenda and our work session at 541 p.m. We will reconvene at 630 p.m. in the council chambers. >> Good evening and welcome to the city of Denton's planning and zoning commission meeting for Wednesday, March 29th, 2023. With the quorum present, I will call us to order at 630 p.m. Let the record show that Commissioner Smith and Commissioner Anderson are not present for the meeting tonight. First item on our agenda is the pledge of allegiance to the U.S. and Texas flags. >> I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation, under God, indivisible, with liberty and justice for all. >> Honor the Texas flag, I pledge allegiance to thee, Texas, one state, under God, one and indivisible. >> Thank you. Next on our agenda is approval -- consider approval of the minutes for March 15th meeting. Commissioner Villarreal. >> I move approval. >> Commissioner McDade. >> Second. >> Okay. We've got a first and a second for approval of the March 15th minutes. Any discussion? Let's vote on the board, please. That motion carries 5-0. That will take us to our consent agenda this evening. Chair can entertain a motion or discussion on that. Commissioner Villarreal. >> I move approval of the consent agenda. >> Commissioner Cole. >> Second. >> But I believe you are recusing on an item, is that correct? >> Yes. >> Okay. Commissioner Villarreal, might I add to your motion approval of the consent agenda with removal of item 3C? >> I accept that motion. >> Okay. Commissioner Cole. >> Second. >> We've got a motion on the floor to approve the consent agenda with removing item 3C to individual consideration. Any discussion? Okay. Let's vote on the board, please. That motion carries 5-0. I will let Commissioner Cole go ahead and recuse himself on this item, and we will hear now what was formerly item 3C, FP23002A. And the Chair can entertain a motion on that item or discussion. Commissioner Villarreal. >> I move approval. >> Second. >> We've got a first and a second for approval. Any discussion? Okay. Let's vote on the board, please. That motion carries 4-0. We'll give Commissioner Cole a moment to come back in, and we will move to our items for individual consideration. Okay. Hearing 4A, PP23007. >> Hi, Ashley. >> Good evening. Ashley Extead, Assistant Planner. This item is PP230007. It is a preliminary plat for the cottages at Denton. It is a multifamily use on approximately 1.8 acres. Staff is currently recommending denials. They do not meet all the criteria for approval, but we have no objection to the requested extension, which could be granted until April 26, 2023. Happy to answer any questions. >> Thank you, Ashley. Any questions for Ashley? Okay. Thank you very much. Commissioner Perutt. >> I'll move that we approve the applicant's requested extension to the date certain of April 26, 2023. >> Did you say 2023? >> Yes. >> Okay. Well, I heard two. Thank you. Commissioner McDane. >> All right. I'll second. >> We've got a first and a second for approval of the extension request to a date certain of April 26, 2023. Any discussion? Okay. Let's vote on the board, please. That motion will carry 5-0. That will take us to 4B, PP23-0003. Cameron is making her way up here. Hello. >> Good evening. Cameron Robertson, principal planner. This is a preliminary plat that's approximately 19 acres, generally located on the southwest corner of East University and May Hill Road, its own light industrial. Staff is recommending denial as it does not meet the criteria for approval, but staff has no objection to the extension, which will be granted to April 26, 2023. >> Great. Thank you very much, Cameron. Any questions? Thank you. Commissioner Cole. >> I make a motion for the extension to April 26, 2023. >> Okay. Commissioner Pruitt. >> Second. >> We've got a first and a second for approval of the applicant's extension request to a date certain of April 26, 2023. Any discussion? Let's vote on the board, please. That motion carries 5-0. That will take us to 4C, FR23-0003. >> Good evening, everyone. Angie Manglars, senior planner. This is a final replat, FR23-0003. This is a residential replat for Glenwood Meadows Phase 2. It is approximately 10.2 acres. It's creating 42 residential lots and two open space lots and is on PDR6. At this time, the final replat does not meet our criteria for approval and staff is recommending denial. However, we have no objection to the requested extension that could be granted to a date certain of April 26, 2023. Happy to answer any questions. >> Thanks, Angie. Any questions for Angie? Thank you. Commissioner Villarreal. >> I move approval of the extension to a date certain of April 26, 2023. >> Commissioner Cole. >> Second. >> All right, first and a second for approval of the extension request to a date certain of April 26, 2023. Any discussion? Let's vote on the board, please. That motion carries 5-0. That will move us to our 4D item on the agenda. The applicant was able to work through things and staff was able to approve that administratively so we will not need to take action on that item this evening. That will move us to our public hearing items, 5A is PD21-0007B. That public hearing has been continued and on our agenda, the applicant has requested to postpone this item to a date certain of April 12, 2023. Hillary, I do have a question for you that I forgot to ask in work session that's listed on our agenda. Do we need to make a motion to postpone that item? >> I believe we did last time so I think it would be best practice to do a motion this time as well. >> Okay. >> And I'd also note that the public hearing remains open. >> That sounds good. Okay. Thank you. >> So I will move to postpone this item to a date certain of April 12, 2023 with the public hearing remaining open. Commissioner Pruitt? >> Second. >> Okay. We've got a first and a second for approval of that postponement and continuation of the public hearing. Any discussion? Okay. Let's vote on the board, please. That motion carries 5-0. That will move us to item 5B, which is PD 220010C. Since the agenda was posted, the applicant has requested to postpone this item to the April 12th Planning and Zoning Commission meeting. Reason cited was the lack of a full commission. We do only have five members here this evening. I will go ahead and open the public hearing for this item. I don't believe staff has a presentation for us. Would you like to come up here? Thank you. >> Good evening, members of the commission. Yes, so the applicant -- this is Mia Hines, Associate Planner. This item is a plan development to change the zoning from PDMN to PDC, an overlay PD. The applicant is requesting that this be postponed, but I do have a presentation if you want me to walk through it or if you have any questions, I'm happy to answer. >> Thanks, ma'am. I do not see any questions. Appreciate that. Being that this is a public hearing, I can allow if there is anyone who would like to speak on this item, though the request from the applicant is to continue the public hearing to April 12th. So is there anyone here wishing to speak on this item tonight? So you can come up to the podium if you would. >> I'm sorry, is that the way I was filming it out, and I apologize, I wasn't paying real close attention. >> That's okay. >> We were up front with the economy teacher. Is this on that 22-001C overlay? >> Yes, correct. That is the one. >> Okay. Then I will come back then on April 12th. >> Okay. Very good. >> Thank you. >> Thank you. Is there anyone else wishing to talk this evening while you are here? Okay. Seeing none, the chair can entertain -- commissioner Prude. >> Thank you. I'll move that we continue this hearing to the date certain of April 12th. >> Commissioner Cole? >> Second. >> Okay. We've got a first and a second to continue this public hearing item to a date certain of April 12th, 2023. Commissioner Villarreal. >> Yes. I fully understand the need to postpone this further, but out of respect for the folks that showed up, I'll be voting against the motion. >> Appreciate that. Thank you. Any other discussion on this? Okay. So the motion on the floor is to continue the public hearing item to a date certain of April 12th, 2023. Let's go ahead and vote on the board, please. Okay, that motion has passed with a 4-1 vote. So again, that will be on our agenda April 12th. If you did come here tonight for that evening to speak on that item this evening, we will be hearing it here April 12th. That will move us to our planning and zoning commission project and matrix. Thank you. I'll turn it over to Tina. >> Thank you. So there were no modifications made to the matrix, it remains as is, from the meeting on the -- I guess two weeks ago on the March 15th. And I will make note that we will update and continue the discussion and the report from our city attorney's office regarding the public hearing notification of properties within the ETJ at our next meeting on the 12th. So we know this item is of importance to Commissioner Smith and want to have the opportunity for him to be able to participate in that discussion. So thank you for your flexibility this evening. We'll have that updated. In terms of action on any development-related items that may have gone to council, we did not have anything on council's agenda on March 21st, so there's nothing to report there. I will note that we did have our first open house events with respect to the Northeast Area Plan this past Thursday as well as Saturday. In between the two events, we had approximately 300 people in attendance. So if there's anyone who was not able to attend the open house and is interested in providing feedback, they may do so online by going to our Discuss Denton webpage at the City of Denton's website and then look for area plans in the Northeast, and there's an opportunity to continue to provide feedback there. That concludes my report. That's great. Thank you, Tina. Is there anything to add to the matrix? Any concluding items? Okay. With that, we will adjourn at 6.45 p.m. Thank you, everyone. See you on the 12th.
