The subject property is 35 00:02:13,800 --> 00:02:15,439 comprised of four parcels 36 00:02:15,439 --> 00:02:18,610 of land three of them have frontage on country club road 37 00:02:18,610 --> 00:02:19,199 the fourth is 38 00:02:19,199 --> 00:02:21,919 currently landlocked they're located on the east side of 39 00:02:21,919 --> 00:02:22,680 country club road 40 00:02:22,680 --> 00:02:27,349 approximately 265 feet south of Regency Court and to give 41 00:02:27,349 --> 00:02:28,120 you a little bit 42 00:02:28,120 --> 00:02:30,870 better view of where this is at the very top you can see 43 00:02:30,870 --> 00:02:32,039 the Fort Worth drive and 44 00:02:32,039 --> 00:02:36,259 country club road intersection as well as how this relates 45 00:02:36,259 --> 00:02:37,400 to Hobson Lane. 46 00:02:37,400 --> 00:02:40,370 Some of the surrounding properties the Bent Creek estate 47 00:02:40,370 --> 00:02:42,080 subdivision is located 48 00:02:42,080 --> 00:02:45,840 east or west across country club road Regency Oaks is 49 00:02:45,840 --> 00:02:47,520 immediately to the north 50 00:02:47,520 --> 00:02:50,180 of this property and the El Paso addition is to the east of 51 00:02:50,180 --> 00:02:51,319 it and there 52 00:02:51,319 --> 00:02:54,759 is a tributary of Hickory Creek that runs north to south 53 00:02:54,759 --> 00:02:56,159 across the property. 54 00:02:56,159 --> 00:02:59,639 So as I mentioned currently 15 and a half acres which is 55 00:02:59,639 --> 00:03:00,960 roughly 43 percent 56 00:03:00,960 --> 00:03:04,719 of the property is zoned NR2 a little over 20 acres or 57 00:03:04,719 --> 00:03:06,199 about 56 percent is 58 00:03:06,199 --> 00:03:11,599 zoned NR4 and the proposal is to rezone all four parcels to 59 00:03:11,599 --> 00:03:12,240 NR3. 60 00:03:12,240 --> 00:03:16,159 Commissioner Back. Thank you Chair. Go back that little 61 00:03:16,159 --> 00:03:18,319 strip out there is that that road is 62 00:03:18,319 --> 00:03:21,860 that all that is that little panhandle? Oh yes I believe 63 00:03:21,860 --> 00:03:24,039 that's their access. Okay. 64 00:03:26,439 --> 00:03:29,060 So the future land use designation for the property is low 65 00:03:29,060 --> 00:03:30,960 residential and this 66 00:03:30,960 --> 00:03:34,159 designation allows for single-family residential areas with 67 00:03:34,159 --> 00:03:35,000 a density of up 68 00:03:35,000 --> 00:03:38,599 to four units per acre. It encourages new single-family 69 00:03:38,599 --> 00:03:39,599 developments that is 70 00:03:39,599 --> 00:03:42,780 compatible with existing neighborhoods and it promotes a 71 00:03:42,780 --> 00:03:43,879 variety of housing 72 00:03:43,879 --> 00:03:48,259 styles types and price points. So some of our 73 00:03:48,259 --> 00:03:50,840 considerations for this rezoning to 74 00:03:50,840 --> 00:03:54,729 NR3 is not inconsistent with the surrounding patterns it's 75 00:03:54,729 --> 00:03:55,159 not an 76 00:03:55,159 --> 00:03:57,439 immediate continuation of anything adjoining the property 77 00:03:57,439 --> 00:03:57,919 but there is 78 00:03:57,919 --> 00:04:02,099 other NR3 across country club road from the property. The 79 00:04:02,099 --> 00:04:03,560 permitted uses within 80 00:04:03,560 --> 00:04:05,960 the NR3 district are consistent with the surrounding 81 00:04:05,960 --> 00:04:07,159 development primarily 82 00:04:07,159 --> 00:04:09,740 single-family dwellings or what's permitted there. Multi- 83 00:04:09,740 --> 00:04:10,639 family and duplex 84 00:04:10,639 --> 00:04:12,960 uses are not permitted in the current or the proposed 85 00:04:12,960 --> 00:04:16,240 zoning district and NR3 is 86 00:04:16,240 --> 00:04:19,829 consistent with that future land use designation of low 87 00:04:19,829 --> 00:04:22,199 residential. Overall 88 00:04:22,199 --> 00:04:25,040 this provides for a decrease in the intensity of the 89 00:04:25,040 --> 00:04:26,319 current zoning because 90 00:04:26,319 --> 00:04:28,899 over half of the property is currently NR4 and it would be 91 00:04:28,899 --> 00:04:31,399 reduced to NR3 and 92 00:04:31,399 --> 00:04:34,889 NR3 is kind of an intermediate in terms of density and 93 00:04:34,889 --> 00:04:35,839 scale from what's 94 00:04:35,839 --> 00:04:38,589 currently there so that would provide a more logical 95 00:04:38,589 --> 00:04:39,920 transition between the 96 00:04:39,920 --> 00:04:44,360 existing NR2 zone neighborhoods and what is being proposed. 97 00:04:44,360 --> 00:04:45,920 So just to give you a 98 00:04:45,920 --> 00:04:50,560 look at that the NR3 regulations that they would be subject 99 00:04:50,560 --> 00:04:51,399 to if this is 100 00:04:51,399 --> 00:04:54,220 approved are circled in yellow in the middle so it's kind 101 00:04:54,220 --> 00:04:54,959 of an intermediate 102 00:04:54,959 --> 00:04:57,860 in terms of the density that's allowed in the zoning 103 00:04:57,860 --> 00:04:59,240 districts as well as in 104 00:04:59,240 --> 00:05:02,060 the lot coverage and the other criteria and so this rez 105 00:05:02,060 --> 00:05:03,360 oning would consolidate 106 00:05:03,360 --> 00:05:06,319 the development in the future from having two different 107 00:05:06,319 --> 00:05:07,240 sets of criteria 108 00:05:07,240 --> 00:05:09,839 that it would have to be looked at with when they go to 109 00:05:09,839 --> 00:05:11,040 Platte and develop to 110 00:05:11,040 --> 00:05:17,949 just one set of zoning criteria. The existing zoning with 111 00:05:17,949 --> 00:05:18,199 the two 112 00:05:18,199 --> 00:05:22,129 different designations would allow a maximum of 111 lots on 113 00:05:22,129 --> 00:05:22,839 the entire 114 00:05:22,839 --> 00:05:26,850 property. The proposed zoning would permit up to 124 lots 115 00:05:26,850 --> 00:05:28,120 or 124 dwelling 116 00:05:28,120 --> 00:05:31,870 units per acre to be exact. The applicant has stated that 117 00:05:31,870 --> 00:05:33,160 their intent is to 118 00:05:33,160 --> 00:05:38,959 develop between 73 and 78 lots and that is reduced and 119 00:05:38,959 --> 00:05:39,600 depend the final 120 00:05:39,600 --> 00:05:42,310 configuration and number of lots will depend on the 121 00:05:42,310 --> 00:05:43,680 physical constraints that 122 00:05:43,680 --> 00:05:46,300 are imposed by the current floodplain and alternative ESA 123 00:05:46,300 --> 00:05:47,240 that runs through the 124 00:05:47,240 --> 00:05:50,720 property so they have an application in for an alternative 125 00:05:50,720 --> 00:05:51,560 environmentally 126 00:05:51,560 --> 00:05:54,800 sensitive area plan and depending on how that is worked out 127 00:05:54,800 --> 00:05:55,800 would basically 128 00:05:55,800 --> 00:05:59,699 determine what configuration of lots they could achieve 129 00:05:59,699 --> 00:06:00,199 here. 130 00:06:00,319 --> 00:06:04,680 Notification was sent out for this case. 46 notices sent to 131 00:06:04,680 --> 00:06:05,600 properties within 200 132 00:06:05,600 --> 00:06:09,980 feet, 126 sent to the 500 foot radius. We received two in 133 00:06:09,980 --> 00:06:11,920 opposition, one in favor, 134 00:06:11,920 --> 00:06:15,680 one neutral, and one that I placed on your desk today was 135 00:06:15,680 --> 00:06:16,279 received and they 136 00:06:16,279 --> 00:06:20,750 were kind of undecided on how they felt about the case. All 137 00:06:20,750 --> 00:06:22,160 of the other notices 138 00:06:22,160 --> 00:06:24,339 or responses that I received were included in your backup 139 00:06:24,339 --> 00:06:24,720 with the 140 00:06:24,720 --> 00:06:29,560 notification map. So staff recommends approval of this 141 00:06:29,560 --> 00:06:30,639 request as it's 142 00:06:30,639 --> 00:06:33,279 compatible with the surrounding land use and zoning pattern 143 00:06:33,279 --> 00:06:34,199 and is consistent 144 00:06:34,199 --> 00:06:37,319 with the goals and objectives of the Denton Plan 2030 and I 145 00:06:37,319 --> 00:06:38,079 'll stand for any 146 00:06:38,079 --> 00:06:42,459 questions if you have them. Commissioner Taylor. Thank you 147 00:06:42,459 --> 00:06:44,399 Chair. I have I have 148 00:06:44,399 --> 00:06:47,899 several questions some pertain just to this project and 149 00:06:47,899 --> 00:06:49,160 some are just just 150 00:06:49,160 --> 00:06:54,180 general questions on a development that might have a mixed 151 00:06:54,180 --> 00:06:56,439 zoning. So can you 152 00:06:56,439 --> 00:07:00,819 back up to the area the two more I think two more back not 153 00:07:00,819 --> 00:07:02,079 the area one one 154 00:07:02,079 --> 00:07:04,769 forward I'm sorry with the floodplain. So those houses that 155 00:07:04,769 --> 00:07:05,879 are already built on 156 00:07:05,879 --> 00:07:10,810 Country Club Road those are on individual fairly small parc 157 00:07:10,810 --> 00:07:11,160 els those 158 00:07:11,160 --> 00:07:13,949 are kind of like an about an NR3 or NR4 density right now 159 00:07:13,949 --> 00:07:15,360 aren't they? There's 160 00:07:15,360 --> 00:07:17,939 ten total houses that front Country Club right now they're 161 00:07:17,939 --> 00:07:19,839 actually all on one parcel of land. 162 00:07:19,839 --> 00:07:23,050 It's not individual lots. Oh okay so if they were parceled 163 00:07:23,050 --> 00:07:24,600 out it would I'm like 164 00:07:24,600 --> 00:07:27,160 just looking across the street is NR3 and they're a little 165 00:07:27,160 --> 00:07:27,759 bit tighter 166 00:07:27,759 --> 00:07:32,040 together than the NR3 are. So okay. Again I believe just to 167 00:07:32,040 --> 00:07:32,399 clarify the 168 00:07:32,399 --> 00:07:34,639 subdivision across the street is NR3 but it was developed 169 00:07:34,639 --> 00:07:35,800 before that zoning 170 00:07:35,800 --> 00:07:38,250 designation was put in place so I think it is actually a 171 00:07:38,250 --> 00:07:40,120 higher density than NR3. 172 00:07:40,120 --> 00:07:44,350 Okay all right and my other question is this is probably a 173 00:07:44,350 --> 00:07:45,680 good map to do it on 174 00:07:45,680 --> 00:07:51,019 they're they're aiming for 75 ish lots how does density 175 00:07:51,019 --> 00:07:53,439 transfer work in a 176 00:07:53,439 --> 00:07:55,759 development if you actually had a development with two zon 177 00:07:55,759 --> 00:07:56,879 ings in it like 178 00:07:56,879 --> 00:07:59,310 some of our larger developments have in our three at the 179 00:07:59,310 --> 00:08:00,319 front and our six at 180 00:08:00,319 --> 00:08:05,379 the back or something like that can you density transfer is 181 00:08:05,379 --> 00:08:06,800 it only within the 182 00:08:06,800 --> 00:08:14,399 the boundaries of the zoning district okay. Hey Alex so I'm 183 00:08:14,399 --> 00:08:14,800 just looking at 184 00:08:14,800 --> 00:08:18,430 this and trying to figure out because you get a bunch of 185 00:08:18,430 --> 00:08:20,120 you know 25% of that 186 00:08:20,120 --> 00:08:24,029 or 20% of that or something is in a floodplain so you'd get 187 00:08:24,029 --> 00:08:24,600 a bunch of 188 00:08:24,600 --> 00:08:27,790 density transfer anyway so it seems like you could still 189 00:08:27,790 --> 00:08:29,439 build 75 lots really 190 00:08:29,439 --> 00:08:32,210 easily so I'm just trying to understand you know and I 191 00:08:32,210 --> 00:08:33,039 understand there might be 192 00:08:33,039 --> 00:08:36,059 like they probably want the same zoning across the entire 193 00:08:36,059 --> 00:08:37,679 project and there 194 00:08:37,679 --> 00:08:40,809 might be those side yard sizes and things like that that as 195 00:08:40,809 --> 00:08:41,399 to why the 196 00:08:41,399 --> 00:08:44,669 developers doing it I'm just trying to trying to understand 197 00:08:44,669 --> 00:08:45,240 for my own 198 00:08:45,240 --> 00:08:48,139 education. Yeah I believe a lot of the intent was to 199 00:08:48,139 --> 00:08:49,279 consolidate it under one 200 00:08:49,279 --> 00:08:52,759 set of regulations there because the way it's configured 201 00:08:52,759 --> 00:08:53,960 now that NR4 would 202 00:08:53,960 --> 00:08:56,019 lead to smaller lots kind of in the back of the property 203 00:08:56,019 --> 00:08:56,879 and larger lots on the 204 00:08:56,879 --> 00:09:01,080 edges and so I think just to simplify moving forward they 205 00:09:01,080 --> 00:09:01,559 were hoping to 206 00:09:01,559 --> 00:09:04,440 consolidate that but I believe the applicant will be here 207 00:09:04,440 --> 00:09:05,120 at the public 208 00:09:05,120 --> 00:09:07,330 hearing later if you have any questions. And then the hatch 209 00:09:07,330 --> 00:09:08,200 ed orange here are 210 00:09:08,200 --> 00:09:12,100 those areas that have been are being removed from the ESA 211 00:09:12,100 --> 00:09:13,080 or what's the 212 00:09:13,080 --> 00:09:16,759 designation there do you know? The hatched areas are 213 00:09:16,759 --> 00:09:19,240 historic Lomar. Oh okay 214 00:09:19,240 --> 00:09:22,600 so not really. Yeah the blue area is the current floodplain 215 00:09:22,600 --> 00:09:26,240 . All right thank you. 216 00:09:26,799 --> 00:09:30,070 Commissioner Beck. Thank you Chair. I'm sorry the hatch 217 00:09:30,070 --> 00:09:31,799 marks are historical what? 218 00:09:31,799 --> 00:09:34,919 Lomar I'm not sure. Earl would probably be able to better 219 00:09:34,919 --> 00:09:35,799 answer questions about 220 00:09:35,799 --> 00:09:43,450 what that designation is. Okay. Earl? Question? They're 221 00:09:43,450 --> 00:09:43,960 wondering what the 222 00:09:43,960 --> 00:09:46,919 hatched areas. Could you explain that a little bit more? 223 00:09:46,919 --> 00:09:50,879 The hatched area is the historical floodplain. Oh okay. 224 00:09:50,879 --> 00:09:53,669 That's what the floodplain used to be because it was unstud 225 00:09:53,669 --> 00:09:55,039 ied. Yeah. And so 226 00:09:55,039 --> 00:09:58,210 when the Regency development to the north came in they 227 00:09:58,210 --> 00:09:59,840 performed a letter of 228 00:09:59,840 --> 00:10:02,240 map revision to establish where the floodplain actually is 229 00:10:02,240 --> 00:10:02,879 by studying it 230 00:10:02,879 --> 00:10:05,929 and that's where the blue shade comes in. Okay so the 231 00:10:05,929 --> 00:10:06,960 historical little hatch marks. 232 00:10:06,960 --> 00:10:11,240 Yeah that layer should have been turned off. Gotcha. Thanks 233 00:10:11,240 --> 00:10:15,080 . Commissioner Hatchbeth. I don't know if this is 234 00:10:15,080 --> 00:10:19,000 another Earl question but I don't even know if I can ask it 235 00:10:19,000 --> 00:10:19,559 if it's 236 00:10:19,559 --> 00:10:24,039 germane to what we're considering today. Has anyone 237 00:10:24,039 --> 00:10:27,240 considered the ins and out of 238 00:10:27,240 --> 00:10:32,440 the property? Can we consider that at this point or no? 239 00:10:33,960 --> 00:10:37,110 This is since this is a zoning matter there we can't really 240 00:10:37,110 --> 00:10:37,960 take. Definitely 241 00:10:37,960 --> 00:10:41,470 gonna have access to Country Club and then there's a street 242 00:10:41,470 --> 00:10:42,960 stubbed out from 243 00:10:42,960 --> 00:10:49,899 the east and our code requires them to connect to that. I 244 00:10:49,899 --> 00:10:51,840 believe we also 245 00:10:51,840 --> 00:10:56,279 require connectivity to the south and I just don't I don't 246 00:10:56,279 --> 00:10:57,559 recall how many 247 00:10:57,559 --> 00:11:00,559 connection points you had on Country Club. At least one. 248 00:11:00,559 --> 00:11:01,759 One to the south and 249 00:11:01,759 --> 00:11:06,159 one to the east. Just one. 250 00:11:12,960 --> 00:11:23,240 Lee do you want to I think have a little more of a 251 00:11:23,240 --> 00:11:24,120 conversation if 252 00:11:24,120 --> 00:11:26,330 you want to come up and maybe you can answer some questions 253 00:11:26,330 --> 00:11:28,919 . Thank you. 254 00:11:32,080 --> 00:11:36,159 I'm sorry Lee Allison with Allison Engineering Group. 255 00:11:36,159 --> 00:11:37,519 Appreciate the visit 256 00:11:37,519 --> 00:11:41,120 to opportunity to visit here briefly. We do have a concept 257 00:11:41,120 --> 00:11:42,440 plan that'll be in my 258 00:11:42,440 --> 00:11:46,850 presentation this evening. It does include connection to 259 00:11:46,850 --> 00:11:47,759 the east and a 260 00:11:47,759 --> 00:11:50,210 connection to the west of Country Club Road and it does 261 00:11:50,210 --> 00:11:51,519 cross the floodplain in 262 00:11:51,519 --> 00:11:55,909 the developed portion or the developed floodplain portion 263 00:11:55,909 --> 00:11:58,519 of it and so the 264 00:11:58,519 --> 00:12:01,600 connectivity will be there. We've had some discussions 265 00:12:01,600 --> 00:12:02,519 about going to the 266 00:12:02,519 --> 00:12:05,039 south but I think because of the gas well and other reasons 267 00:12:05,039 --> 00:12:05,840 we thought we may 268 00:12:05,840 --> 00:12:10,490 not but that's not necessarily a closed discussion at this 269 00:12:10,490 --> 00:12:11,159 time. 270 00:12:11,159 --> 00:12:14,799 Commissioner Beck. Thank you chair. I was gonna wait until 271 00:12:14,799 --> 00:12:15,799 the public hearing to 272 00:12:15,799 --> 00:12:20,450 act just but since we got you up here the egress or ingress 273 00:12:20,450 --> 00:12:21,480 from the east which 274 00:12:21,480 --> 00:12:26,710 is the metal land? Metal I think so. Okay is that gonna 275 00:12:26,710 --> 00:12:28,000 extend all the way across 276 00:12:28,000 --> 00:12:32,009 the property to Country Club? It's gonna wind through the 277 00:12:32,009 --> 00:12:33,799 property to Country 278 00:12:33,799 --> 00:12:37,919 Club. Okay. So in our concept plan and I'm gonna ask the 279 00:12:37,919 --> 00:12:39,879 attorney for comment I'm 280 00:12:39,879 --> 00:12:42,559 not sure how much it's appropriate for me to speak up now. 281 00:12:42,559 --> 00:12:43,659 We should wait until the 282 00:12:43,659 --> 00:12:46,279 regular session in order to go through that. I think we're 283 00:12:46,279 --> 00:12:46,919 staying in this room 284 00:12:46,919 --> 00:12:51,580 tonight because there's construction in the chamber. I'll 285 00:12:51,580 --> 00:12:53,320 be glad to answer 286 00:12:53,320 --> 00:12:56,259 any other questions that are appropriate for me at this 287 00:12:56,259 --> 00:12:57,320 time. Thank you. 288 00:12:57,320 --> 00:13:10,720 Thank you Lee. Any other questions? I'd have one and we may 289 00:13:10,720 --> 00:13:11,480 get into this a little 290 00:13:11,480 --> 00:13:16,679 later. Are they gonna be coming back with doing some type 291 00:13:16,679 --> 00:13:17,480 of a letter of map 292 00:13:17,480 --> 00:13:22,289 revision or or Clomore or something to narrow that flood 293 00:13:22,289 --> 00:13:24,840 plain as well and that 294 00:13:24,840 --> 00:13:28,259 I know that's extra beyond what we're talking about with 295 00:13:28,259 --> 00:13:30,240 zoning but they will 296 00:13:30,240 --> 00:13:33,080 they will have to submit for a conditional letter of map 297 00:13:33,080 --> 00:13:33,720 revision of 298 00:13:33,720 --> 00:13:36,600 Clomore and Lomar just because there's a street that's 299 00:13:36,600 --> 00:13:37,600 gonna be proposed across 300 00:13:37,600 --> 00:13:40,629 that creek and so that being said they're gonna have to 301 00:13:40,629 --> 00:13:41,600 reduce that flood 302 00:13:41,600 --> 00:13:44,080 plain to be contained within a pipe system at the road 303 00:13:44,080 --> 00:13:46,000 crossing. Okay great 304 00:13:46,000 --> 00:13:59,720 thank you. Any other questions for staff on this item? The 305 00:13:59,720 --> 00:14:01,399 next item is the 306 00:14:01,399 --> 00:14:06,250 specific use permit for the QT on Carroll and I'll invite 307 00:14:06,250 --> 00:14:08,759 Julie Wyatt up. 308 00:14:08,759 --> 00:14:13,840 Hi I'm Julie Wyatt. The request before you is to consider 309 00:14:13,840 --> 00:14:15,159 making recommendation to 310 00:14:15,159 --> 00:14:19,940 City Council regarding amending an SUP for the QT at 311 00:14:19,940 --> 00:14:22,879 Carroll and Eagle to allow 312 00:14:22,879 --> 00:14:26,529 them to add 16 more parking spaces to the site. The subject 313 00:14:26,529 --> 00:14:28,000 property is located 314 00:14:28,000 --> 00:14:33,509 on the corner here at Eagle in North Carroll. It's in a 315 00:14:33,509 --> 00:14:35,120 downtown commercial 316 00:14:35,120 --> 00:14:38,970 general zoning district. This zoning district does require 317 00:14:38,970 --> 00:14:40,059 a specific use 318 00:14:40,059 --> 00:14:45,279 permit for the use which is quick vehicle servicing. That 319 00:14:45,279 --> 00:14:46,879 SUP was approved 320 00:14:46,879 --> 00:14:51,600 in 2002 by the City Council and that that development 321 00:14:51,600 --> 00:14:53,000 included a 5,000 square 322 00:14:53,000 --> 00:14:57,379 foot retail building, 12 fuel pumps, 26 parking spaces, a 323 00:14:57,379 --> 00:14:58,799 little over 58,000 324 00:14:58,799 --> 00:15:04,600 square feet of impervious surface and then 25,594 square 325 00:15:04,600 --> 00:15:05,639 feet of new tree 326 00:15:05,639 --> 00:15:08,559 canopy. Yes sir. Commissioner Beck. Thank you chair because 327 00:15:08,559 --> 00:15:09,799 I'm gonna get in part of 328 00:15:09,799 --> 00:15:13,159 this later but the 26 parking spaces does that include 329 00:15:13,159 --> 00:15:14,440 where the pumps are at 330 00:15:14,440 --> 00:15:16,629 or they consider parking spaces? Those are not considered 331 00:15:16,629 --> 00:15:19,240 parking spaces. Okay thanks. 332 00:15:19,240 --> 00:15:23,690 And here is that site plan associated with that with that 333 00:15:23,690 --> 00:15:25,559 SUP. Here's the I 334 00:15:25,559 --> 00:15:31,559 don't know what the black lines are. Here is the here's the 335 00:15:31,559 --> 00:15:32,080 building the 336 00:15:32,080 --> 00:15:35,440 gas pumps. They had access they have access to Carroll as 337 00:15:35,440 --> 00:15:36,399 well as Eagle and 338 00:15:36,399 --> 00:15:41,059 Myrtle. And then here is the landscape plan associated with 339 00:15:41,059 --> 00:15:41,960 it. They had street 340 00:15:41,960 --> 00:15:46,940 trees and some some landscape islands out by by the right 341 00:15:46,940 --> 00:15:49,120 of way. So here's 342 00:15:49,120 --> 00:15:53,009 what they're proposing. With this request they're proposing 343 00:15:53,009 --> 00:15:54,080 16 additional 344 00:15:54,080 --> 00:15:57,830 parking spaces and those are in the yellow. A pedestrian 345 00:15:57,830 --> 00:15:59,159 crossing to connect 346 00:15:59,159 --> 00:16:03,850 to this sidewalk on Carroll to the the retail building. In 347 00:16:03,850 --> 00:16:05,279 order to meet the 348 00:16:05,279 --> 00:16:07,940 screening requirements in the Denton Development Code there 349 00:16:07,940 --> 00:16:08,559 's a proposed 350 00:16:08,559 --> 00:16:12,169 three-foot masonry wall here that to match the the retail 351 00:16:12,169 --> 00:16:14,320 building. And then 352 00:16:14,320 --> 00:16:18,269 an inlet filter here which I'll go over in just a minute. 353 00:16:18,269 --> 00:16:18,919 Deborah might have 354 00:16:18,919 --> 00:16:22,799 additional information. And all of these proposed 355 00:16:22,799 --> 00:16:26,440 improvements would result in an 356 00:16:26,440 --> 00:16:33,519 impervious surface of 63,963 square feet which is 68%. Just 357 00:16:33,519 --> 00:16:35,000 to note that is that 358 00:16:35,000 --> 00:16:38,250 meets the Denton Development Code requirements for DCG 359 00:16:38,250 --> 00:16:38,679 which which 360 00:16:38,679 --> 00:16:44,039 permits a maximum of 85% lot coverage. So to go a little 361 00:16:44,039 --> 00:16:46,039 further into that inlet 362 00:16:46,039 --> 00:16:50,740 filter what this is it's it's it's a it's a bucket like 363 00:16:50,740 --> 00:16:52,039 structure that they 364 00:16:52,039 --> 00:16:57,070 put inside and in the existing curb inlet and as water 365 00:16:57,070 --> 00:16:58,960 during a rain event 366 00:16:58,960 --> 00:17:03,659 flows into that inlet a portion of that water will go into 367 00:17:03,659 --> 00:17:04,920 that bucket and 368 00:17:04,920 --> 00:17:09,039 through a filter. So it will then filter out as Deborah 369 00:17:09,039 --> 00:17:10,480 said floatable so anything 370 00:17:10,480 --> 00:17:14,490 that floats as well as any other pollution that's in that 371 00:17:14,490 --> 00:17:15,359 water. So that 372 00:17:15,359 --> 00:17:21,910 that's what that that filter would do. And the point of 373 00:17:21,910 --> 00:17:23,440 that is to reduce the 374 00:17:23,440 --> 00:17:26,190 pollutants particularly that are caused by the additional 375 00:17:26,190 --> 00:17:28,119 impervious surface. And 376 00:17:28,119 --> 00:17:33,519 then yes sir. Commissioner Beth. Thank you Chair. That area 377 00:17:33,519 --> 00:17:34,180 where they put the new 378 00:17:34,180 --> 00:17:39,519 parking spaces is way back there away from that drainage. 379 00:17:39,519 --> 00:17:41,319 Is everything pitched 380 00:17:41,319 --> 00:17:46,569 in that direction or? That's a really good question. No. It 381 00:17:46,569 --> 00:17:47,880 's an existing curb 382 00:17:47,880 --> 00:17:50,829 inlet and and as we were working with them and as we were 383 00:17:50,829 --> 00:17:51,880 talking with them 384 00:17:51,880 --> 00:17:55,549 this location you're right this does not necessarily drain 385 00:17:55,549 --> 00:17:57,640 here but this area the 386 00:17:57,640 --> 00:18:01,130 the pump area would drain there. So we can kind of infer 387 00:18:01,130 --> 00:18:02,440 that that's going to 388 00:18:02,440 --> 00:18:06,200 be an area that may see a lot of pollution and so since 389 00:18:06,200 --> 00:18:06,559 this 390 00:18:06,559 --> 00:18:10,210 infrastructure was already there it made sense to put that 391 00:18:10,210 --> 00:18:12,279 filter there to have a 392 00:18:12,279 --> 00:18:16,039 greater impact on on the runoff and the pollutants 393 00:18:16,039 --> 00:18:17,559 suspended within that runoff. 394 00:18:17,559 --> 00:18:20,920 But it's actually not going to help the 16 new parking. It 395 00:18:20,920 --> 00:18:22,119 won't help that but 396 00:18:22,119 --> 00:18:25,869 what it will do and let me I'm gonna show you this is 397 00:18:25,869 --> 00:18:27,359 schematic it is not 398 00:18:27,359 --> 00:18:39,829 where here this may help because I had the same question. 399 00:18:39,829 --> 00:18:41,480 So this is something 400 00:18:41,480 --> 00:18:43,670 that the applicant put together I said what is actually 401 00:18:43,670 --> 00:18:44,480 draining in there 402 00:18:44,480 --> 00:18:48,109 because it's I think it's a good question and and this is 403 00:18:48,109 --> 00:18:49,480 this yellow area 404 00:18:49,480 --> 00:18:53,859 is what they're showing would would actually potentially 405 00:18:53,859 --> 00:18:55,200 drain in that area 406 00:18:55,200 --> 00:18:58,380 which does take up some existing parking as well as those 407 00:18:58,380 --> 00:19:00,839 pump areas. So yes the 408 00:19:00,839 --> 00:19:04,000 the new parking area wouldn't necessarily flow in there but 409 00:19:04,000 --> 00:19:04,519 it would 410 00:19:04,519 --> 00:19:09,160 accommodate an impervious surface that is equal to or 411 00:19:09,160 --> 00:19:10,839 greater than what they're 412 00:19:10,839 --> 00:19:14,940 proposing as far as new pervious surface impervious surface 413 00:19:14,940 --> 00:19:16,319 . So those 414 00:19:16,319 --> 00:19:19,940 parking spaces wouldn't flow in there but other impervious 415 00:19:19,940 --> 00:19:21,119 surface on the site 416 00:19:21,119 --> 00:19:25,240 which one would imagine could get equally as polluted or 417 00:19:25,240 --> 00:19:26,880 have equally as 418 00:19:26,880 --> 00:19:32,039 many things drip on it would would flow through that area. 419 00:19:32,039 --> 00:19:34,799 This is kind of a 420 00:19:36,359 --> 00:19:39,339 what would you call it again say look we can't affect this 421 00:19:39,339 --> 00:19:40,400 area but look what 422 00:19:40,400 --> 00:19:42,880 we're doing to the area that is disinherited and it's doing 423 00:19:42,880 --> 00:19:43,799 much better than it was 424 00:19:43,799 --> 00:19:47,579 before. Essentially that is what they're proposing and and 425 00:19:47,579 --> 00:19:48,920 this is an existing 426 00:19:48,920 --> 00:19:51,740 infrastructure this is where the storm sewer goes to so 427 00:19:51,740 --> 00:19:52,720 that that's why it 428 00:19:52,720 --> 00:19:57,099 made sense for that location. Okay thank you. The proposal 429 00:19:57,099 --> 00:19:59,000 also would reduce the 430 00:19:59,000 --> 00:20:05,730 the existing tree canopy down to 25% to 23,800 square feet 431 00:20:05,730 --> 00:20:07,799 and here and here's 432 00:20:07,799 --> 00:20:11,549 how that's made up. These four trees would have to be 433 00:20:11,549 --> 00:20:13,079 actually relocated as 434 00:20:13,079 --> 00:20:15,799 as a result of this request and I'll show you those 435 00:20:15,799 --> 00:20:17,200 locations in a moment but 436 00:20:17,200 --> 00:20:20,900 they're proposing to relocate these four trees. These these 437 00:20:20,900 --> 00:20:22,079 trees they are 438 00:20:22,079 --> 00:20:27,009 proposing would have to be taken down as a result of this 439 00:20:27,009 --> 00:20:29,500 request and there's the 440 00:20:29,500 --> 00:20:34,680 location for those those relocated trees. This is kind of 441 00:20:34,680 --> 00:20:36,759 just a rendering of what 442 00:20:36,759 --> 00:20:40,319 they're proposing part of the reason for this request is 443 00:20:40,319 --> 00:20:41,400 that they are adding 444 00:20:41,400 --> 00:20:44,250 that side door adjacent to Carroll so they're they're 445 00:20:44,250 --> 00:20:45,420 wanting additional 446 00:20:45,420 --> 00:20:49,210 parking spaces next to that side door. The considerations 447 00:20:49,210 --> 00:20:50,559 that staff looked at 448 00:20:50,559 --> 00:20:54,859 since this proposal is purely a modification of an existing 449 00:20:54,859 --> 00:20:55,359 use it 450 00:20:55,359 --> 00:20:59,369 really is just to renovate an existing commercial use not 451 00:20:59,369 --> 00:21:00,640 adding an additional 452 00:21:00,640 --> 00:21:05,279 use to the area. It doesn't substantially affect the 453 00:21:05,279 --> 00:21:07,240 existing scalar form and it 454 00:21:07,240 --> 00:21:13,660 also complies with the with the the impervious cover and 455 00:21:13,660 --> 00:21:15,440 and and the building 456 00:21:15,440 --> 00:21:19,190 envelope for the governing zoning district for DCG so the 457 00:21:19,190 --> 00:21:20,200 impacts on the 458 00:21:20,200 --> 00:21:24,210 adjacent properties would be minimal. The inlet filter 459 00:21:24,210 --> 00:21:25,880 would address some of the 460 00:21:25,880 --> 00:21:30,160 pollution issues that are associated with additional 461 00:21:30,160 --> 00:21:31,839 parking so that that 462 00:21:31,839 --> 00:21:35,240 would that was a consideration that staff looked at and the 463 00:21:35,240 --> 00:21:36,640 request does 464 00:21:36,640 --> 00:21:41,279 comply with all of the criteria for specific use permits 465 00:21:41,279 --> 00:21:42,599 within subchapter 466 00:21:42,599 --> 00:21:47,859 six. Based upon that staff does recommend approval of the 467 00:21:47,859 --> 00:21:48,920 request but we do have 468 00:21:48,920 --> 00:21:53,559 it subject to some conditions. First that the proposal does 469 00:21:53,559 --> 00:21:54,200 substantially 470 00:21:54,200 --> 00:21:57,109 conform to the attached site plan, landscape plan, and 471 00:21:57,109 --> 00:21:57,960 grading plan is 472 00:21:57,960 --> 00:22:03,349 submitted and that includes that five foot REM Triton curb 473 00:22:03,349 --> 00:22:05,119 inlet filter with a 474 00:22:05,119 --> 00:22:10,369 replaceable REM fog media pack. It should be installed and 475 00:22:10,369 --> 00:22:11,400 maintained in the 476 00:22:11,400 --> 00:22:15,279 northwest corner of the site as depicted on the site plan. 477 00:22:15,279 --> 00:22:16,400 The applicant must 478 00:22:16,400 --> 00:22:19,769 submit three reports per calendar year to the planning 479 00:22:19,769 --> 00:22:21,400 division demonstrating 480 00:22:21,400 --> 00:22:24,170 that the curb inlet filter has been inspected and 481 00:22:24,170 --> 00:22:25,599 maintained a minimum of 482 00:22:25,599 --> 00:22:28,519 three times per year or when the debris or an accumulation 483 00:22:28,519 --> 00:22:29,759 reaches 80% of 484 00:22:29,759 --> 00:22:34,400 filtered capacity. Additionally the reports must confirm 485 00:22:34,400 --> 00:22:35,279 must provide 486 00:22:35,279 --> 00:22:41,279 confirmation that the REM, I think I have a typo there, FOG 487 00:22:41,279 --> 00:22:44,640 replaceable media has been replaced at least once per year 488 00:22:44,640 --> 00:22:45,759 when the media pack 489 00:22:45,759 --> 00:22:50,240 is 50% coated with contaminants. They have to provide that 490 00:22:50,240 --> 00:22:51,200 marked pedestrian 491 00:22:51,200 --> 00:22:56,630 connection as depicted on the site plan and also maintain 492 00:22:56,630 --> 00:22:58,000 relocate those four 493 00:22:58,000 --> 00:23:01,029 trees that they are proposing to relocate as shown on the 494 00:23:01,029 --> 00:23:01,920 landscape plan. 495 00:23:01,920 --> 00:23:06,569 In addition to that staff has one more recommendation and 496 00:23:06,569 --> 00:23:08,480 that is for four 497 00:23:08,480 --> 00:23:12,730 additional trees to be planted on the site. As a result of 498 00:23:12,730 --> 00:23:14,000 this proposal as I 499 00:23:14,000 --> 00:23:18,650 discussed the tree canopy would be lowered from to that 25 500 00:23:18,650 --> 00:23:20,079 %. In order to 501 00:23:20,079 --> 00:23:23,759 maintain the existing tree canopy on the site we're we're 502 00:23:23,759 --> 00:23:24,720 proposing a condition 503 00:23:24,720 --> 00:23:28,230 that they do plant four two-inch caliper trees to be 504 00:23:28,230 --> 00:23:29,960 planted in accordance with 505 00:23:29,960 --> 00:23:33,319 the landscape and tree canopy requirements in subchapter 13 506 00:23:33,319 --> 00:23:34,839 . Yes sir. 507 00:23:34,839 --> 00:23:38,019 Commissioner Beck. Thank you chair. Did you show us where 508 00:23:38,019 --> 00:23:39,200 those four new trees were going? 509 00:23:39,200 --> 00:23:44,160 No that would be, yes they would need to be planted as a 510 00:23:44,160 --> 00:23:45,920 part of the site plan 511 00:23:45,920 --> 00:23:51,069 process and building permit. How many trees are we pulling 512 00:23:51,069 --> 00:23:53,039 out? This is the 513 00:23:53,039 --> 00:23:55,440 tree survey and I believe it's in your backup as well. I 514 00:23:55,440 --> 00:23:57,079 think there are one two 515 00:23:57,079 --> 00:24:00,549 three four five trees that were that were being removed 516 00:24:00,549 --> 00:24:01,880 some larger and some 517 00:24:01,880 --> 00:24:05,519 smaller and I didn't I didn't suggest we didn't suggest 518 00:24:05,519 --> 00:24:07,440 five trees because we 519 00:24:07,440 --> 00:24:11,500 looked at the overall canopy and so we wanted we wanted to 520 00:24:11,500 --> 00:24:12,759 maintain or get 521 00:24:12,759 --> 00:24:17,599 close to maintaining that existing canopy. Okay thank you. 522 00:24:17,599 --> 00:24:18,640 Sure. Commissioner 523 00:24:18,640 --> 00:24:23,859 Hatchbeth. Can we go back and look at whatever you would 524 00:24:23,859 --> 00:24:25,160 purport to be your 525 00:24:25,160 --> 00:24:31,220 best slide depicting where I'm trying to get my head around 526 00:24:31,220 --> 00:24:33,920 exactly where the 527 00:24:33,920 --> 00:24:38,000 I have a general idea where the parking space is going but 528 00:24:38,000 --> 00:24:39,319 I want to have 529 00:24:39,319 --> 00:24:44,160 questions of where the driveway is I'm just not real clear 530 00:24:44,160 --> 00:24:45,119 and where the 531 00:24:45,119 --> 00:24:48,150 driveway currently is that so I guess it would be the one 532 00:24:48,150 --> 00:24:51,279 that it's most south. 533 00:24:51,279 --> 00:24:54,970 Yes sir it is this one right here on Carroll. Okay and then 534 00:24:54,970 --> 00:24:56,079 so where are the 535 00:24:56,079 --> 00:25:01,140 new? It's in the yellow right here. Okay. So there's there 536 00:25:01,140 --> 00:25:02,519 's some behind it and 537 00:25:02,519 --> 00:25:07,160 then on the side adjacent to the retail and then and then 538 00:25:07,160 --> 00:25:07,680 and then here 539 00:25:07,680 --> 00:25:12,539 adjacent to Carroll. Okay and are there no concern I mean 540 00:25:12,539 --> 00:25:13,200 because it's pretty 541 00:25:13,200 --> 00:25:17,069 difficult to get in there as is right because you're on 542 00:25:17,069 --> 00:25:18,319 Carroll and so you're 543 00:25:18,319 --> 00:25:23,359 like 45 ish and you slide in and you're gonna have people 544 00:25:23,359 --> 00:25:24,839 walking across there 545 00:25:24,839 --> 00:25:29,220 which then backs up on to Carroll you get maybe what three 546 00:25:29,220 --> 00:25:32,440 cars before so if 547 00:25:32,440 --> 00:25:35,920 someone's backing out you know and they're not at all 548 00:25:35,920 --> 00:25:37,319 comfortable with it 549 00:25:37,319 --> 00:25:40,680 or this I know I mean is that a concern at all? Engineering 550 00:25:40,680 --> 00:25:41,599 has reviewed it and 551 00:25:41,599 --> 00:25:45,049 and it meets the criteria for approval for for the 552 00:25:45,049 --> 00:25:47,079 transportation and for the 553 00:25:47,079 --> 00:25:56,400 stacking. Okay thank you. And Earl will come up. 554 00:25:58,519 --> 00:26:02,039 It met our I'm sorry it met our minimum stacking 555 00:26:02,039 --> 00:26:04,039 requirements from a public 556 00:26:04,039 --> 00:26:08,480 library that's our main concern is really backing up into 557 00:26:08,480 --> 00:26:09,599 Carroll with 558 00:26:09,599 --> 00:26:12,460 these parking parking spaces that you know the car has to 559 00:26:12,460 --> 00:26:13,279 wait for a car to 560 00:26:13,279 --> 00:26:17,920 back out and exit will that result in a stacking back into 561 00:26:17,920 --> 00:26:19,720 Carroll Boulevard and 562 00:26:19,720 --> 00:26:23,410 that's those parking spaces are far back are into the side 563 00:26:23,410 --> 00:26:24,640 enough to prevent 564 00:26:24,640 --> 00:26:31,319 that from happening. Continue sure. Yeah so what is that 565 00:26:31,319 --> 00:26:33,039 walk me through I mean 566 00:26:33,039 --> 00:26:35,980 because I don't just my experience with that filling 567 00:26:35,980 --> 00:26:37,440 station so you have where 568 00:26:37,440 --> 00:26:43,200 the crosswalk is you'll have the air station is just to the 569 00:26:43,200 --> 00:26:44,599 north of that 570 00:26:44,599 --> 00:26:48,700 which in and of itself causes a little bit of a backup and 571 00:26:48,700 --> 00:26:51,200 then so most people 572 00:26:51,200 --> 00:26:55,400 avoid that second driveway near that crosswalk and they 573 00:26:55,400 --> 00:26:56,480 would opt to pull 574 00:26:56,480 --> 00:27:03,109 into that back one there and so I just no no the yes right 575 00:27:03,109 --> 00:27:04,160 there so I think 576 00:27:04,160 --> 00:27:09,859 most people coming on to the site use that entrance and it 577 00:27:09,859 --> 00:27:11,519 's almost before you 578 00:27:11,519 --> 00:27:14,339 see the gas station so it's kind of almost like a second 579 00:27:14,339 --> 00:27:15,440 thoughts like oh I'll 580 00:27:15,440 --> 00:27:21,279 pull in here type thing and so I'm really I'm just curious 581 00:27:21,279 --> 00:27:22,519 how many cars you you 582 00:27:22,519 --> 00:27:27,259 will stack there I guess is the simplest question if if 583 00:27:27,259 --> 00:27:28,759 someone's backing out 584 00:27:28,759 --> 00:27:31,059 let's say in the first base of the yellow nearest the 585 00:27:31,059 --> 00:27:32,480 building how many 586 00:27:32,480 --> 00:27:36,759 cars can you get waiting before it gets on the Carol if a 587 00:27:36,759 --> 00:27:39,039 car was in these 588 00:27:39,039 --> 00:27:42,130 spaces and happen to block the traffic from entering the 589 00:27:42,130 --> 00:27:42,880 site yes how many 590 00:27:42,880 --> 00:27:45,789 cars would it would it take to back in the Carol yes sir it 591 00:27:45,789 --> 00:27:46,599 is four vehicles 592 00:27:46,599 --> 00:27:54,599 four okay thank you commissioner Taylor thank you chair so 593 00:27:54,599 --> 00:27:55,839 I noticed on the 594 00:27:55,839 --> 00:28:00,000 original site plan there is an area of pervious paving yes 595 00:28:00,000 --> 00:28:00,880 and that's 596 00:28:00,880 --> 00:28:04,480 approximately where the parking spots are now behind to the 597 00:28:04,480 --> 00:28:05,960 yeah so that's and 598 00:28:05,960 --> 00:28:09,599 it's ten feet off the building and it's 20 feet wide so if 599 00:28:09,599 --> 00:28:11,359 you go to the the new 600 00:28:11,359 --> 00:28:15,410 the new site plan that's basically just exactly where those 601 00:28:15,410 --> 00:28:17,599 yellow spots are and 602 00:28:17,599 --> 00:28:22,519 why was that pervious this is all it was for fire access 603 00:28:22,519 --> 00:28:24,759 for fire access so that 604 00:28:24,759 --> 00:28:29,829 was not used for so normally nobody volunteers for pervious 605 00:28:29,829 --> 00:28:31,359 paving so I was 606 00:28:31,359 --> 00:28:34,450 wondering if there was a requirement if they were using per 607 00:28:34,450 --> 00:28:35,960 vious paving because 608 00:28:35,960 --> 00:28:41,539 they were exceeding some other I am not sure because they 609 00:28:41,539 --> 00:28:42,640 don't they don't get 610 00:28:42,640 --> 00:28:47,890 close to the the maximum lot coverage so I'm not really 611 00:28:47,890 --> 00:28:49,519 sure why they elected to 612 00:28:49,519 --> 00:28:54,680 do those pervious there instead of pavement and I guess 613 00:28:54,680 --> 00:28:56,240 that that is the 614 00:28:56,240 --> 00:29:00,250 most significant addition of concrete is that 34 by 70 is 615 00:29:00,250 --> 00:29:01,640 basically all new yes 616 00:29:01,640 --> 00:29:05,440 sir that's where most of the 10,000 square feet of new 617 00:29:05,440 --> 00:29:09,920 pavement is okay I'll 618 00:29:09,920 --> 00:29:13,920 ask some questions and I guess nobody else 619 00:29:17,039 --> 00:29:22,029 currently they're at 68 and they're permitted to have 85 620 00:29:22,029 --> 00:29:23,480 percent coverage 621 00:29:23,480 --> 00:29:28,910 there they're there as proposed it would be 68 I believe it 622 00:29:28,910 --> 00:29:30,720 's 46 percent how 623 00:29:30,720 --> 00:29:33,750 they are now they're way under though from what they could 624 00:29:33,750 --> 00:29:38,039 be there have it 625 00:29:38,039 --> 00:29:41,230 after this they'll have a 25 percent tree canopy they're 626 00:29:41,230 --> 00:29:42,279 only required to have 627 00:29:42,279 --> 00:29:48,529 20 yes so why are they having to plant four two-inch trees 628 00:29:48,529 --> 00:29:50,200 and why are they 629 00:29:50,200 --> 00:29:53,970 putting in that filter out there when their site is in 630 00:29:53,970 --> 00:29:55,519 compliance it seems 631 00:29:55,519 --> 00:29:58,170 like they're doing extra things that aren't required they 632 00:29:58,170 --> 00:29:59,000 actually are 633 00:29:59,000 --> 00:30:04,490 exceeding our required parking and because they're doing 634 00:30:04,490 --> 00:30:05,960 that staff worked 635 00:30:05,960 --> 00:30:09,710 with them instead of going through the ADP process we 636 00:30:09,710 --> 00:30:10,480 actually did work with 637 00:30:10,480 --> 00:30:13,700 them on doing an ADP for the excess parking because they 638 00:30:13,700 --> 00:30:14,759 are exceeding the 639 00:30:14,759 --> 00:30:19,410 the permitted parking so but in the end we said let's just 640 00:30:19,410 --> 00:30:20,160 move forward with the 641 00:30:20,160 --> 00:30:22,630 SUP because that you know that will be backed up by 642 00:30:22,630 --> 00:30:24,880 ordinance so and it's it's 643 00:30:24,880 --> 00:30:27,859 approved by City Council so they're actually doing those 644 00:30:27,859 --> 00:30:28,920 additional things 645 00:30:28,920 --> 00:30:32,839 because they are exceeding our maximum parking with imper 646 00:30:32,839 --> 00:30:34,759 vious surface okay so 647 00:30:34,759 --> 00:30:38,880 it's the number of parking spaces not not the impervious 648 00:30:38,880 --> 00:30:39,839 not the impervious 649 00:30:39,839 --> 00:30:46,519 okay great thank you sure Commissioner Beck just one 650 00:30:46,519 --> 00:30:47,359 general question is the 651 00:30:47,359 --> 00:30:51,799 applicant gonna be here he will be okay he's on his way I 652 00:30:51,799 --> 00:30:52,920 hope 653 00:30:54,039 --> 00:31:11,400 thank you thank you Julie okay I'm going to that's the last 654 00:31:11,400 --> 00:31:12,319 item we presentation from work session so 715 00:34:44,139 --> 00:34:45,659 this is case z 16 716 00:34:45,659 --> 00:34:49,579 25 for Country Club Road estates the request was to hold a 717 00:34:49,579 --> 00:34:50,599 public hearing and 718 00:34:50,599 --> 00:34:53,500 consider a request to rezone approximately 15 and a half 719 00:34:53,500 --> 00:34:54,079 acres from 720 00:34:54,079 --> 00:34:57,170 neighborhood residential 2 to neighborhood residential 3 721 00:34:57,170 --> 00:34:57,840 and to rezone 722 00:34:57,840 --> 00:35:00,960 approximately 20 acres from neighborhood residential 4 to 723 00:35:00,960 --> 00:35:01,300 neighborhood 724 00:35:01,300 --> 00:35:06,760 residential 3 the property is comprised of four parcels of 725 00:35:06,760 --> 00:35:07,760 land located on the 726 00:35:07,760 --> 00:35:11,800 east side of Country Club Road just south of Regency Court 727 00:35:11,800 --> 00:35:13,519 some just for a 728 00:35:13,519 --> 00:35:16,289 reference the property is you can see the Country Club and 729 00:35:16,289 --> 00:35:17,199 Fort Worth Drive 730 00:35:17,199 --> 00:35:19,150 intersection at the north side of the map to give you a 731 00:35:19,150 --> 00:35:20,079 reference point there 732 00:35:20,079 --> 00:35:23,730 the Regency Oak subdivision adjoins it to the north the Alp 733 00:35:23,730 --> 00:35:24,960 aceo addition adjoins 734 00:35:24,960 --> 00:35:28,119 it to the east Bent Creek Estates is located just across 735 00:35:28,119 --> 00:35:28,960 Country Club Road 736 00:35:28,960 --> 00:35:32,489 and then a tributary of Hickory Creek runs north south 737 00:35:32,489 --> 00:35:35,000 through the property so 738 00:35:35,000 --> 00:35:37,570 as I mentioned earlier currently 15 and a half acres are z 739 00:35:37,570 --> 00:35:38,480 oned in our two that's 740 00:35:38,480 --> 00:35:42,400 about 43% of the property 20.1 six acres are zoned in our 741 00:35:42,400 --> 00:35:43,440 four that makes up about 742 00:35:43,440 --> 00:35:47,389 56% of the property and the proposal is to take all four 743 00:35:47,389 --> 00:35:48,880 parcels to the NR3 744 00:35:48,880 --> 00:35:53,519 district the future land use designation is low residential 745 00:35:53,519 --> 00:35:54,199 so that allows for 746 00:35:54,199 --> 00:35:56,780 single-family subdivisions up to four dwelling units per 747 00:35:56,780 --> 00:35:58,920 acre in density this 748 00:35:58,920 --> 00:36:01,500 designation encourages new single-family residential 749 00:36:01,500 --> 00:36:02,360 development that is 750 00:36:02,360 --> 00:36:04,869 compatible with existing neighborhoods and promotes a 751 00:36:04,869 --> 00:36:06,119 variety of housing styles 752 00:36:06,119 --> 00:36:10,849 types and price points some considerations for this rez 753 00:36:10,849 --> 00:36:11,599 oning to NR3 754 00:36:11,599 --> 00:36:15,429 is not inconsistent with the surrounding pattern there is 755 00:36:15,429 --> 00:36:16,840 NR3 located across 756 00:36:16,840 --> 00:36:20,119 Country Club Road to the west of this property the uses 757 00:36:20,119 --> 00:36:21,400 that are permitted 758 00:36:21,400 --> 00:36:24,170 within the NR3 district which are primarily single-family 759 00:36:24,170 --> 00:36:24,920 dwelling units 760 00:36:24,920 --> 00:36:28,710 are consistent with existing development in the area multif 761 00:36:28,710 --> 00:36:29,840 amily and duplex uses 762 00:36:29,840 --> 00:36:32,130 would not be permitted in either the current or the 763 00:36:32,130 --> 00:36:33,320 proposed zoning districts 764 00:36:33,320 --> 00:36:37,190 and NR3 is also consistent with the future land use 765 00:36:37,190 --> 00:36:38,599 designation of low 766 00:36:38,599 --> 00:36:45,760 residential so for comparison here's the general 767 00:36:45,760 --> 00:36:46,800 regulations that would apply 768 00:36:46,800 --> 00:36:50,369 subdivisions greater than two acres don't have minimum lot 769 00:36:50,369 --> 00:36:51,239 sizes we go by 770 00:36:51,239 --> 00:36:54,429 a density so NR3 allows up to three and a half dwelling 771 00:36:54,429 --> 00:36:55,400 units per acre in 772 00:36:55,400 --> 00:36:59,000 comparison the NR2 portion would allow two and our four 773 00:36:59,000 --> 00:36:59,719 would allow four 774 00:36:59,719 --> 00:37:02,300 dwelling units per acre you can see that in the other 775 00:37:02,300 --> 00:37:04,079 criteria and our three is 776 00:37:04,079 --> 00:37:07,369 an intermediate between the two existing zoning districts 777 00:37:07,369 --> 00:37:08,360 so it kind of provides 778 00:37:08,360 --> 00:37:11,360 a smoother transition in scale and density between the 779 00:37:11,360 --> 00:37:12,360 current in our two 780 00:37:12,360 --> 00:37:16,739 subdivisions that surround this and what's being proposed 781 00:37:16,739 --> 00:37:18,679 currently under the 782 00:37:18,679 --> 00:37:21,110 two existing zoning districts it would allow for up to a 783 00:37:21,110 --> 00:37:22,039 hundred and eleven 784 00:37:22,039 --> 00:37:25,250 lots or dwelling a hundred and eleven dwelling units per 785 00:37:25,250 --> 00:37:26,840 acre and the 786 00:37:26,840 --> 00:37:29,619 proposal would allow for a hundred and twenty four lots or 787 00:37:29,619 --> 00:37:30,519 a hundred and twenty 788 00:37:30,519 --> 00:37:33,329 four dwelling units per acre the applicant has stated that 789 00:37:33,329 --> 00:37:34,000 their intent 790 00:37:34,000 --> 00:37:38,840 would be to develop between 73 and 78 lots in this area 791 00:37:38,840 --> 00:37:40,679 depending on the final 792 00:37:40,679 --> 00:37:44,230 physical constraints that are imposed on the area based on 793 00:37:44,230 --> 00:37:45,760 floodplain that exists 794 00:37:45,760 --> 00:37:49,139 as you can see here in blue that's the existing floodplain 795 00:37:49,139 --> 00:37:50,239 that surrounds that 796 00:37:50,239 --> 00:37:54,519 tributary to Hickory Creek and notifications were sent 797 00:37:54,519 --> 00:37:55,659 about this we 798 00:37:55,659 --> 00:37:58,360 received two in opposition one in favor one that was 799 00:37:58,360 --> 00:37:59,519 neutral and one that was 800 00:37:59,519 --> 00:38:03,639 undecided and staff is recommending approval of the request 801 00:38:03,639 --> 00:38:04,679 because of its 802 00:38:04,679 --> 00:38:07,530 compatibility with the surrounding land uses and its 803 00:38:07,530 --> 00:38:08,679 consistency with the 804 00:38:08,679 --> 00:38:13,320 objectives of the Denton plan 2030 so I'll stand for any 805 00:38:13,320 --> 00:38:15,480 questions any 806 00:38:15,480 --> 00:38:22,829 questions for staff of the Commission thank you Haley we 807 00:38:22,829 --> 00:38:26,360 have some cards while 808 00:38:26,360 --> 00:38:29,030 I'm going through the cards I think we have the applicant 809 00:38:29,030 --> 00:38:30,119 here who wishes to 810 00:38:30,119 --> 00:38:34,760 speak and let him go ahead and call on Lee Allison the 811 00:38:34,760 --> 00:38:36,599 applicant or representing 812 00:38:36,599 --> 00:38:41,960 the applicant or some additional information and we'll go 813 00:38:41,960 --> 00:38:43,199 through cards 814 00:38:43,199 --> 00:38:48,539 the public and ask you all to come as well just a reminder 815 00:38:48,539 --> 00:38:49,559 since you do 816 00:38:49,559 --> 00:38:52,519 represent the applicant you'll have a total of ten minutes 817 00:38:52,519 --> 00:38:53,780 and if the 818 00:38:53,780 --> 00:38:56,610 applicant would like to speak as well they have ten minutes 819 00:38:56,610 --> 00:38:57,679 for a total of 20 820 00:38:57,679 --> 00:39:01,599 between all of you representing the applicant thank you I'm 821 00:39:01,599 --> 00:39:02,159 do my best to 822 00:39:02,159 --> 00:39:05,320 keep it to three or four my name is Lee Allison with 823 00:39:05,320 --> 00:39:06,659 Allison engineering group 824 00:39:06,659 --> 00:39:10,280 I'm here representing this project Kent Key could not be 825 00:39:10,280 --> 00:39:12,159 here this evening Lance 826 00:39:12,159 --> 00:39:15,170 Holdorf our project manager from Allison engineering is 827 00:39:15,170 --> 00:39:17,300 with me as well we are 828 00:39:17,300 --> 00:39:20,659 for the moment calling this country club estate spending 829 00:39:20,659 --> 00:39:21,880 another name at another 830 00:39:21,880 --> 00:39:25,030 date I'd like to just supplement the staff comments there's 831 00:39:25,030 --> 00:39:25,880 some rumors and 832 00:39:25,880 --> 00:39:28,780 concerns that have been going around we heard an indication 833 00:39:28,780 --> 00:39:29,559 that somebody 834 00:39:29,559 --> 00:39:31,550 thought there was going to be apartments out there well 835 00:39:31,550 --> 00:39:32,719 that's absolutely not the 836 00:39:32,719 --> 00:39:38,420 case none of these zoning card categories allows apartments 837 00:39:38,420 --> 00:39:38,880 at all 838 00:39:38,880 --> 00:39:41,820 there had been discussion in some of the comments turned in 839 00:39:41,820 --> 00:39:42,719 about a drainage 840 00:39:42,719 --> 00:39:45,409 plan well the drainage plan is currently underway we've 841 00:39:45,409 --> 00:39:46,440 already started an 842 00:39:46,440 --> 00:39:49,659 alternative ESA application we had hoped to bring that 843 00:39:49,659 --> 00:39:51,079 through tonight with the 844 00:39:51,079 --> 00:39:53,119 zoning but we've learned we have to have an approved 845 00:39:53,119 --> 00:39:54,519 preliminary plan so we're 846 00:39:54,519 --> 00:39:57,989 working on that and that'll be coming to you hopefully in 847 00:39:57,989 --> 00:39:59,159 the near future on the 848 00:39:59,159 --> 00:40:03,219 same agenda discussions about traffic of course there'll be 849 00:40:03,219 --> 00:40:04,159 traffic that's why the 850 00:40:04,159 --> 00:40:07,719 city has a traffic master thoroughfare plan this works well 851 00:40:07,719 --> 00:40:08,400 with that I don't 852 00:40:08,400 --> 00:40:11,340 think we're punched punching the density enough to affect 853 00:40:11,340 --> 00:40:12,260 that and we'll be 854 00:40:12,260 --> 00:40:15,320 paying impact fees that will help the city implement its 855 00:40:15,320 --> 00:40:16,639 thoroughfare plans 856 00:40:16,639 --> 00:40:20,000 one neighbor I believe to the east mentioned some drainage 857 00:40:20,000 --> 00:40:21,079 problems and as I 858 00:40:21,079 --> 00:40:23,880 read through their comments to the city they sound like 859 00:40:23,880 --> 00:40:24,880 some significant 860 00:40:24,880 --> 00:40:30,230 drainage problems however that is upstream or uphill from 861 00:40:30,230 --> 00:40:30,980 us so we're not 862 00:40:30,980 --> 00:40:33,889 draining on to their property nor contributing to those 863 00:40:33,889 --> 00:40:35,460 problems at the 864 00:40:35,460 --> 00:40:38,739 same time if there's any way that we could work along with 865 00:40:38,739 --> 00:40:39,599 the city on our 866 00:40:39,599 --> 00:40:42,960 project to leave the problems we will I think Earl can 867 00:40:42,960 --> 00:40:44,239 testify at a recent 868 00:40:44,239 --> 00:40:48,280 project Meadows Oaks we learned about some far downstream 869 00:40:48,280 --> 00:40:49,320 drainage problems 870 00:40:49,320 --> 00:40:51,789 after we already had approved construction plans and we 871 00:40:51,789 --> 00:40:52,320 went in and 872 00:40:52,320 --> 00:40:55,179 redid the street grading on those to avoid that so we're 873 00:40:55,179 --> 00:40:56,199 ready to work with 874 00:40:56,199 --> 00:41:00,079 those kind of things as that happens the NR2 zoning some 875 00:41:00,079 --> 00:41:01,199 concern well there's 876 00:41:01,199 --> 00:41:04,239 actually a very awkward zoning situation here as you've 877 00:41:04,239 --> 00:41:05,559 seen earlier we got an 878 00:41:05,559 --> 00:41:10,199 NR4 in the tan color and NR2 in the yellow the NR4 allows 879 00:41:10,199 --> 00:41:11,039 four homes per 880 00:41:11,039 --> 00:41:15,280 acre and the NR2 allows two homes per acre it's kind of a 881 00:41:15,280 --> 00:41:17,280 weird split with 882 00:41:17,280 --> 00:41:20,500 this being over a two acre site we're not subject to the 883 00:41:20,500 --> 00:41:21,300 minimum lot 884 00:41:21,300 --> 00:41:24,250 dimensions so we could squeeze all the lots in or somebody 885 00:41:24,250 --> 00:41:25,320 can squeeze all the 886 00:41:25,320 --> 00:41:32,750 lots in as they intend to oops I'm going wrong now I'm 887 00:41:32,750 --> 00:41:35,760 really in trouble 888 00:41:38,840 --> 00:41:41,719 some have already jumped to our concept plan we mentioned 889 00:41:41,719 --> 00:41:42,500 that I know the 890 00:41:42,500 --> 00:41:47,630 concept plans are not part of the zoning consideration but 891 00:41:47,630 --> 00:41:49,280 our initial concepts 892 00:41:49,280 --> 00:41:53,920 if we reclaim the part of the ESA would give us about 73 893 00:41:53,920 --> 00:41:54,679 lots we've put a 894 00:41:54,679 --> 00:41:59,449 maximum of 78 Kent wants to have 16,000 square foot lots 895 00:41:59,449 --> 00:42:00,980 minimum to the east of 896 00:42:00,980 --> 00:42:04,769 the drainage area and about 12,000 square foot lots minimum 897 00:42:04,769 --> 00:42:05,400 to west which 898 00:42:05,400 --> 00:42:09,429 is much greater than what the code requires again as we go 899 00:42:09,429 --> 00:42:10,639 through the ESA 900 00:42:10,639 --> 00:42:13,199 and the preliminary plan we'll get to that this is an 901 00:42:13,199 --> 00:42:14,679 aerial photograph of the 902 00:42:14,679 --> 00:42:18,449 site one thing I want to point out here primarily is all 903 00:42:18,449 --> 00:42:19,679 the houses that front 904 00:42:19,679 --> 00:42:22,769 Country Club Road the intention is to move those off and 905 00:42:22,769 --> 00:42:23,719 get rid of those 906 00:42:23,719 --> 00:42:26,619 driveways onto Country Club Road which I think would be an 907 00:42:26,619 --> 00:42:27,559 enhancement to the 908 00:42:27,559 --> 00:42:33,760 traffic situation let me go back me and this mouse are not 909 00:42:33,760 --> 00:42:34,920 getting a question 910 00:42:34,920 --> 00:42:38,360 Commissioner Beck thank you chair so are you talking about 911 00:42:38,360 --> 00:42:40,079 the houses on the 912 00:42:40,079 --> 00:42:43,880 property that face Country Club Road all those what are you 913 00:42:43,880 --> 00:42:44,980 gonna what you're 914 00:42:44,980 --> 00:42:49,360 moving those he's got a development out in the county 915 00:42:49,360 --> 00:42:50,840 somewhere I'm sorry I don't 916 00:42:50,840 --> 00:42:53,340 know the locating I can't disclose it I don't know it it's 917 00:42:53,340 --> 00:42:54,559 okay but he plans to 918 00:42:54,559 --> 00:42:56,679 move those they're still structurally in pretty good 919 00:42:56,679 --> 00:42:58,400 condition but they don't fit 920 00:42:58,400 --> 00:43:00,940 in with the neighborhood that he's wanting to develop plus 921 00:43:00,940 --> 00:43:01,960 all the accesses 922 00:43:01,960 --> 00:43:08,230 to Country Club Road and the fact that they all would need 923 00:43:08,230 --> 00:43:09,800 individual lots and 924 00:43:09,800 --> 00:43:12,320 it just wouldn't work well yeah well that's good news 925 00:43:12,320 --> 00:43:17,440 thanks Lee and why in the world can I 926 00:43:20,840 --> 00:43:25,909 I'm sorry I may need all ten minutes just to work these 927 00:43:25,909 --> 00:43:26,559 power points 928 00:43:27,440 --> 00:43:32,320 all right it worked they let me turn on and close all the 929 00:43:32,320 --> 00:43:33,320 kid as long as I close 930 00:43:33,320 --> 00:43:39,320 without saving okay all right there we go and there was the 931 00:43:39,320 --> 00:43:39,760 concept 932 00:43:39,760 --> 00:43:43,179 planet this one we're showing a access from I'll try and 933 00:43:43,179 --> 00:43:44,519 use the pointer to the 934 00:43:44,519 --> 00:43:49,159 east on metal and road to come through and across across 935 00:43:49,159 --> 00:43:50,000 the ESA up here 936 00:43:50,000 --> 00:43:56,079 because it's developed floodplain and then come back out to 937 00:43:56,079 --> 00:43:57,960 Country Club Road 938 00:43:57,960 --> 00:44:01,150 we've discussed with staff previously and access to the 939 00:44:01,150 --> 00:44:02,440 south however with the 940 00:44:02,440 --> 00:44:05,400 master thoroughfare plan and the arterial coming across 941 00:44:05,400 --> 00:44:06,280 there were some 942 00:44:06,280 --> 00:44:10,980 issues with it but that's not a closed discussion at this 943 00:44:10,980 --> 00:44:15,280 time and that shows 944 00:44:15,280 --> 00:44:18,469 the extent of the ESA and we're preparing an alternate ESA 945 00:44:18,469 --> 00:44:19,159 for to be able 946 00:44:19,159 --> 00:44:22,059 to bring that in but not get in not get into the stream 947 00:44:22,059 --> 00:44:23,320 buffer ESA just to be 948 00:44:23,320 --> 00:44:27,699 able to narrow the the floodplain ESA and recover some 949 00:44:27,699 --> 00:44:29,239 property there that's 950 00:44:29,239 --> 00:44:31,800 really just primarily mowed grass we're staying outside of 951 00:44:31,800 --> 00:44:32,679 the tree line and 952 00:44:32,679 --> 00:44:37,599 outside of the floodplain ESA I mean stream buffer ESA but 953 00:44:37,599 --> 00:44:38,679 again that's for 954 00:44:38,679 --> 00:44:40,960 further consideration and not for consideration tonight 955 00:44:40,960 --> 00:44:41,599 just give you an 956 00:44:41,599 --> 00:44:45,639 idea where we're headed I'll pause and be available for 957 00:44:45,639 --> 00:44:46,920 questions at this time if 958 00:44:46,920 --> 00:44:49,769 you have any oh I did want to bring up I'm sorry because it 959 00:44:49,769 --> 00:44:50,280 wasn't in my 960 00:44:50,280 --> 00:44:54,969 slides the zoning ordinance I think it's always good to 961 00:44:54,969 --> 00:44:55,760 look at it 962 00:44:55,760 --> 00:44:59,380 comprehensively we're real quick to look at density like 963 00:44:59,380 --> 00:45:00,519 how many homes each one 964 00:45:00,519 --> 00:45:05,159 allows but at the same time nr3 has a maximum coverage of 965 00:45:05,159 --> 00:45:07,440 50% while nr4 has a 966 00:45:07,440 --> 00:45:12,750 maximum coverage of 60% and nr2 of course has maximum of 30 967 00:45:12,750 --> 00:45:14,039 % but you can 968 00:45:14,039 --> 00:45:19,539 still put a 3,000 square foot home in nr2 on a 9,000 square 969 00:45:19,539 --> 00:45:21,159 foot lot as long as 970 00:45:21,159 --> 00:45:23,590 you don't have more than X number lot so even without 971 00:45:23,590 --> 00:45:24,679 recovering the flood 972 00:45:24,679 --> 00:45:27,579 planes so you could develop in accordance with these 973 00:45:27,579 --> 00:45:29,519 existing zones and 974 00:45:29,519 --> 00:45:31,619 not get into them but you'd end up with much smaller lots 975 00:45:31,619 --> 00:45:32,599 and much smaller homes 976 00:45:32,599 --> 00:45:36,519 and a very different appearance than if we can keep the 977 00:45:36,519 --> 00:45:38,159 spread out a large lot 978 00:45:38,159 --> 00:45:40,440 appearance that Kent is trying to carry through and 979 00:45:40,440 --> 00:45:41,679 transition down to the 980 00:45:41,679 --> 00:45:46,590 Country Club Road now I'll stop wait for any questions or 981 00:45:46,590 --> 00:45:47,039 comments 982 00:45:47,039 --> 00:45:53,280 Commissioner back thank you chair you had mentioned in our 983 00:45:53,280 --> 00:45:53,760 background 984 00:45:53,760 --> 00:45:58,400 information we mentioned that you intend to utilize area 985 00:45:58,400 --> 00:46:00,360 around the creek as 986 00:46:00,360 --> 00:46:03,590 urban green space within the neighborhood so could you and 987 00:46:03,590 --> 00:46:03,960 I know 988 00:46:03,960 --> 00:46:06,690 we're dealing with a rezoning issue here but we've touched 989 00:46:06,690 --> 00:46:07,480 on the development 990 00:46:07,480 --> 00:46:10,280 aspect that can you just detail are we looking at maybe a 991 00:46:10,280 --> 00:46:11,280 park or just leaving 992 00:46:11,280 --> 00:46:15,050 it open as pure green space basically according to the didn 993 00:46:15,050 --> 00:46:15,960 't development code 994 00:46:15,960 --> 00:46:20,239 this area in here would be its own individual lot that 995 00:46:20,239 --> 00:46:21,559 would be a green 996 00:46:21,559 --> 00:46:26,010 space it would be also for drainage purposes but it could 997 00:46:26,010 --> 00:46:27,599 have walking track 998 00:46:27,599 --> 00:46:31,610 bike paths through there if it should be continued through 999 00:46:31,610 --> 00:46:32,960 other neighborhoods 1000 00:46:32,960 --> 00:46:36,000 that's a potential if not it's still a green space for this 1001 00:46:36,000 --> 00:46:36,920 area to utilize 1002 00:46:36,920 --> 00:46:43,039 individually thank you Commissioner Roselle thank you chair 1003 00:46:43,039 --> 00:46:44,320 thank you mr. 1004 00:46:44,320 --> 00:46:48,559 Allison for your presentation just so I'm I'm understanding 1005 00:46:48,559 --> 00:46:50,119 you correctly this 1006 00:46:50,119 --> 00:46:54,840 project could go forward with the split zoning the the 1007 00:46:54,840 --> 00:46:56,920 reason y'all have chosen 1008 00:46:56,920 --> 00:47:00,610 to come for rezoning is so that the east part of the 1009 00:47:00,610 --> 00:47:02,960 property would not be forced 1010 00:47:02,960 --> 00:47:08,539 to be developed denser you want a less dense development on 1011 00:47:08,539 --> 00:47:09,639 the east side am I 1012 00:47:09,639 --> 00:47:12,250 understanding that correctly that is correct I'm getting a 1013 00:47:12,250 --> 00:47:12,960 little better at 1014 00:47:12,960 --> 00:47:16,969 this basically within the area that's colored tan we'd have 1015 00:47:16,969 --> 00:47:17,679 to put four lots 1016 00:47:17,679 --> 00:47:20,179 per acre to get our density out of that with the stream 1017 00:47:20,179 --> 00:47:21,440 buffer that goes through 1018 00:47:21,440 --> 00:47:24,019 there and you can kind of see where the creek falls that 1019 00:47:24,019 --> 00:47:25,920 means let's say there's 1020 00:47:25,920 --> 00:47:29,219 20 acres we could get 80 homes in there but we'd be putting 1021 00:47:29,219 --> 00:47:30,760 all 80 homes in this 1022 00:47:30,760 --> 00:47:33,440 area right here I don't know that would even get 80 but you 1023 00:47:33,440 --> 00:47:34,320 know we could pack 1024 00:47:34,320 --> 00:47:38,840 it in on five six thousand square foot lots on in our four 1025 00:47:38,840 --> 00:47:40,599 thank you and we're 1026 00:47:40,599 --> 00:47:47,239 not wanting to do that somebody could not I'll ask a 1027 00:47:47,239 --> 00:47:49,719 question at this point 1028 00:47:49,719 --> 00:47:53,079 that property is already zoned in our four yes you all are 1029 00:47:53,079 --> 00:47:53,920 basically wanting 1030 00:47:53,920 --> 00:47:57,929 to rezone the whole entire property to in our three yes I 1031 00:47:57,929 --> 00:47:59,519 think in our four 1032 00:47:59,519 --> 00:48:03,980 allows in certain instances that you can have duplexes in 1033 00:48:03,980 --> 00:48:05,400 the site I'm 1034 00:48:05,400 --> 00:48:09,559 understanding correctly so currently the way it's on 1035 00:48:09,559 --> 00:48:11,000 somebody could come in and 1036 00:48:11,000 --> 00:48:15,010 and do duplexes on the in our four part if they wanted to 1037 00:48:15,010 --> 00:48:16,159 under in our three 1038 00:48:16,159 --> 00:48:21,269 that's not permitted has to be single-family home so it's 1039 00:48:21,269 --> 00:48:22,559 almost if 1040 00:48:22,559 --> 00:48:26,480 you're a neighbor to the east and if you're concerned about 1041 00:48:26,480 --> 00:48:27,679 the development I 1042 00:48:27,679 --> 00:48:31,219 would see that the in our three rezone would probably be an 1043 00:48:31,219 --> 00:48:32,519 enhancement and more 1044 00:48:32,519 --> 00:48:35,030 of a protection against the possibility what could go in 1045 00:48:35,030 --> 00:48:35,920 there the way it's 1046 00:48:35,920 --> 00:48:42,610 owned as is that first statement or that's a very fair 1047 00:48:42,610 --> 00:48:45,199 statement even though 1048 00:48:45,199 --> 00:48:48,800 I know people are always concerned about things being 1049 00:48:48,800 --> 00:48:50,440 developed it is already 1050 00:48:50,440 --> 00:48:53,139 zoned in our four and actually you're down zoning that 1051 00:48:53,139 --> 00:48:54,360 portion of the property 1052 00:48:54,360 --> 00:48:57,380 and asking for an up zoning on the front part from in our 1053 00:48:57,380 --> 00:48:58,960 two to our three so 1054 00:48:58,960 --> 00:49:01,679 you're going down against existing neighborhood and going 1055 00:49:01,679 --> 00:49:02,239 up against 1056 00:49:02,239 --> 00:49:09,239 country club road okay any other questions for the 1057 00:49:09,239 --> 00:49:09,639 applicants 1058 00:49:09,639 --> 00:49:16,039 representative okay thank you Lee appreciate it and I'm not 1059 00:49:16,039 --> 00:49:16,519 going anywhere 1060 00:49:16,519 --> 00:49:19,760 so something comes up 1061 00:49:23,159 --> 00:49:29,320 no did you want to okay I have sir if if you want to if you 1062 00:49:29,320 --> 00:49:30,840 want to speak you can 1063 00:49:30,840 --> 00:49:34,010 fill out a card but you can't address the individuals at 1064 00:49:34,010 --> 00:49:41,559 the podium okay sure 1065 00:49:41,559 --> 00:49:45,579 you want to have any come back on it's probably a question 1066 00:49:45,579 --> 00:49:47,199 for okay Earl would 1067 00:49:47,199 --> 00:49:51,639 you come up and then we've got a question 1068 00:49:53,159 --> 00:50:03,090 so my question is about traffic routing and the disarray 1069 00:50:03,090 --> 00:50:05,840 that country club road 1070 00:50:05,840 --> 00:50:09,340 currently is in and I understand that the applicant was 1071 00:50:09,340 --> 00:50:10,679 saying that removal 1072 00:50:10,679 --> 00:50:13,699 of those homes might reduce driveways access to country 1073 00:50:13,699 --> 00:50:14,639 club but we're also 1074 00:50:14,639 --> 00:50:18,769 introducing a lot of homes directly on the country club did 1075 00:50:18,769 --> 00:50:20,559 the city look at 1076 00:50:20,559 --> 00:50:25,210 what will happen to the neighborhood to the east because I 1077 00:50:25,210 --> 00:50:26,760 live in the area and 1078 00:50:26,760 --> 00:50:30,800 my first thought is individuals that want to get down to 24 1079 00:50:30,800 --> 00:50:32,679 99 and Geyer they 1080 00:50:32,679 --> 00:50:37,320 could bypass country club Ryan Hobson and all that mess by 1081 00:50:37,320 --> 00:50:37,960 just going through 1082 00:50:37,960 --> 00:50:41,599 the existing neighborhood was that looked at and studied 1083 00:50:41,599 --> 00:50:42,599 and if so what was 1084 00:50:42,599 --> 00:50:50,639 the outcome it's really hard to tell because you know 1085 00:50:50,639 --> 00:50:52,239 traffic depending on 1086 00:50:52,239 --> 00:50:56,570 where you're going you can assume a split but that's that's 1087 00:50:56,570 --> 00:50:57,239 what it is it's 1088 00:50:57,239 --> 00:51:00,760 just an assumption you could head east which then head 1089 00:51:00,760 --> 00:51:02,719 south to get you to I 1090 00:51:02,719 --> 00:51:04,710 believe it's Ryan right and that can get you either way 1091 00:51:04,710 --> 00:51:05,840 either back to country 1092 00:51:05,840 --> 00:51:11,159 club or to Teasley or you could head north on country club 1093 00:51:11,159 --> 00:51:12,579 to get the 377 1094 00:51:12,579 --> 00:51:16,530 textile is currently going to begin construction on 377 1095 00:51:16,530 --> 00:51:18,480 from the highway all 1096 00:51:18,480 --> 00:51:21,699 the way down just south of country club road they're gonna 1097 00:51:21,699 --> 00:51:22,360 widen that to six 1098 00:51:22,360 --> 00:51:25,360 lanes and they're also gonna do some improvements on FM 18 1099 00:51:25,360 --> 00:51:26,239 30 which is 1100 00:51:26,239 --> 00:51:30,989 country club road from Fort Worth Drive to Hobson they're 1101 00:51:30,989 --> 00:51:32,199 gonna widen that the 1102 00:51:32,199 --> 00:51:35,860 four lanes just to improve that intersection you know 1103 00:51:35,860 --> 00:51:37,159 country club road 1104 00:51:37,159 --> 00:51:41,869 is FM 1830 is a textile roadway the city has in the past 1105 00:51:41,869 --> 00:51:43,400 applied for signal at 1106 00:51:43,400 --> 00:51:46,570 Hobson and country club road and was denied by textile 1107 00:51:46,570 --> 00:51:47,480 because of its 1108 00:51:47,480 --> 00:51:52,869 vicinity to the intersection with the US 377 we've also 1109 00:51:52,869 --> 00:51:55,000 performed weren't a 1110 00:51:55,000 --> 00:52:02,119 signal weren't analysis over at FM 1830 and Ryan as well as 1111 00:52:02,119 --> 00:52:05,800 1830 and Hickory Creek 1112 00:52:05,800 --> 00:52:10,800 and they both did not meet text odds warrants but as soon 1113 00:52:10,800 --> 00:52:12,079 as it as soon as 1114 00:52:12,079 --> 00:52:15,760 it does then we'll begin design and construction of those 1115 00:52:15,760 --> 00:52:16,719 are those warrants 1116 00:52:16,719 --> 00:52:20,489 explicitly detailed or we all applying trying to figure out 1117 00:52:20,489 --> 00:52:21,840 what those warrants 1118 00:52:21,840 --> 00:52:26,219 were how we know we're in rat that threshold text dot has 1119 00:52:26,219 --> 00:52:26,679 certain 1120 00:52:26,679 --> 00:52:30,239 thresholds they have eight warrants that we have to meet 1121 00:52:30,239 --> 00:52:32,559 and and we did not meet 1122 00:52:32,559 --> 00:52:38,110 those and I know that text dots working in 2017 for the 377 1123 00:52:38,110 --> 00:52:40,239 and also that 1124 00:52:40,239 --> 00:52:44,159 Teasley Lillian Miller is what's the do you know the 1125 00:52:44,159 --> 00:52:47,800 schedule on 1830 and or 1126 00:52:47,800 --> 00:52:52,269 Ryan is there any schedule for improvements on those two 1127 00:52:52,269 --> 00:52:53,360 roads there 1128 00:52:53,360 --> 00:52:56,860 are no planned improvements pass Hobson for country club at 1129 00:52:56,860 --> 00:53:00,920 this time but 1830 1130 00:53:00,920 --> 00:53:06,800 from Hobson to 377 slated for February 2017 Teasley is I 1131 00:53:06,800 --> 00:53:07,679 believe it's June of 1132 00:53:07,679 --> 00:53:13,440 next year okay thank you Commissioner Beck 1133 00:53:13,440 --> 00:53:17,719 as well no no I have a question for Earl before we move on 1134 00:53:17,719 --> 00:53:19,480 I was going to offer 1135 00:53:19,480 --> 00:53:22,110 something to Commissioner Roeville that might alleviate the 1136 00:53:22,110 --> 00:53:23,079 concern because I I 1137 00:53:23,079 --> 00:53:25,900 kind of looked at that too how metal land comes in and 1138 00:53:25,900 --> 00:53:28,079 connects country club to 1139 00:53:28,079 --> 00:53:32,530 areas East but probably the only people that would use that 1140 00:53:32,530 --> 00:53:33,840 would be the people 1141 00:53:33,840 --> 00:53:37,010 in the new development because it does some zigging and sag 1142 00:53:37,010 --> 00:53:37,440 ging and if you 1143 00:53:37,440 --> 00:53:40,820 wanted to get a place quick to the issue I think more 1144 00:53:40,820 --> 00:53:42,559 likely take Hobson or Ryan 1145 00:53:42,559 --> 00:53:46,050 Roe but that's just an opinion of course I did have a 1146 00:53:46,050 --> 00:53:47,719 follow-up question for how 1147 00:53:47,719 --> 00:53:51,480 long ago was a study done on the warrants for Ryan last 1148 00:53:51,480 --> 00:53:52,400 year last year 1149 00:53:52,400 --> 00:53:56,090 is that so that did they take into consideration all the 1150 00:53:56,090 --> 00:53:57,360 new developments 1151 00:53:57,360 --> 00:54:00,190 that are going in currently on Ryan or is it just a actual 1152 00:54:00,190 --> 00:54:01,000 traffic it was 1153 00:54:01,000 --> 00:54:04,269 actually on the ground counts okay and that's what text dot 1154 00:54:04,269 --> 00:54:05,340 will they will not 1155 00:54:05,340 --> 00:54:08,920 permit a signal unless it's based on actual on the ground 1156 00:54:08,920 --> 00:54:10,519 counts okay so we 1157 00:54:10,519 --> 00:54:13,750 know warrants so when those subdivisions come in the city 1158 00:54:13,750 --> 00:54:15,000 can go back and do a 1159 00:54:15,000 --> 00:54:17,880 new train account that's correct with all the new traffic 1160 00:54:17,880 --> 00:54:18,559 that will be on there 1161 00:54:18,559 --> 00:54:22,000 and see now if those intersections would meet the criteria 1162 00:54:22,000 --> 00:54:23,320 possibly for a signal 1163 00:54:23,320 --> 00:54:26,719 but not until the homes are built the people are in it and 1164 00:54:26,719 --> 00:54:27,960 the traffic is even 1165 00:54:27,960 --> 00:54:32,079 worse than it is now and I think we performed a count 1166 00:54:32,079 --> 00:54:33,440 before last year 1167 00:54:33,440 --> 00:54:36,389 sometime and it actually did me more and then we went back 1168 00:54:36,389 --> 00:54:37,119 last year to 1169 00:54:37,119 --> 00:54:40,579 re-perform those counts at those intersections and it didn 1170 00:54:40,579 --> 00:54:41,360 't meet counts 1171 00:54:41,360 --> 00:54:44,000 I think our traffic department thought there was maybe some 1172 00:54:44,000 --> 00:54:44,679 redirectional 1173 00:54:44,679 --> 00:54:54,480 traffic because of 2499 possibly or I guess 2499 to 1174 00:54:54,480 --> 00:54:55,920 completion 2499 was done 1175 00:54:55,920 --> 00:55:00,559 recently so okay this may be one more level of detail do 1176 00:55:00,559 --> 00:55:01,239 they do the count 1177 00:55:01,239 --> 00:55:04,800 just for the the day or is it during certain times of the 1178 00:55:04,800 --> 00:55:06,199 day how precise is 1179 00:55:06,199 --> 00:55:09,320 account because it's a 24-hour count again text out has 1180 00:55:09,320 --> 00:55:10,800 eight warrants we have 1181 00:55:10,800 --> 00:55:13,150 to meet the peak our warrant we have to meet a four-hour 1182 00:55:13,150 --> 00:55:14,159 warrants and an eight 1183 00:55:14,159 --> 00:55:17,829 hour one okay I know during depending on when what time you 1184 00:55:17,829 --> 00:55:18,599 're getting there 1185 00:55:18,599 --> 00:55:22,280 around school time and work time getting out of those 1186 00:55:22,280 --> 00:55:24,239 neighborhoods the traffic 1187 00:55:24,239 --> 00:55:29,630 backup on Ryan and Hobson is extensive during those times 1188 00:55:29,630 --> 00:55:30,519 later middle of the 1189 00:55:30,519 --> 00:55:33,039 morning it's not as bad I don't know if there's a 1190 00:55:33,039 --> 00:55:34,559 particular time that they do 1191 00:55:34,559 --> 00:55:37,880 or it's not time sensitive it's not time sensitive okay 1192 00:55:37,880 --> 00:55:38,800 great thank you any other 1193 00:55:38,800 --> 00:55:44,300 questions for Earl or another staff member actually kind of 1194 00:55:44,300 --> 00:55:44,920 a comment 1195 00:55:44,920 --> 00:55:48,119 bringing in some history on cut-through traffic okay sure 1196 00:55:48,119 --> 00:55:50,309 Commissioner Taylor thank you chair I was just going to say 1197 00:55:50,309 --> 00:55:54,159 the the master the 1198 00:55:54,159 --> 00:55:58,800 mobility master plan since the at least the late 1980s had 1199 00:55:58,800 --> 00:56:00,699 had El Paseo as an 1200 00:56:00,699 --> 00:56:06,210 arterial connecting from 1832 Teasley and that had not been 1201 00:56:06,210 --> 00:56:08,199 a popular idea and 1202 00:56:08,199 --> 00:56:13,460 it finally got removed from from that role about four years 1203 00:56:13,460 --> 00:56:15,639 ago or so so in 1204 00:56:15,639 --> 00:56:20,449 theory you know on our 20 year ago plan El Paseo would have 1205 00:56:20,449 --> 00:56:21,159 come through 1206 00:56:21,159 --> 00:56:24,010 probably just on the very south side of this property been 1207 00:56:24,010 --> 00:56:25,960 a major arterial all 1208 00:56:25,960 --> 00:56:29,789 the way across to Teasley and on both ends there were 1209 00:56:29,789 --> 00:56:31,320 people fighting it so it 1210 00:56:31,320 --> 00:56:33,730 won't connect and that does prevent this from being a good 1211 00:56:33,730 --> 00:56:34,679 way to get to Teasley 1212 00:56:34,679 --> 00:56:37,929 because if you do manage to get over into the neighborhood 1213 00:56:37,929 --> 00:56:39,639 on El Paseo you 1214 00:56:39,639 --> 00:56:42,039 can't really you can get to Montecito but you can't really 1215 00:56:42,039 --> 00:56:42,679 get out of that 1216 00:56:42,679 --> 00:56:45,849 neighborhood so you know it does does really limit the 1217 00:56:45,849 --> 00:56:47,320 amount of cross traffic 1218 00:56:47,320 --> 00:56:51,599 here as opposed to if El Paseo did connect on the Teasley 1219 00:56:51,599 --> 00:56:52,559 side you know this 1220 00:56:52,559 --> 00:56:56,789 would any outlet on this side would immediately become a 1221 00:56:56,789 --> 00:56:59,599 highway thank you 1222 00:56:59,599 --> 00:57:06,920 Commissioner Ellis thank you chair Earl I'm sorry I just 1223 00:57:06,920 --> 00:57:07,360 want to try to 1224 00:57:07,360 --> 00:57:11,409 understand what you said earlier as far as meeting the war 1225 00:57:11,409 --> 00:57:12,679 rants you said we met 1226 00:57:12,679 --> 00:57:16,880 some but not all can you elaborate on that at all no no 1227 00:57:16,880 --> 00:57:18,559 what I've met was we 1228 00:57:18,559 --> 00:57:24,519 performed a warrant analysis prior to last year and it 1229 00:57:24,519 --> 00:57:25,440 actually did meet 1230 00:57:25,440 --> 00:57:29,190 warrants but there were some questions on the numbers and 1231 00:57:29,190 --> 00:57:30,480 accounts so we read 1232 00:57:30,480 --> 00:57:33,460 that we performed those numbers just last year and 1233 00:57:33,460 --> 00:57:35,400 discovered that it didn't 1234 00:57:35,400 --> 00:57:40,250 meet warrants okay and do and we don't have a plan to do it 1235 00:57:40,250 --> 00:57:43,079 again we don't 1236 00:57:43,079 --> 00:57:46,300 think there's gonna be a significant change from and within 1237 00:57:46,300 --> 00:57:47,559 12 months so no 1238 00:57:47,559 --> 00:57:51,920 plan in place it right now we can I mean whenever we want 1239 00:57:51,920 --> 00:57:53,360 to it's just there 1240 00:57:53,360 --> 00:57:55,929 hasn't been a significant amount of development since the 1241 00:57:55,929 --> 00:57:57,519 last 12 months to 1242 00:57:57,519 --> 00:58:04,250 to warrant additional traffic okay thanks okay any other 1243 00:58:04,250 --> 00:58:05,480 questions for 1244 00:58:05,480 --> 00:58:08,909 staff or I'm going to start calling some of our folks that 1245 00:58:08,909 --> 00:58:10,079 have requested to 1246 00:58:10,079 --> 00:58:18,800 speak first card I have is from Donna Zelisco McLaughlin I 1247 00:58:18,800 --> 00:58:20,719 think 3300 Belmont 1248 00:58:20,719 --> 00:58:26,960 Street and she is in opposition if you would please come 1249 00:58:26,960 --> 00:58:28,800 okay if you'll give us 1250 00:58:28,800 --> 00:58:34,820 your name and address and then that's okay okay Donna Zel 1251 00:58:34,820 --> 00:58:36,440 isco McLaughlin live 1252 00:58:36,440 --> 00:58:43,329 at 3300 Belmont Street in Denton I'm also speaking for Rick 1253 00:58:43,329 --> 00:58:44,099 and Kelly 1254 00:58:44,099 --> 00:58:48,900 Wisenhunt there are new neighbors at the 3306 Belmont 1255 00:58:48,900 --> 00:58:50,880 Street house they did not 1256 00:58:50,880 --> 00:58:58,010 receive a notification of this hearing and they are also in 1257 00:58:58,010 --> 00:58:59,760 opposition I'm 1258 00:58:59,760 --> 00:59:04,440 going to read my notes please okay we're all opposed to 1259 00:59:04,440 --> 00:59:06,239 this proposal for the 1260 00:59:06,239 --> 00:59:10,010 zoning change for the following reasons one changes in the 1261 00:59:10,010 --> 00:59:11,519 landscape environment 1262 00:59:11,519 --> 00:59:14,929 and the property generally located on the east side of 1263 00:59:14,929 --> 00:59:16,320 Country Club Road and 1264 00:59:16,320 --> 00:59:20,550 directly west of our property to increase density of the 1265 00:59:20,550 --> 00:59:21,760 land will enhance 1266 00:59:21,760 --> 00:59:26,400 the probability of continued flooding of our property we 1267 00:59:26,400 --> 00:59:27,880 moved to this property 1268 00:59:27,880 --> 00:59:32,650 in June 2007 our house was the fourth house built on this 1269 00:59:32,650 --> 00:59:34,400 side of Belmont our 1270 00:59:34,400 --> 00:59:37,650 property experienced flooding at the time it was built in 1271 00:59:37,650 --> 00:59:38,599 doing two other 1272 00:59:38,599 --> 00:59:42,519 rainy storms over the years since then the house south to 1273 00:59:42,519 --> 00:59:44,639 ours which is the 3306 1274 00:59:44,639 --> 00:59:48,679 Belmont Street was built two years before ours had 1275 00:59:48,679 --> 00:59:50,920 experienced water problems 1276 00:59:50,920 --> 00:59:54,570 prior to our house being built and also continues to have 1277 00:59:54,570 --> 00:59:56,239 backyard water issues 1278 00:59:56,239 --> 01:00:01,389 during extreme rains we have built two French drains and a 1279 01:00:01,389 --> 01:00:02,519 major retaining wall 1280 01:00:02,519 --> 01:00:05,880 on the south side of our house in order to control water 1281 01:00:05,880 --> 01:00:07,320 damage to our property 1282 01:00:07,320 --> 01:00:11,599 and to the 3306 Belmont property on the north side of our 1283 01:00:11,599 --> 01:00:12,599 house in order to 1284 01:00:12,599 --> 01:00:15,750 allow water to flow freely to the street we have not 1285 01:00:15,750 --> 01:00:17,519 landscaped beyond putting in 1286 01:00:17,519 --> 01:00:21,250 a lawn the extraordinary amount of water on the north side 1287 01:00:21,250 --> 01:00:22,119 of the house is the 1288 01:00:22,119 --> 01:00:25,079 result of higher elevations of the developed properties 1289 01:00:25,079 --> 01:00:25,880 north of us and 1290 01:00:25,880 --> 01:00:31,000 from water that flows west of us water continues to drain 1291 01:00:31,000 --> 01:00:32,519 to Belmont Street on 1292 01:00:32,519 --> 01:00:36,610 the north side of our house even on days after it stops 1293 01:00:36,610 --> 01:00:38,320 raining and all you have 1294 01:00:38,320 --> 01:00:41,559 to do is come and you will see the water coming underneath 1295 01:00:41,559 --> 01:00:42,800 the front of our lawn 1296 01:00:42,800 --> 01:00:49,320 going into Belmont Street any environmental or watershed 1297 01:00:49,320 --> 01:00:50,079 protection 1298 01:00:50,079 --> 01:00:54,090 protector team should be able to identify this problem area 1299 01:00:54,090 --> 01:00:54,960 from Belmont 1300 01:00:54,960 --> 01:00:59,320 Street also if you came during the storm you would see from 1301 01:00:59,320 --> 01:01:00,800 Belmont from the 1302 01:01:00,800 --> 01:01:04,469 north side of Belmont Street where the cul-de-sac is it g 1303 01:01:04,469 --> 01:01:06,599 ushes down so 1304 01:01:06,599 --> 01:01:11,579 forcefully during an extreme rain that the drain draining 1305 01:01:11,579 --> 01:01:13,320 cannot empty out from 1306 01:01:13,320 --> 01:01:17,449 the French drains because the power from coming down Bel 1307 01:01:17,449 --> 01:01:19,840 mont is strong water has 1308 01:01:19,840 --> 01:01:23,489 flooded our yard and has reached our back door beside the 1309 01:01:23,489 --> 01:01:24,559 back door of the 1310 01:01:24,559 --> 01:01:28,570 house through our patio despite efforts to direct water 1311 01:01:28,570 --> 01:01:29,559 away from the house 1312 01:01:29,559 --> 01:01:33,940 there is a distance of approximately 40 feet from our west 1313 01:01:33,940 --> 01:01:35,079 boundary where a 1314 01:01:35,079 --> 01:01:39,090 grove of trees also provides a barrier to any kind of water 1315 01:01:39,090 --> 01:01:40,960 flow since Belmont 1316 01:01:40,960 --> 01:01:44,070 Street has water gushing from the cul-de-sac which is the 1317 01:01:44,070 --> 01:01:44,960 north end and 1318 01:01:44,960 --> 01:01:48,440 because the north end of the street is greatly elevated the 1319 01:01:48,440 --> 01:01:49,519 backyards in the 1320 01:01:49,519 --> 01:01:53,719 middle of the estates of El Paso decision that's the homes 1321 01:01:53,719 --> 01:01:54,719 that are 1322 01:01:54,719 --> 01:01:58,210 between Belmont and Preetness which is that whole 1323 01:01:58,210 --> 01:01:59,960 neighborhood of the new 1324 01:01:59,960 --> 01:02:03,710 development also have had flooding issues due to the 1325 01:02:03,710 --> 01:02:05,239 natural flow of water 1326 01:02:05,239 --> 01:02:09,250 in the area when it's extremely rainy the same time when 1327 01:02:09,250 --> 01:02:10,440 there was flooding in 1328 01:02:10,440 --> 01:02:13,960 the downtown Denton area which is why all the work was 1329 01:02:13,960 --> 01:02:15,639 being done in downtown is 1330 01:02:15,639 --> 01:02:19,420 when we were aware that the neighbors across the street 1331 01:02:19,420 --> 01:02:20,800 between Belmont and 1332 01:02:20,800 --> 01:02:25,710 Preetness had backyard flooding issues our neighborhood is 1333 01:02:25,710 --> 01:02:27,039 zoned in our two 1334 01:02:27,039 --> 01:02:30,510 the neighborhood occupies the land that the original ranch 1335 01:02:30,510 --> 01:02:31,519 occupied when it 1336 01:02:31,519 --> 01:02:35,300 rains a lot funny became a real issue is what we were told 1337 01:02:35,300 --> 01:02:36,559 by the developer 1338 01:02:36,559 --> 01:02:40,920 decreasing the available natural environment for runoff 1339 01:02:40,920 --> 01:02:41,719 that is the 1340 01:02:41,719 --> 01:02:45,469 rainfall that is not absorbed by the soil will aggravate 1341 01:02:45,469 --> 01:02:46,360 the existing 1342 01:02:46,360 --> 01:02:50,019 flooding problem don't matter how many houses if it's 1343 01:02:50,019 --> 01:02:51,800 cemented over we're going 1344 01:02:51,800 --> 01:02:55,960 to have worth flooding problems do not change the zoning to 1345 01:02:55,960 --> 01:02:57,239 increase density in 1346 01:02:57,239 --> 01:03:00,360 an area adjacent to ours and therefore decrease the 1347 01:03:00,360 --> 01:03:02,159 property value of the 1348 01:03:02,159 --> 01:03:06,809 existing homes on our street removal of any of the trees 1349 01:03:06,809 --> 01:03:08,559 and our for area will 1350 01:03:08,559 --> 01:03:12,489 matter your four minutes is up okay thank you for your 1351 01:03:12,489 --> 01:03:14,440 comments I have a 1352 01:03:14,440 --> 01:03:18,719 couple questions for you Commissioner Rozelle this first 1353 01:03:18,719 --> 01:03:19,639 thank you chair 1354 01:03:19,639 --> 01:03:22,780 community Commissioner back next mr. Glockland I appreciate 1355 01:03:22,780 --> 01:03:23,679 you you coming and 1356 01:03:23,679 --> 01:03:27,119 speaking tonight my mother actually lived on the east side 1357 01:03:27,119 --> 01:03:28,119 of Belmont and 1358 01:03:28,119 --> 01:03:31,070 I'm very familiar with the rain waters that come from the 1359 01:03:31,070 --> 01:03:32,280 north down everyone's 1360 01:03:32,280 --> 01:03:35,940 backyard in the center she had a great center fence to 1361 01:03:35,940 --> 01:03:37,199 allow the water to flow 1362 01:03:37,199 --> 01:03:42,710 through it's my understanding that that water for the for 1363 01:03:42,710 --> 01:03:43,679 those houses including 1364 01:03:43,679 --> 01:03:48,500 your own is from the high elevation of the property to the 1365 01:03:48,500 --> 01:03:50,119 north and that the 1366 01:03:50,119 --> 01:03:53,570 property to the west is actually a lower elevation is that 1367 01:03:53,570 --> 01:03:55,000 correct not front if 1368 01:03:55,000 --> 01:03:58,409 you come and look at the side the north side of our house 1369 01:03:58,409 --> 01:03:59,880 between our home and 1370 01:03:59,880 --> 01:04:05,150 the hills home we were told okay we will originally wanted 1371 01:04:05,150 --> 01:04:06,760 to put a driveway 1372 01:04:06,760 --> 01:04:10,230 there we were told we could not because of how the water 1373 01:04:10,230 --> 01:04:12,360 was coming from the 1374 01:04:12,360 --> 01:04:16,630 lot that wants to be rezoned okay and if in this is where 1375 01:04:16,630 --> 01:04:18,760 we're getting water on 1376 01:04:18,760 --> 01:04:25,920 that side of the house even after it stops raining and and 1377 01:04:25,920 --> 01:04:27,480 it did yes if 1378 01:04:27,480 --> 01:04:31,840 there's an elevation on the north but there also is it's 1379 01:04:31,840 --> 01:04:33,400 not as extreme as the 1380 01:04:33,400 --> 01:04:39,400 one on the north but waters coming from west from west 1381 01:04:39,400 --> 01:04:41,639 because our fence line 1382 01:04:41,639 --> 01:04:46,280 even though we've built up the backyard to the fence line 1383 01:04:46,280 --> 01:04:47,719 it's still the only 1384 01:04:47,719 --> 01:04:51,920 thing to do is walk out there and how soggy marshy it is 1385 01:04:51,920 --> 01:04:53,159 after it rains and 1386 01:04:53,159 --> 01:04:58,670 then another point not question is the area to the west is 1387 01:04:58,670 --> 01:05:00,199 actually trying to 1388 01:05:00,199 --> 01:05:03,699 rezone to a less dense area this evening they're not trying 1389 01:05:03,699 --> 01:05:04,559 to increase density 1390 01:05:04,559 --> 01:05:07,559 behind your property I'm not sure if you're aware of that 1391 01:05:07,559 --> 01:05:09,199 but the the request 1392 01:05:09,199 --> 01:05:14,440 of the applicant yes that was my next statement you 1393 01:05:14,440 --> 01:05:15,320 mentioned that you didn't 1394 01:05:15,320 --> 01:05:18,280 want them to increase zoning that isn't happening tonight 1395 01:05:18,280 --> 01:05:19,000 that's not even 1396 01:05:19,000 --> 01:05:23,429 proposed what's proposed is to decrease the density behind 1397 01:05:23,429 --> 01:05:24,760 your home they want 1398 01:05:24,760 --> 01:05:29,530 to put more development back there and I'm concerned that 1399 01:05:29,530 --> 01:05:30,199 the fact we're gonna 1400 01:05:30,199 --> 01:05:35,260 lose the land that's on the branch that's got the growth 1401 01:05:35,260 --> 01:05:36,960 the growth of trees 1402 01:05:36,960 --> 01:05:43,619 and the open land that absorbs water that if it's you know 1403 01:05:43,619 --> 01:05:45,480 it has residences 1404 01:05:45,480 --> 01:05:49,780 and driveways and concrete it's the absolute absorption of 1405 01:05:49,780 --> 01:05:51,320 the water will 1406 01:05:51,320 --> 01:05:55,639 make our situation worse I understand thank you 1407 01:05:55,639 --> 01:06:00,829 Commissioner Beck thank you chair thank you miss let's go 1408 01:06:00,829 --> 01:06:04,119 and clothland let me 1409 01:06:04,119 --> 01:06:07,869 kind of help me kind of wrap my head around all this now as 1410 01:06:07,869 --> 01:06:08,559 Commissioner 1411 01:06:08,559 --> 01:06:12,320 Rossell pointed out you really are getting less density 1412 01:06:12,320 --> 01:06:13,400 behind you you 1413 01:06:13,400 --> 01:06:16,119 mentioned yes but there's still gonna be development in 1414 01:06:16,119 --> 01:06:17,519 there which there will 1415 01:06:17,519 --> 01:06:19,920 when y'all bought that house did you ever think there wasn 1416 01:06:19,920 --> 01:06:20,559 't gonna be any 1417 01:06:20,559 --> 01:06:24,159 development in there no okay we were told that Meadowlands 1418 01:06:24,159 --> 01:06:25,159 was probably gonna 1419 01:06:25,159 --> 01:06:29,980 be extended between where it is now to Country Club and we 1420 01:06:29,980 --> 01:06:31,239 went back there and 1421 01:06:31,239 --> 01:06:35,619 we looked at the homes that are in that little a long 1422 01:06:35,619 --> 01:06:37,159 Country Club room no a 1423 01:06:37,159 --> 01:06:40,690 long Country Club and you go how do you have to get to that 1424 01:06:40,690 --> 01:06:41,840 ranch it looks more 1425 01:06:41,840 --> 01:06:45,309 like somebody's driveway yeah okay and we went back in 1426 01:06:45,309 --> 01:06:46,679 there and checked it all 1427 01:06:46,679 --> 01:06:50,469 out okay so we were aware that they were probably gonna be 1428 01:06:50,469 --> 01:06:51,679 changed so inevitably 1429 01:06:51,679 --> 01:06:54,800 the development is gonna happen in and really there's not 1430 01:06:54,800 --> 01:06:55,800 much we can do about 1431 01:06:55,800 --> 01:06:59,860 that if we leave it like it is though and a developer does 1432 01:06:59,860 --> 01:07:00,599 come in then they 1433 01:07:00,599 --> 01:07:05,599 will build in more density directly behind you now mr. 1434 01:07:05,599 --> 01:07:07,000 Allison explained 1435 01:07:07,000 --> 01:07:10,110 that drainage shouldn't be an issue with their development 1436 01:07:10,110 --> 01:07:11,239 he could elaborate on 1437 01:07:11,239 --> 01:07:14,849 it if he wants to but I would think the fact that you're 1438 01:07:14,849 --> 01:07:16,360 experiencing heavy 1439 01:07:16,360 --> 01:07:20,400 flooding right now you know naturally when a development 1440 01:07:20,400 --> 01:07:21,079 comes in doesn't 1441 01:07:21,079 --> 01:07:24,019 automatically mean the drainage will increase it could 1442 01:07:24,019 --> 01:07:25,199 improve because they 1443 01:07:25,199 --> 01:07:29,420 have to meet certain criteria to to ensure that wherever 1444 01:07:29,420 --> 01:07:30,440 they develop it 1445 01:07:30,440 --> 01:07:32,530 doesn't drain on to somebody else's property and again I 1446 01:07:32,530 --> 01:07:33,360 understand that is 1447 01:07:33,360 --> 01:07:36,719 a perfect world scenario but nonetheless it could actually 1448 01:07:36,719 --> 01:07:38,239 get better than worse 1449 01:07:38,239 --> 01:07:42,460 I'm aware of that but I just believe that I need to have my 1450 01:07:42,460 --> 01:07:43,440 say and the 1451 01:07:43,440 --> 01:07:47,860 record concerns are because I'm aware here in Denton where 1452 01:07:47,860 --> 01:07:49,000 there's been other 1453 01:07:49,000 --> 01:07:52,840 development that issues have come up granted where there 1454 01:07:52,840 --> 01:07:54,659 weren't issues okay 1455 01:07:54,659 --> 01:08:02,760 very good thank you then thank you next speaker is Robert 1456 01:08:02,760 --> 01:08:04,280 McLaughlin at 3300 1457 01:08:04,280 --> 01:08:09,690 Belmont to be followed by Diane Garcia as she's coming the 1458 01:08:09,690 --> 01:08:11,440 microphone this is a 1459 01:08:11,440 --> 01:08:14,519 public hearing so anyone that would like to speak on this 1460 01:08:14,519 --> 01:08:15,760 item please fill out a 1461 01:08:15,760 --> 01:08:19,060 blue card if you do not want to speak you can fill out a 1462 01:08:19,060 --> 01:08:20,239 white card but we 1463 01:08:20,239 --> 01:08:24,520 will need a card for anyone who does wish to speak you'll 1464 01:08:24,520 --> 01:08:25,340 have can I bring 1465 01:08:25,340 --> 01:08:29,720 this path I don't know if we have that capability tonight 1466 01:08:29,720 --> 01:08:30,680 because we're not in 1467 01:08:30,680 --> 01:08:35,479 our normal it was up a moment ago okay great in the slide 1468 01:08:35,479 --> 01:08:36,680 packet great thank 1469 01:08:36,680 --> 01:08:39,510 you my mistake will get back to that slide I thought you 1470 01:08:39,510 --> 01:08:40,119 had something you 1471 01:08:40,119 --> 01:08:43,479 wanted to put on the overhead camera 1472 01:08:50,239 --> 01:09:19,720 , okay. I see okay. Okay. 1473 01:09:20,600 --> 01:09:27,479 I'm Robert McLaughlin under 3300 Belmont Street. I wanted 1474 01:09:27,479 --> 01:09:29,720 to read a statement 1475 01:09:29,720 --> 01:09:34,510 that's included in your packet of information here that 1476 01:09:34,510 --> 01:09:35,979 said the purpose 1477 01:09:35,979 --> 01:09:38,850 of the neighborhood residential zoning districts is to 1478 01:09:38,850 --> 01:09:40,119 preserve or protect the 1479 01:09:40,119 --> 01:09:42,979 existing neighborhoods and to ensure that any new 1480 01:09:42,979 --> 01:09:44,640 development is compatible 1481 01:09:44,640 --> 01:09:50,149 with the existing land uses patterns and design standards. 1482 01:09:50,149 --> 01:09:52,199 I would contend that we 1483 01:09:52,199 --> 01:09:57,569 haven't met that compatibility requirement because the vast 1484 01:09:57,569 --> 01:09:58,600 majority it 1485 01:09:58,600 --> 01:10:02,489 doesn't show on this map well but the vast majority of the 1486 01:10:02,489 --> 01:10:03,960 existing neighborhood 1487 01:10:03,960 --> 01:10:07,869 is the Forest Ridge-El Pasayo area which incorporates 1488 01:10:07,869 --> 01:10:09,699 several hundred acres to 1489 01:10:09,699 --> 01:10:15,090 the east and city staff has identified the small Bend Creek 1490 01:10:15,090 --> 01:10:17,359 Estates area it's 1491 01:10:17,359 --> 01:10:22,220 the NR3 area as a cross country club as the area that we're 1492 01:10:22,220 --> 01:10:23,960 comparing to so I'm 1493 01:10:23,960 --> 01:10:27,750 kind of like we've got a tree but we're comparing it to a 1494 01:10:27,750 --> 01:10:30,399 single leaf the El 1495 01:10:30,399 --> 01:10:35,569 Pasayo area is much much more established and I think is 1496 01:10:35,569 --> 01:10:36,640 the area that 1497 01:10:36,640 --> 01:10:41,279 we should be comparing to so my point would be I recognize 1498 01:10:41,279 --> 01:10:42,399 the fact that the 1499 01:10:42,399 --> 01:10:45,800 NR3 development or designation is somewhat of an 1500 01:10:45,800 --> 01:10:48,399 improvement from NR4 but 1501 01:10:48,399 --> 01:10:51,199 I feel like you haven't asked them to go quite far enough 1502 01:10:51,199 --> 01:10:52,600 if you want to preserve 1503 01:10:52,600 --> 01:10:56,159 the El Pasayo Forest Ridge designation and how it's all put 1504 01:10:56,159 --> 01:10:57,760 together this lot 1505 01:10:57,760 --> 01:11:03,439 should be all NR2 and then as it's developed it was going 1506 01:11:03,439 --> 01:11:04,159 to be much more 1507 01:11:04,159 --> 01:11:08,270 compatible with what we have there I think you would have 1508 01:11:08,270 --> 01:11:09,760 somewhere between 1509 01:11:09,760 --> 01:11:14,640 65 and 70 homes I understand from mr. Allison's 1510 01:11:14,640 --> 01:11:15,800 presentation that they're 1511 01:11:15,800 --> 01:11:24,119 producing 78 73 to 78 what worries me is if if mr. Loughlin 1512 01:11:24,119 --> 01:11:24,760 could we get you to 1513 01:11:24,760 --> 01:11:26,609 speak in the microphone because they're having a hard time 1514 01:11:26,609 --> 01:11:27,279 hearing you in the 1515 01:11:27,279 --> 01:11:31,920 back we record the meetings thank you quite all right my 1516 01:11:31,920 --> 01:11:33,680 concern with the NR 1517 01:11:33,680 --> 01:11:37,520 3 designation is once that's granted is there anything 1518 01:11:37,520 --> 01:11:40,760 which would impede or 1519 01:11:40,760 --> 01:11:45,199 prohibit the maximum development of that land which would 1520 01:11:45,199 --> 01:11:47,000 be up to about 125 1521 01:11:47,000 --> 01:11:53,359 homes okay I didn't think so so my request would be that I 1522 01:11:53,359 --> 01:11:54,399 think that in our 1523 01:11:54,399 --> 01:11:58,560 two designation is much more appropriate to this property 1524 01:11:58,560 --> 01:12:00,199 and that I would urge 1525 01:12:00,199 --> 01:12:04,529 you to reject this request from the developer and ask them 1526 01:12:04,529 --> 01:12:05,479 to represent it 1527 01:12:05,479 --> 01:12:10,250 as an NR 2 and to preserve the forest region El Pasayo area 1528 01:12:10,250 --> 01:12:11,439 thank you 1529 01:12:11,439 --> 01:12:14,800 Commissioner Roselle thank you chair I appreciate your 1530 01:12:14,800 --> 01:12:16,920 feedback I currently live 1531 01:12:16,920 --> 01:12:21,300 in the NR 2 that you're speaking of and I appreciate the 1532 01:12:21,300 --> 01:12:22,159 considerations that 1533 01:12:22,159 --> 01:12:25,520 that you're making mr. Allison and his presentation said 1534 01:12:25,520 --> 01:12:26,880 that to the east of 1535 01:12:26,880 --> 01:12:33,000 the floodplain area there are going to be lots of 16,000 1536 01:12:33,000 --> 01:12:34,920 square feet which is 1537 01:12:34,920 --> 01:12:42,600 0.36 acres which is the roughly the current size of the 1538 01:12:42,600 --> 01:12:44,279 lots to the west of 1539 01:12:44,279 --> 01:12:49,600 Belmont and then certainly into forest rich proper 0.36 1540 01:12:49,600 --> 01:12:52,960 acres is on par with 1541 01:12:52,960 --> 01:12:56,279 the forest search development correct we're close but not 1542 01:12:56,279 --> 01:12:57,800 quite there in the 1543 01:12:57,800 --> 01:13:01,640 sense of yeah there are parts of forest ridge that do have 1544 01:13:01,640 --> 01:13:02,600 some smaller lots 1545 01:13:02,600 --> 01:13:09,560 than the 0.5 acres but an NR 2 would give us the larger lot 1546 01:13:09,560 --> 01:13:11,199 size less coverage 1547 01:13:11,199 --> 01:13:14,770 on the lot and we would be more compatible with several 1548 01:13:14,770 --> 01:13:15,760 hundred homes 1549 01:13:15,760 --> 01:13:21,479 which exists there I understand that the NR 2 though the 1550 01:13:21,479 --> 01:13:22,840 actual property wouldn't 1551 01:13:22,840 --> 01:13:27,270 be half acres when you actually consider roads drainages 1552 01:13:27,270 --> 01:13:28,880 coverage so the density 1553 01:13:28,880 --> 01:13:31,699 for foresters although in our two I don't know if there's 1554 01:13:31,699 --> 01:13:32,399 any half acre 1555 01:13:32,399 --> 01:13:36,779 properties in forest rich proper you know old phase one 1556 01:13:36,779 --> 01:13:38,439 phase two of forest 1557 01:13:38,439 --> 01:13:41,819 ridge they're going to be less than half acre lots so even 1558 01:13:41,819 --> 01:13:42,720 if we had in our two 1559 01:13:42,720 --> 01:13:46,260 designation which you might be proposing they wouldn't 1560 01:13:46,260 --> 01:13:47,840 achieve a half acre 1561 01:13:47,840 --> 01:13:51,850 designation for clarification all right I don't know if 1562 01:13:51,850 --> 01:13:52,840 that would be a 1563 01:13:52,840 --> 01:13:56,960 possibility well I can only speak for my home and 1564 01:13:56,960 --> 01:14:00,119 certainly partly from my neighbors but we have half acre 1565 01:14:00,119 --> 01:14:01,680 lots there along Belmont 1566 01:14:01,680 --> 01:14:06,520 Street so we knew that this area would be developed as you 1567 01:14:06,520 --> 01:14:07,800 had pointed out that 1568 01:14:07,800 --> 01:14:12,680 was no surprise but we had always been led to believe that 1569 01:14:12,680 --> 01:14:13,640 when it was developed 1570 01:14:13,640 --> 01:14:17,930 it would be a continuation of the Alpacao development and 1571 01:14:17,930 --> 01:14:18,600 would be 1572 01:14:18,600 --> 01:14:24,789 developed in the same residential zoning capacity or I'm 1573 01:14:24,789 --> 01:14:25,960 not sure which one I'm 1574 01:14:25,960 --> 01:14:30,609 looking for there and so the NR 3 is a bit of a surprise 1575 01:14:30,609 --> 01:14:31,640 and kind of a rude 1576 01:14:31,640 --> 01:14:34,539 surprise it's not what we were expecting to have happen 1577 01:14:34,539 --> 01:14:38,399 sure thank you any other 1578 01:14:38,399 --> 01:14:44,310 questions thank you sir appreciate your comments next 1579 01:14:44,310 --> 01:14:46,239 speaker I have is Diane 1580 01:14:46,239 --> 01:14:52,840 Garcia speaking in opposition to be followed by Paul Wadley 1581 01:14:52,840 --> 01:14:59,159 hello I'm Diane 1582 01:14:59,159 --> 01:15:05,039 Garcia I live at 120 West Alpacao which goes is the 1583 01:15:05,039 --> 01:15:06,479 intersection with Belmont 1584 01:15:06,479 --> 01:15:11,739 and I am quite concerned about this proposal I'm concerned 1585 01:15:11,739 --> 01:15:12,840 about the traffic 1586 01:15:12,840 --> 01:15:17,020 flow and the fact that people wishing to make the 1587 01:15:17,020 --> 01:15:19,119 connection with Meadowlands is 1588 01:15:19,119 --> 01:15:21,539 going to come are going to come assuming they'll help us 1589 01:15:21,539 --> 01:15:24,239 say I'm to make the current 1590 01:15:24,239 --> 01:15:28,460 the turn I really ask and I'm sure this has been considered 1591 01:15:28,460 --> 01:15:29,159 but has it been 1592 01:15:29,159 --> 01:15:33,199 seriously considered that all accesses be off Country Club 1593 01:15:33,199 --> 01:15:34,399 Country Club is 1594 01:15:34,399 --> 01:15:42,050 already a mess and so this would just be part of it I'm 1595 01:15:42,050 --> 01:15:44,119 also concerned about the 1596 01:15:44,119 --> 01:15:48,960 density rating and as most of the McLaughlin said I would I 1597 01:15:48,960 --> 01:15:50,319 appreciate the 1598 01:15:50,319 --> 01:15:54,970 lowering from in our four to three and I would appreciate 1599 01:15:54,970 --> 01:15:56,880 more serious concerns 1600 01:15:56,880 --> 01:16:02,529 toward the in our two for this great thank you thank you 1601 01:16:02,529 --> 01:16:03,680 for your comments any 1602 01:16:03,680 --> 01:16:10,359 questions thank you ma'am next speaker will be Paul Wadley 1603 01:16:10,359 --> 01:16:11,720 followed by Lisa 1604 01:16:11,720 --> 01:16:19,689 Hill thank you everyone for allowing me to speak I live at 1605 01:16:19,689 --> 01:16:21,039 801 Regency Court 1606 01:16:21,039 --> 01:16:24,289 which is on the northern border of the proposed development 1607 01:16:24,289 --> 01:16:25,279 and we've kind of 1608 01:16:25,279 --> 01:16:27,600 been in our own little world for a long time just kind of 1609 01:16:27,600 --> 01:16:28,520 houses right off of 1610 01:16:28,520 --> 01:16:31,010 Country Club and we've seen developments go up directly 1611 01:16:31,010 --> 01:16:32,399 across Country Club and 1612 01:16:32,399 --> 01:16:35,600 it affected the traffic significantly there are times of 1613 01:16:35,600 --> 01:16:36,600 the day where you 1614 01:16:36,600 --> 01:16:39,300 look to my left and there's cars backed up from hops and 1615 01:16:39,300 --> 01:16:40,800 for miles my concern is 1616 01:16:40,800 --> 01:16:44,720 traffic number one on a more selfish concern the back my 1617 01:16:44,720 --> 01:16:46,479 backyard is lined by 1618 01:16:46,479 --> 01:16:50,180 some very tall lovely trees I would hate to see those go 1619 01:16:50,180 --> 01:16:51,279 for me to look at 1620 01:16:51,279 --> 01:16:54,640 another neighborhood think it would significantly affect 1621 01:16:54,640 --> 01:16:55,560 all the value of 1622 01:16:55,560 --> 01:16:58,300 the properties on that northern border and kind of our own 1623 01:16:58,300 --> 01:16:59,279 formerly isolated 1624 01:16:59,279 --> 01:17:01,680 land on the plus side I think moving those houses on 1625 01:17:01,680 --> 01:17:02,840 Country Club sounds like 1626 01:17:02,840 --> 01:17:06,680 a stellar idea there's currently heavy metal music played 1627 01:17:06,680 --> 01:17:07,239 from one of those 1628 01:17:07,239 --> 01:17:11,359 houses till 1 2 a.m. most nights of the week so having that 1629 01:17:11,359 --> 01:17:11,960 gone would be 1630 01:17:11,960 --> 01:17:16,640 phenomenal but I'm concerned about the trees mostly traffic 1631 01:17:16,640 --> 01:17:18,119 secondarily and 1632 01:17:18,119 --> 01:17:21,270 would mostly just like to talk to mr. Allison about the 1633 01:17:21,270 --> 01:17:22,600 plans for preserving 1634 01:17:22,600 --> 01:17:29,880 natural beauty of that line thank you commissioner Hesbeth 1635 01:17:29,880 --> 01:17:31,880 what just so I can 1636 01:17:31,880 --> 01:17:34,640 get I'm gonna look afterwards what is your address again 1637 01:17:34,640 --> 01:17:35,199 you know one 1638 01:17:35,199 --> 01:17:39,579 Regency right there on Country Club where it's become quite 1639 01:17:39,579 --> 01:17:41,199 busy thank you 1640 01:17:41,199 --> 01:17:44,800 sir sure thing Commissioner Beck thank you chair I was 1641 01:17:44,800 --> 01:17:45,439 hoping 1642 01:17:45,439 --> 01:17:52,340 Commissioner would ask but can you point out where your 1643 01:17:52,340 --> 01:17:54,520 property is located you 1644 01:17:54,520 --> 01:17:58,119 were concerned about trees this is my property here okay 1645 01:17:58,119 --> 01:17:58,880 right on the corner 1646 01:17:58,880 --> 01:18:04,119 and our backyard line is lined with trees that are pretty 1647 01:18:04,119 --> 01:18:05,760 impressive tall 1648 01:18:05,760 --> 01:18:09,779 trees I see cranes live in those trees but I looked and 1649 01:18:09,779 --> 01:18:10,600 they're not protected 1650 01:18:10,600 --> 01:18:15,960 species or anything so I can't get away with that okay 1651 01:18:15,960 --> 01:18:16,479 great thank you 1652 01:18:16,479 --> 01:18:22,489 before you go hey would you raise your hand mr. trees 1661 01:18:41,149 --> 01:18:41,720 will have to be 1662 01:18:41,720 --> 01:18:47,039 preserved yeah that would be lovely thank you okay our next 1663 01:18:47,039 --> 01:18:47,720 speaker will be 1664 01:18:47,720 --> 01:18:54,479 Lisa Hill to be followed by John Pimento 1665 01:19:01,039 --> 01:19:06,079 good afternoon my name is Lisa Hill and we live right next 1666 01:19:06,079 --> 01:19:07,600 door to the McLaughlin 1667 01:19:07,600 --> 01:19:12,680 so I concur with everything they both said when we moved 1668 01:19:12,680 --> 01:19:13,760 into the neighborhood 1669 01:19:13,760 --> 01:19:17,260 we knew that there would be development in the back but I 1670 01:19:17,260 --> 01:19:18,960 concur because we want 1671 01:19:18,960 --> 01:19:24,630 the neighborhood to be consistent with what it is now and I 1672 01:19:24,630 --> 01:19:26,279 know development 1673 01:19:26,279 --> 01:19:30,180 does happen different things does come in but as far as to 1674 01:19:30,180 --> 01:19:30,840 keep you know as 1675 01:19:30,840 --> 01:19:33,829 far as the property values to keep everything now I wasn't 1676 01:19:33,829 --> 01:19:34,800 aware because I 1677 01:19:34,800 --> 01:19:38,810 didn't have a chance to really study everything you mr. 1678 01:19:38,810 --> 01:19:39,760 strange you had made a 1679 01:19:39,760 --> 01:19:43,770 because we're right now it's going to be zoned but in our 1680 01:19:43,770 --> 01:19:45,279 form it's currently in 1681 01:19:45,279 --> 01:19:48,399 our four is going to be three that's correct okay it's 1682 01:19:48,399 --> 01:19:49,600 going down but we 1683 01:19:49,600 --> 01:19:54,550 prefer to if at all possible but anyway bottom line is to 1684 01:19:54,550 --> 01:19:56,039 keep the nature of the 1685 01:19:56,039 --> 01:19:59,529 beauty the trees the flooding and I do know what they're 1686 01:19:59,529 --> 01:20:00,779 speaking of because we 1687 01:20:00,779 --> 01:20:05,420 did see we had the city to come out and it is I mean yeah 1688 01:20:05,420 --> 01:20:06,680 it's a lot of flooding 1689 01:20:06,680 --> 01:20:08,970 there so I would ask them to take that in consideration we 1690 01:20:08,970 --> 01:20:09,779 would like to keep 1691 01:20:09,779 --> 01:20:15,550 it at level zoning to fit all possible thank you okay thank 1692 01:20:15,550 --> 01:20:16,560 you 1693 01:20:16,560 --> 01:20:22,760 next speaker will be John Pimento he is in support and then 1694 01:20:22,760 --> 01:20:24,479 followed by Troy 1695 01:20:24,479 --> 01:20:31,020 Johnson did I get I'm sorry somebody's handing cards I 1696 01:20:31,020 --> 01:20:32,399 apologize that we've we 1697 01:20:32,399 --> 01:20:36,880 got you're correct it is 3b my mistake some of these are 1698 01:20:36,880 --> 01:20:38,399 marked and some are 1699 01:20:38,399 --> 01:20:43,890 not our next speaker will be Troy Johnson that's the last 1700 01:20:43,890 --> 01:20:44,680 card that I have 1701 01:20:44,680 --> 01:20:48,119 here requesting to speak 1702 01:20:50,720 --> 01:20:56,409 okay and I want to thank the city the staff can you just in 1703 01:20:56,409 --> 01:20:57,380 the microphone 1704 01:20:57,380 --> 01:20:59,680 for the guys like will you give your name and full address 1705 01:20:59,680 --> 01:21:00,399 sure please 1706 01:21:00,399 --> 01:21:05,399 Troy Johnson 3200 Belmont thank you sir all right it'll be 1707 01:21:05,399 --> 01:21:06,319 brief since I guess 1708 01:21:06,319 --> 01:21:10,260 I'm the last one in between this gentleman here maybe thank 1709 01:21:10,260 --> 01:21:10,920 you for a 1710 01:21:10,920 --> 01:21:14,210 careful consideration I don't have a lot to add because I 1711 01:21:14,210 --> 01:21:15,359 think many people have 1712 01:21:15,359 --> 01:21:18,960 said many things good things about development we certainly 1713 01:21:18,960 --> 01:21:19,680 understand that 1714 01:21:19,680 --> 01:21:23,100 that's the nature of where we live in the excitement of our 1715 01:21:23,100 --> 01:21:23,800 area also 1716 01:21:23,800 --> 01:21:27,710 important things about scenery about wildlife about mr. 1717 01:21:27,710 --> 01:21:28,920 widely I look forward 1718 01:21:28,920 --> 01:21:32,569 to getting to know him and maybe work with him some I hope 1719 01:21:32,569 --> 01:21:33,199 you're you're also 1720 01:21:33,199 --> 01:21:35,840 mindful maybe one of the things I didn't hear about is is 1721 01:21:35,840 --> 01:21:36,880 school density and 1722 01:21:36,880 --> 01:21:39,399 impact on schools as you continue down this path of 1723 01:21:39,399 --> 01:21:40,720 development and the 1724 01:21:40,720 --> 01:21:43,720 readiness for the school districts to be able to manage 1725 01:21:43,720 --> 01:21:44,800 especially if there are 1726 01:21:44,800 --> 01:21:49,449 120 or so homes if that's what I heard versus 50 fewer 1727 01:21:49,449 --> 01:21:50,800 homes which is a lot 1728 01:21:50,800 --> 01:21:54,609 fewer children as you might expect I do agree with a lot of 1729 01:21:54,609 --> 01:21:55,720 my neighbors there 1730 01:21:55,720 --> 01:21:59,199 the traffic patterns are going to change and I'm glad that 1731 01:21:59,199 --> 01:22:00,399 you understand that 1732 01:22:00,399 --> 01:22:02,180 neighborhood well and I know all of you have probably 1733 01:22:02,180 --> 01:22:03,560 driven through there some 1734 01:22:03,560 --> 01:22:06,600 time or another that will become a good thoroughfare 1735 01:22:06,600 --> 01:22:08,279 especially with ways the 1736 01:22:08,279 --> 01:22:12,689 mobile app that helps us find shortcuts that's a good being 1737 01:22:12,689 --> 01:22:13,239 on it and that 1738 01:22:13,239 --> 01:22:16,229 track that stop sign is going to get run and it's going to 1739 01:22:16,229 --> 01:22:17,439 be a dangerous kind of 1740 01:22:17,439 --> 01:22:20,199 intersection the way that it curves and s is right there 1741 01:22:20,199 --> 01:22:21,399 and so I appreciate a 1742 01:22:21,399 --> 01:22:23,760 lot of thought from us on a part of city planners 1743 01:22:23,760 --> 01:22:25,640 developers as we move forward 1744 01:22:25,640 --> 01:22:28,850 to get that right for the safety of children that are 1745 01:22:28,850 --> 01:22:30,279 walking home from the 1746 01:22:30,279 --> 01:22:32,909 school bus it's quite a ways down or just people that are 1747 01:22:32,909 --> 01:22:33,920 walking their dogs 1748 01:22:33,920 --> 01:22:37,359 during the day and at night and I'll be happy to answer any 1749 01:22:37,359 --> 01:22:38,079 questions you might 1750 01:22:38,079 --> 01:22:42,090 have Commissioner Hedgesmith so if I were to put you on a 1751 01:22:42,090 --> 01:22:43,600 spot and say give me a 1752 01:22:43,600 --> 01:22:47,350 number of houses that use that fit in that square what 1753 01:22:47,350 --> 01:22:48,800 number comes to your 1754 01:22:48,800 --> 01:22:52,500 mind that's a fair amount of homes to fit in that that 1755 01:22:52,500 --> 01:22:54,600 marked area no I'm on 1756 01:22:54,600 --> 01:22:57,840 the frontier my knowledge on that one so you got me there 1757 01:22:57,840 --> 01:22:59,279 but I do like the 1758 01:22:59,279 --> 01:23:03,119 discussion about lot size being somewhat comparable being 1759 01:23:03,119 --> 01:23:05,000 in that 70 range you 1760 01:23:05,000 --> 01:23:08,640 know the lower the lower certainly feels like it's commens 1761 01:23:08,640 --> 01:23:09,439 urate with the 1762 01:23:09,439 --> 01:23:13,819 development of the community and what what's what's all 1763 01:23:13,819 --> 01:23:15,319 around that particular 1764 01:23:15,319 --> 01:23:18,399 lot I thought there was a really good summary about what 1765 01:23:18,399 --> 01:23:19,479 the nature of that 1766 01:23:19,479 --> 01:23:22,399 kind of area is and so something that's kind of commens 1767 01:23:22,399 --> 01:23:23,720 urate or matching in that 1768 01:23:23,720 --> 01:23:30,079 so great answer if I may and so if I were to represent to 1769 01:23:30,079 --> 01:23:31,279 you that the 1770 01:23:31,279 --> 01:23:35,399 developers talking round numbers point three six of an acre 1771 01:23:35,399 --> 01:23:36,479 and the bulk of 1772 01:23:36,479 --> 01:23:42,579 those houses on Belmont are point three eight so we're 1773 01:23:42,579 --> 01:23:43,760 talking about point oh two 1774 01:23:43,760 --> 01:23:48,140 difference for the majority your your property is about 1775 01:23:48,140 --> 01:23:49,359 point four seven 1776 01:23:49,359 --> 01:23:53,409 there's one about point five on that street but all all 1777 01:23:53,409 --> 01:23:54,560 total we're right 1778 01:23:54,560 --> 01:23:57,239 about point oh two let's round it up point oh four 1779 01:23:57,239 --> 01:23:58,600 difference of an acre 1780 01:23:58,600 --> 01:24:05,029 that's that's consistent and do you agree or do you think 1781 01:24:05,029 --> 01:24:06,119 point oh four 1782 01:24:06,119 --> 01:24:12,939 matters that's a that's a great question the thing that I 1783 01:24:12,939 --> 01:24:13,760 would be curious about 1784 01:24:13,760 --> 01:24:17,979 is whether that point three six is an average or if it's a 1785 01:24:17,979 --> 01:24:19,239 minimum size you 1786 01:24:19,239 --> 01:24:21,560 see there's a difference because point three six could mean 1787 01:24:21,560 --> 01:24:22,359 you have some that 1788 01:24:22,359 --> 01:24:26,020 are point five and some that are two point two five and 1789 01:24:26,020 --> 01:24:27,520 point two five lot is 1790 01:24:27,520 --> 01:24:30,529 a very different size lot than a point three six and so 1791 01:24:30,529 --> 01:24:31,960 most of these I think 1792 01:24:31,960 --> 01:24:34,439 the smaller you might have mentioned was point three six I 1793 01:24:34,439 --> 01:24:35,199 think some of my 1794 01:24:35,199 --> 01:24:37,800 neighbors probably have about that and so I would say it 1795 01:24:37,800 --> 01:24:38,840 kind of depends what 1796 01:24:38,840 --> 01:24:43,079 your point three six really represents but if it's in that 1797 01:24:43,079 --> 01:24:44,199 range then you know 1798 01:24:44,199 --> 01:24:46,829 we're talking pretty commensurate but if you're getting 1799 01:24:46,829 --> 01:24:48,640 down a quarter acre size 1800 01:24:48,640 --> 01:24:51,600 and such and even a third of an acre you know that would 1801 01:24:51,600 --> 01:24:52,920 represent smaller I 1802 01:24:52,920 --> 01:24:56,789 think smaller than the smallest in that area so you see 1803 01:24:56,789 --> 01:24:58,119 where I'm coming from 1804 01:24:58,119 --> 01:25:03,079 okay thank you sure thank you yes thank you for your 1805 01:25:03,079 --> 01:25:04,039 comments thank you all for 1806 and then you can fill out a card I 1809 01:25:13,000 --> 01:25:15,840 have one email from 1810 01:25:15,840 --> 01:25:22,100 Andrea and Steve Shula at 601 Regency Court and quote they 1811 01:25:22,100 --> 01:25:23,279 are not completely 1812 01:25:23,279 --> 01:25:25,710 for or against it so I'm going to put them down as a 1813 01:25:25,710 --> 01:25:27,039 neutral and their major 1814 01:25:27,039 --> 01:25:33,130 concerns are traffic and drainage if there's anyone else 1815 01:25:33,130 --> 01:25:34,439 that would like to 1816 01:25:34,439 --> 01:25:36,590 speak on this item Allison 1898 01:29:18,289 --> 01:29:19,840 a question absolutely 1899 01:29:19,840 --> 01:29:33,310 can we bring him back up yes thank you mr. Allison is there 1900 01:29:33,310 --> 01:29:33,880 a way you can 1901 01:29:33,880 --> 01:29:38,159 elaborate for us why you you cannot do NR to hear how that 1902 01:29:38,159 --> 01:29:39,600 would affect your 1903 01:29:39,600 --> 01:29:43,350 your project and why you are requesting NR three could 1904 01:29:43,350 --> 01:29:45,159 could you elaborate that 1905 01:29:45,159 --> 01:29:50,359 point for for us in our audience I can get back to 1906 01:29:58,920 --> 01:29:59,789 trying to get to my presentation I can't find it I'm 1907 01:29:59,789 --> 01:30:02,560 somebody else's 1908 01:30:02,560 --> 01:30:05,319 apologize 1909 01:30:15,159 --> 01:30:25,840 I'll do my best to try and explain for mr. key that's one 1910 01:30:25,840 --> 01:30:26,800 of the reasons we 1911 01:30:26,800 --> 01:30:31,180 brought this slide in as well we weren't trying to to 1912 01:30:31,180 --> 01:30:34,319 disguise anything we feel 1913 01:30:34,319 --> 01:30:37,680 like that in our three less is too close to what we can do 1914 01:30:37,680 --> 01:30:38,760 today Kent really 1915 01:30:38,760 --> 01:30:44,140 doesn't want to do the smaller lots at the same time he's 1916 01:30:44,140 --> 01:30:46,039 got an investment 1917 01:30:46,039 --> 01:30:48,939 there and needs to get a return on the investment and the 1918 01:30:48,939 --> 01:30:51,399 NR three allows up to 1919 01:30:51,399 --> 01:30:54,960 124 but to go to NR two would just put him way too low 1920 01:30:54,960 --> 01:30:55,960 compared put him down 1921 01:30:55,960 --> 01:31:00,119 into the into the 70 range and believe it or not three or 1922 01:31:00,119 --> 01:31:00,960 four more lots can 1923 01:31:00,960 --> 01:31:05,600 make quite a bit of difference so he is looking for that as 1924 01:31:05,600 --> 01:31:07,420 mr. Taylor pointed 1925 01:31:07,420 --> 01:31:15,600 out what's there can be done these densities you need to 1926 01:31:15,600 --> 01:31:16,840 look at because it 1927 01:31:16,840 --> 01:31:19,079 is correct another reason we brought this chart up is you 1928 01:31:19,079 --> 01:31:19,840 've really got to 1929 01:31:19,840 --> 01:31:23,670 look at the zoning and how that affects the overall site 1930 01:31:23,670 --> 01:31:25,079 but I also wanted to 1931 01:31:25,079 --> 01:31:29,090 point out with the ESA limits and the proposed ESA 1932 01:31:29,090 --> 01:31:31,199 alternate ESA if we come 1933 01:31:31,199 --> 01:31:36,229 back I'm taking a long time to answer your question I 1934 01:31:36,229 --> 01:31:38,680 apologize but with this 1935 01:31:38,680 --> 01:31:42,430 it's very difficult to get even with the NR for that high 1936 01:31:42,430 --> 01:31:43,920 density in this area 1937 01:31:43,920 --> 01:31:47,170 because of the lot coverages and the set building setbacks 1938 01:31:47,170 --> 01:31:48,159 and those kind of 1939 01:31:48,159 --> 01:31:52,180 things so the NR three seemed like a good compromise and an 1940 01:31:52,180 --> 01:31:53,039 overall upgrade 1941 01:31:53,039 --> 01:31:56,250 compared to what was there relative to what's over here and 1942 01:31:56,250 --> 01:31:58,439 with his plan that 1943 01:31:58,439 --> 01:32:04,710 we've come up and we're sticking with the the I mean this 1944 01:32:04,710 --> 01:32:06,159 plan shows 73 I don't 1945 01:32:06,159 --> 01:32:09,760 really see it it changing but we said 78 to give us a 1946 01:32:09,760 --> 01:32:11,039 little wiggle room as we go 1947 01:32:11,039 --> 01:32:14,069 through the processes with the city one thing we might 1948 01:32:14,069 --> 01:32:15,520 consider and I'm not sure 1949 01:32:15,520 --> 01:32:19,060 how best to do it would be to eliminate this piece of road 1950 01:32:19,060 --> 01:32:20,779 right here we could 1951 01:32:20,779 --> 01:32:23,409 have two entries well we've got two shown here now we could 1952 01:32:23,409 --> 01:32:24,279 move it down here 1953 01:32:24,279 --> 01:32:26,810 and keep it there this side wouldn't be a problem this 1954 01:32:26,810 --> 01:32:28,039 could be an issue because 1955 01:32:28,039 --> 01:32:31,710 of emergency access and more than needed and maybe we build 1956 01:32:31,710 --> 01:32:32,800 that as an emergency 1957 01:32:32,800 --> 01:32:36,079 access only for some reason not keep it open one of the 1958 01:32:36,079 --> 01:32:38,079 reasons we put the z-shaped 1959 01:32:38,079 --> 01:32:42,460 road in here was to discourage the through traffic the cut 1960 01:32:42,460 --> 01:32:43,560 through traffic 1961 01:32:43,560 --> 01:32:46,319 and it was our understanding that even though not as an 1962 01:32:46,319 --> 01:32:48,439 arterial and maybe I 1963 01:32:48,439 --> 01:32:51,340 misunderstood but I thought Alpacaille was still shown as a 1964 01:32:51,340 --> 01:32:52,279 collector coming 1965 01:32:52,279 --> 01:32:54,970 all the way through so it may not be going through as an 1966 01:32:54,970 --> 01:32:56,159 arterial but will be 1967 01:32:56,159 --> 01:32:58,050 going through as a commercial collector which is 1968 01:32:58,050 --> 01:32:59,239 essentially what it is today 1969 01:32:59,239 --> 01:33:02,279 and that's what's really going to take the cut through 1970 01:33:02,279 --> 01:33:03,640 traffic in the future 1971 01:33:03,640 --> 01:33:07,000 and when you look at the amount of money you put in for p 1972 01:33:07,000 --> 01:33:07,979 aving and different 1973 01:33:07,979 --> 01:33:10,810 things to go with the infrastructure he's just trying to 1974 01:33:10,810 --> 01:33:11,840 find an economically 1975 01:33:11,840 --> 01:33:18,159 feasible number here but he's also looking to keep these 1976 01:33:18,159 --> 01:33:18,960 lots on the higher 1977 01:33:18,960 --> 01:33:25,340 side and also back here to help transition from the bigger 1978 01:33:25,340 --> 01:33:26,399 lots through 1979 01:33:26,399 --> 01:33:30,529 bigger lots to a little bit smaller on this side and again 1980 01:33:30,529 --> 01:33:31,680 I think when we come 1981 01:33:31,680 --> 01:33:34,550 back with the ESA if we come back with an ESA and try and 1982 01:33:34,550 --> 01:33:36,079 look at doing 120 1983 01:33:36,079 --> 01:33:38,680 lots that's where you say you don't get the ESA so you're 1984 01:33:38,680 --> 01:33:39,640 kind of stuck with 1985 01:33:39,640 --> 01:33:43,000 some physical constraints that keep us you know sometimes 1986 01:33:43,000 --> 01:33:44,159 it's the practical 1987 01:33:44,159 --> 01:33:48,220 limitations not the actual specific zoning numbers that 1988 01:33:48,220 --> 01:33:49,560 that minimize or 1989 01:33:49,560 --> 01:33:52,199 determine what we can really do on the site so when you 1990 01:33:52,199 --> 01:33:53,159 look at the zoning 1991 01:33:53,159 --> 01:33:57,880 along with the existing environmentally system of areas it 1992 01:33:57,880 --> 01:33:59,399 's it's tough to even 1993 01:33:59,399 --> 01:34:03,470 do the NR4 out there I mean still be done but it'd be even 1994 01:34:03,470 --> 01:34:04,960 uglier than all 1995 01:34:04,960 --> 01:34:08,779 but if we get the ESA and do this this will be a nice site. 1996 01:34:08,779 --> 01:34:09,939 Well you're up there 1997 01:34:09,939 --> 01:34:12,750 Lee if you don't mind I'm glad you have this map up this is 1998 01:34:12,750 --> 01:34:13,439 a topo map 1999 01:34:13,439 --> 01:34:16,840 essentially that you have on there as well as can you speak 2000 01:34:16,840 --> 01:34:17,640 on your 2001 01:34:17,640 --> 01:34:21,140 professional opinion as to how with the essentially two cul 2002 01:34:21,140 --> 01:34:22,399 -de-sacs that you have 2003 01:34:22,399 --> 01:34:25,760 coming up on the east side of your property how that will 2004 01:34:25,760 --> 01:34:27,079 pick up water and 2005 01:34:27,079 --> 01:34:30,380 the city requirements for I believe it lots have to drain 2006 01:34:30,380 --> 01:34:31,720 to the streets how 2007 01:34:31,720 --> 01:34:34,029 that may improve some of the drainage issues that we've 2008 01:34:34,029 --> 01:34:35,159 heard about this evening. 2009 01:34:35,159 --> 01:34:38,800 Yes I can our focus has been primarily on the floodplain 2010 01:34:38,800 --> 01:34:40,199 itself but as we look 2011 01:34:40,199 --> 01:34:44,210 at this topo map there is a ridge along here and you can 2012 01:34:44,210 --> 01:34:45,640 see there is a small 2013 01:34:45,640 --> 01:34:48,640 area that does drain back to the east and that would go 2014 01:34:48,640 --> 01:34:49,840 into the yards that 2015 01:34:49,840 --> 01:34:52,850 are having some complications with these cul-de-sacs here 2016 01:34:52,850 --> 01:34:53,840 we'd be cutting down 2017 01:34:53,840 --> 01:34:56,819 and we can make sure that all of these areas drain into the 2018 01:34:56,819 --> 01:34:57,800 cul-de-sacs and 2019 01:34:57,800 --> 01:35:01,069 into the creek and away from those homes additionally we'd 2020 01:35:01,069 --> 01:35:02,840 have probably some 2021 01:35:02,840 --> 01:35:05,989 storms so we're maybe not this far back but if there are 2022 01:35:05,989 --> 01:35:07,359 some other problems that 2023 01:35:07,359 --> 01:35:09,880 our development doesn't directly solve we might work with 2024 01:35:09,880 --> 01:35:10,720 the city to extend 2025 01:35:10,720 --> 01:35:13,189 some storms who are to resolve some city problems in that 2026 01:35:13,189 --> 01:35:14,159 area possibly I don't 2027 01:35:14,159 --> 01:35:16,909 know we haven't studied it but there's potential there. 2028 01:35:16,909 --> 01:35:19,800 Okay. Commissioner Rossell. 2029 01:35:19,800 --> 01:35:25,710 This is more clarification maybe for own edification but it 2030 01:35:25,710 --> 01:35:27,800 fits here if this was 2031 01:35:27,800 --> 01:35:31,909 an NR2 zoning the spaces in which they can't develop they 2032 01:35:31,909 --> 01:35:32,640 can displace that 2033 01:35:32,640 --> 01:35:37,000 density elsewhere do you know off the top your head what 2034 01:35:37,000 --> 01:35:38,399 the lot sizes would be 2035 01:35:38,399 --> 01:35:42,479 condensed down to an NR2 I mean wouldn't it be I'm just 2036 01:35:42,479 --> 01:35:43,199 thinking it'd be point 2037 01:35:43,199 --> 01:35:49,630 four and change. Well if we were to develop with this ESA 2038 01:35:49,630 --> 01:35:51,079 and the whole 2039 01:35:51,079 --> 01:35:56,199 things NR2 would probably bound in the 12,000 square foot 2040 01:35:56,199 --> 01:35:57,199 per lot by the time 2041 01:35:57,199 --> 01:36:02,050 you allow for streets and things if we get an alternative E 2042 01:36:02,050 --> 01:36:03,479 SA and we're in the 2043 01:36:03,479 --> 01:36:10,210 NR2 probably more than 14,000 square foot average per lot 2044 01:36:10,210 --> 01:36:12,319 again as I think you 2045 01:36:12,319 --> 01:36:19,539 were pointing out earlier and I'm gonna be off the chart 2046 01:36:19,539 --> 01:36:23,600 here but you know 35 2047 01:36:23,600 --> 01:36:27,829 acres NR2 70 lots we could make this one lot and we could 2048 01:36:27,829 --> 01:36:30,159 make this 69 lots you 2049 01:36:30,159 --> 01:36:32,640 know just to help shift it around because the code when you 2050 01:36:32,640 --> 01:36:33,239 're over two 2051 01:36:33,239 --> 01:36:36,680 acres doesn't doesn't set a minimum lot size it basically 2052 01:36:36,680 --> 01:36:37,640 sets an average and 2053 01:36:37,640 --> 01:36:41,000 the number of lots is based on the gross acreage of the 2054 01:36:41,000 --> 01:36:42,640 development that you know 2055 01:36:42,640 --> 01:36:45,579 NR2 doesn't mean a half acre lot it's probably more in the 2056 01:36:45,579 --> 01:36:47,159 point four acres 2057 01:36:47,159 --> 01:36:50,689 some of these lots I did look earlier depending on you 2058 01:36:50,689 --> 01:36:52,039 found some more in the 2059 01:36:52,039 --> 01:36:55,489 point four point three six range there were some out there 2060 01:36:55,489 --> 01:36:56,640 further away that 2061 01:36:56,640 --> 01:37:01,729 are more like into a point five but it varies thank you I 2062 01:37:01,729 --> 01:37:03,079 'll make one other 2063 01:37:03,079 --> 01:37:06,859 comment one of the issues that probably has not been 2064 01:37:06,859 --> 01:37:07,880 discussed it's gonna be the 2065 01:37:07,880 --> 01:37:13,000 lot coverage and depending on whether it's an NR2 or an NR4 2066 01:37:13,000 --> 01:37:14,039 or a compromise in 2067 01:37:14,039 --> 01:37:16,979 the middle of NR3 you're gonna get a difference in the lot 2068 01:37:16,979 --> 01:37:18,720 coverage to on on 2069 01:37:18,720 --> 01:37:23,119 these and that's part of the issue I assume from what I 2070 01:37:23,119 --> 01:37:24,359 know about the 2071 01:37:24,359 --> 01:37:27,260 developers is one of the driving issues on this is to make 2072 01:37:27,260 --> 01:37:28,399 this a little more of 2073 01:37:28,399 --> 01:37:31,529 a consistent development and then also because a lot 2074 01:37:31,529 --> 01:37:32,960 coverage to make the lots 2075 01:37:32,960 --> 01:37:38,390 be essentially buildable lots and I think that's another 2076 01:37:38,390 --> 01:37:39,600 issue that will 2077 01:37:39,600 --> 01:37:42,739 probably be brought to us and discuss maybe in more detail 2078 01:37:42,739 --> 01:37:43,720 when you all come 2079 01:37:43,720 --> 01:37:47,220 back for preliminary platting in your ESA but I think that 2080 01:37:47,220 --> 01:37:47,899 's just for the 2081 01:37:47,899 --> 01:37:50,970 Commission that's another big issue that's going to come 2082 01:37:50,970 --> 01:37:51,800 before us as to 2083 01:37:51,800 --> 01:37:56,840 why this is where Quest was made to begin with any other 2084 01:37:56,840 --> 01:37:58,079 questions for mr. 2085 01:37:58,079 --> 01:38:07,420 Allison thank you again our public hearing is closed so we 2086 01:38:07,420 --> 01:38:08,760 're in discussion 2087 01:38:08,760 --> 01:38:18,439 or motion commissioner back thank you chair just some 2088 01:38:18,439 --> 01:38:19,680 comments and then I'll 2089 01:38:19,680 --> 01:38:22,720 make a motion I have heard the concerns of the citizens 2090 01:38:22,720 --> 01:38:23,760 around that and I 2091 01:38:23,760 --> 01:38:27,399 understand that course increased traffic drainage issues is 2092 01:38:27,399 --> 01:38:30,279 a legitimate concern 2093 01:38:30,279 --> 01:38:37,130 honestly feel though any changes we have in traffic is to 2094 01:38:37,130 --> 01:38:39,000 distinguish between 2095 01:38:39,000 --> 01:38:44,119 and in our to development and an NR4 you know is is not 2096 01:38:44,119 --> 01:38:45,359 going to be that 2097 01:38:45,359 --> 01:38:49,119 consequential if we're looking at road development on Hobs 2098 01:38:49,119 --> 01:38:50,239 on that's going to 2099 01:38:50,239 --> 01:38:54,750 expand it and Ryan Road eventually you know those are going 2100 01:38:54,750 --> 01:38:55,640 to be the default 2101 01:38:55,640 --> 01:39:00,029 roads to get from Country Club to the Teasley and all that 2102 01:39:00,029 --> 01:39:01,239 the way this is 2103 01:39:01,239 --> 01:39:04,880 set up it's going to actually discourage any cutting 2104 01:39:04,880 --> 01:39:07,680 through is my opinion the 2105 01:39:07,680 --> 01:39:11,039 developer if we get in once we get into that I'm vaguely 2106 01:39:11,039 --> 01:39:12,279 familiar with them 2107 01:39:12,279 --> 01:39:15,640 they're very eco-friendly I think that the concerns people 2108 01:39:15,640 --> 01:39:16,600 have about trees and 2109 01:39:16,600 --> 01:39:19,899 everything will be a laid once we see what the developer 2110 01:39:19,899 --> 01:39:21,119 has in store he's 2111 01:39:21,119 --> 01:39:25,539 been before us on several occasions and he's expressed a 2112 01:39:25,539 --> 01:39:27,199 genuine concern for 2113 01:39:27,199 --> 01:39:30,250 environmentally sound areas keeping things intact as they 2114 01:39:30,250 --> 01:39:36,600 are so as difficult 2115 01:39:36,600 --> 01:39:42,000 as it may be you know to cross paths with the homeowners 2116 01:39:42,000 --> 01:39:42,960 that oppose this I'm 2117 01:39:42,960 --> 01:39:48,680 going to move that we approve this okay the motion for 2118 01:39:48,680 --> 01:39:51,319 approval I have a second 2119 01:39:52,520 --> 01:39:59,359 second Commissioner Taylor second any discussion 2120 01:40:02,800 --> 01:40:11,800 Commissioner Hesbeth yeah I just I struggle with the 2121 01:40:11,800 --> 01:40:14,319 options Commissioner 2122 01:40:14,319 --> 01:40:21,050 Taylor pointed out and I think the most encouraging thing 2123 01:40:21,050 --> 01:40:25,039 for me is Mr. Allison's 2124 01:40:25,039 --> 01:40:29,479 willingness to meet those concerns so really I've boiled 2125 01:40:29,479 --> 01:40:31,119 those concerns down 2126 01:40:31,119 --> 01:40:35,819 to the traffic on Country Club Road which we as a city have 2127 01:40:35,819 --> 01:40:37,479 no control over so 2128 01:40:37,479 --> 01:40:40,930 assuming he works with the neighborhood to mitigate the 2129 01:40:40,930 --> 01:40:42,720 water assuming he works 2130 01:40:42,720 --> 01:40:45,930 with the neighborhood to to preserve trees where he can and 2131 01:40:45,930 --> 01:40:47,600 he's articulated 2132 01:40:47,600 --> 01:40:50,500 those things he's articulated the willingness to shift she 2133 01:40:50,500 --> 01:40:51,279 streets around 2134 01:40:51,279 --> 01:40:57,210 to make it less cut through friendly if you will I really I 2135 01:40:57,210 --> 01:40:59,319 mean there's nothing 2136 01:40:59,319 --> 01:41:02,800 we can do about this body can do about Country Club Road 2137 01:41:02,800 --> 01:41:06,199 and so just just 2138 01:41:06,199 --> 01:41:10,069 thinking out loud I think that that's why I'm at peace with 2139 01:41:10,069 --> 01:41:10,960 it is just because 2140 01:41:10,960 --> 01:41:16,510 he's touched all the concerns of the neighborhood and did 2141 01:41:16,510 --> 01:41:18,000 not go where we've 2142 01:41:18,000 --> 01:41:21,359 seen some go worse just hey here's my project here's what I 2143 01:41:21,359 --> 01:41:22,600 'm gonna do and and 2144 01:41:22,600 --> 01:41:25,569 everyone can pound sand I mean he's he's shown a 2145 01:41:25,569 --> 01:41:27,800 willingness to to be pliable and 2146 01:41:27,800 --> 01:41:32,439 I think that's that's that's commendable so anyway I think 2147 01:41:32,439 --> 01:41:35,199 I think he mitigates 2148 01:41:35,199 --> 01:41:41,109 the concerns of the neighborhood and removes that in our 2149 01:41:41,109 --> 01:41:42,600 for label that's 2150 01:41:42,600 --> 01:41:45,010 hanging out there currently and then we don't have any say 2151 01:41:45,010 --> 01:41:46,279 so and what goes 2152 01:41:46,279 --> 01:41:51,050 there so I want to take advantage of that why we can 2153 01:41:51,050 --> 01:41:52,319 Commissioner Roselle 2154 01:41:52,319 --> 01:41:56,399 thank you chair I just wanted to thank everyone for coming 2155 01:41:56,399 --> 01:41:57,680 out and helping 2156 01:41:57,680 --> 01:42:00,270 us have this conversation and dialogue through this and 2157 01:42:00,270 --> 01:42:01,279 bring up points that 2158 01:42:01,279 --> 01:42:04,899 help contextualize this I can say living in the 2159 01:42:04,899 --> 01:42:06,560 neighborhood if there is 2160 01:42:06,560 --> 01:42:08,569 individuals that cut through I'm gonna I'm gonna be a 2161 01:42:08,569 --> 01:42:10,199 victim to it I'm gonna 2162 01:42:10,199 --> 01:42:13,479 have to deal with El Paseo that stop sign where it's run 2163 01:42:13,479 --> 01:42:15,840 often and I'm sure 2164 01:42:15,840 --> 01:42:18,470 I've seen most people that spoke tonight in my passing on 2165 01:42:18,470 --> 01:42:19,399 the way to work or 2166 01:42:19,399 --> 01:42:23,239 coming home so I'm familiar with the area and I and 2167 01:42:23,239 --> 01:42:25,600 certainly will be 2168 01:42:25,600 --> 01:42:29,289 interested in anxious to see the new traffic patterns and 2169 01:42:29,289 --> 01:42:30,399 hoping that tech 2170 01:42:30,399 --> 01:42:35,079 stock can can approve some stoplights but I think based on 2171 01:42:35,079 --> 01:42:36,319 just the flood 2172 01:42:36,319 --> 01:42:39,060 plane going through someone mentioned earlier that we're 2173 01:42:39,060 --> 01:42:40,159 looking at a tree or 2174 01:42:40,159 --> 01:42:43,470 leaf not a tree and I feel to some extent that might be 2175 01:42:43,470 --> 01:42:45,199 true except that it 2176 01:42:45,199 --> 01:42:50,180 it seems that the floodplain in existence kind of forces 2177 01:42:50,180 --> 01:42:51,399 these lots to 2178 01:42:51,399 --> 01:42:55,260 be kind of capped at a certain size this doesn't seem I don 2179 01:42:55,260 --> 01:42:56,039 't see the 2180 01:42:56,039 --> 01:42:59,510 economics of putting half acre lots in their unit of his NR 2181 01:42:59,510 --> 01:43:00,680 two and there's an 2182 01:43:00,680 --> 01:43:03,909 opportunity right now to make sure duplexes are not built 2183 01:43:03,909 --> 01:43:04,920 on that property 2184 01:43:04,920 --> 01:43:10,069 and so for the reasons independent of what Mr. Taylor 2185 01:43:10,069 --> 01:43:10,680 saying of the 2186 01:43:10,680 --> 01:43:15,090 development going in this still secures this property to a 2187 01:43:15,090 --> 01:43:16,800 point that encourages 2188 01:43:16,800 --> 01:43:19,770 I think a higher level of development that then it 2189 01:43:19,770 --> 01:43:21,520 currently stands and so for 2190 01:43:21,520 --> 01:43:25,289 those reasons and with great hope that the traffic is 2191 01:43:25,289 --> 01:43:28,239 resolved for the approval 2192 01:43:28,239 --> 01:43:30,439 of this 2193 01:43:31,479 --> 01:43:34,899 nobody else any coming I'm gonna make comments to you I'm 2194 01:43:34,899 --> 01:43:35,880 echo what I said 2195 01:43:35,880 --> 01:43:38,789 earlier and Commissioner just Rosal just said is that 2196 01:43:38,789 --> 01:43:40,079 currently this is in our 2197 01:43:40,079 --> 01:43:43,359 four and so we don't typically get a lot of down zoning 2198 01:43:43,359 --> 01:43:44,960 cases here before us and 2199 01:43:44,960 --> 01:43:51,020 I think it's for the neighborhood to the east this is a 2200 01:43:51,020 --> 01:43:52,600 great opportunity for it 2201 01:43:52,600 --> 01:43:56,630 to be down zone from what could go there right now as in 2202 01:43:56,630 --> 01:43:58,359 our four to NNR three I 2203 01:43:58,359 --> 01:44:01,670 think gives a neighborhood a lot more protection than what 2204 01:44:01,670 --> 01:44:02,560 you could face 2205 01:44:02,560 --> 01:44:06,949 within our four and really no say so about it and so for 2206 01:44:06,949 --> 01:44:09,600 that reason alone I'm 2207 01:44:09,600 --> 01:44:15,029 I'm going to support this this evening I also believe that 2208 01:44:15,029 --> 01:44:16,840 because of the design 2209 01:44:16,840 --> 01:44:20,359 that has been put before us which were they're not bound to 2210 01:44:20,359 --> 01:44:21,479 this is a concept 2211 01:44:21,479 --> 01:44:25,710 but familiar with the developer and other projects that 2212 01:44:25,710 --> 01:44:27,560 they've done that I'm 2213 01:44:27,560 --> 01:44:31,079 sure they have taken that into account to make it more 2214 01:44:31,079 --> 01:44:32,640 difficult to get in and 2215 01:44:32,640 --> 01:44:36,050 out of that neighborhood versus just a straight shot do 2216 01:44:36,050 --> 01:44:39,319 West that might make it 2217 01:44:39,319 --> 01:44:42,600 more of a cut through that I think that is a good first 2218 01:44:42,600 --> 01:44:43,840 step we'll have an 2219 01:44:43,840 --> 01:44:46,739 opportunity look at that when they bring it back and the 2220 01:44:46,739 --> 01:44:48,680 final reason I'm 2221 01:44:48,680 --> 01:44:51,130 gonna support it is because I have heard the neighbors 2222 01:44:51,130 --> 01:44:52,079 concerns about the 2223 01:44:52,079 --> 01:44:55,760 drainage and I think when the streets get in here sooner 2224 01:44:55,760 --> 01:44:57,560 rather than later and 2225 01:44:57,560 --> 01:45:00,920 they have to meet the development code to have those slots 2226 01:45:00,920 --> 01:45:01,760 drained to the 2227 01:45:01,760 --> 01:45:05,079 street that some of your issues will get addressed that 2228 01:45:05,079 --> 01:45:06,520 right now if this doesn't 2229 01:45:06,520 --> 01:45:09,760 move forward you may be having to contend with those for 2230 01:45:09,760 --> 01:45:11,159 some time longer 2231 01:45:11,159 --> 01:45:15,010 so for those three reasons I'm going to support this as 2232 01:45:15,010 --> 01:45:16,600 well and unless anybody 2233 01:45:16,600 --> 01:45:21,439 else has a comment I'm gonna call for a hand vote this 2234 01:45:21,439 --> 01:45:23,239 evening all those in 2235 01:45:23,239 --> 01:45:28,319 favor please raise your right hand all those opposed same 2236 01:45:28,319 --> 01:45:29,720 sign and the motion 2237 01:45:29,720 --> 01:45:36,340 to approve carries six to zero thank you all for coming out 2238 01:45:36,340 --> 01:45:39,000 this evening that 2239 01:45:39,000 --> 01:45:50,279 will move us to our item 3b and I'm going to give them 2240 01:46:00,720 --> 01:46:05,100 we can I exit your presentation give the room just a couple 2241 01:46:05,100 --> 01:46:10,279 more minutes to kind 2242 01:46:10,279 --> 01:46:14,569 of clear since we're kind of small and then we'll open our 2243 01:46:14,569 --> 01:46:15,760 next item here 2244 01:46:29,720 --> 01:46:53,189 I know I'm like somewhere we're kind of having a de facto 2245 01:46:53,189 --> 01:46:57,880 break here 2246 01:46:59,720 --> 01:47:05,750 you want me just to call it for five minutes here I tell 2247 01:47:05,750 --> 01:47:08,399 you what we've got a 2248 01:47:08,399 --> 01:47:10,729 few more people trying to clear the room and I think a 2249 01:47:10,729 --> 01:47:11,880 couple people needed to 2250 01:47:11,880 --> 01:47:18,039 take a quick break I'm a caller recess at 750 2251 01:47:29,720 --> 01:47:48,840 I'm Julie Wyatt this is s 16 6 quick trip do you want to go 2252 01:47:48,840 --> 01:47:49,239 over the whole 2253 01:47:49,239 --> 01:47:52,199 presentation again or do we want to do the summary okay all 2254 01:47:52,199 --> 01:47:52,760 right we'll do the 2255 01:47:52,760 --> 01:47:55,439 summary all right the request before you is to consider a 2256 01:47:55,439 --> 01:47:56,439 modification of an 2257 01:47:56,439 --> 01:48:01,079 existing approved SUP to permit 16 additional parking 2258 01:48:01,079 --> 01:48:03,319 spaces at the quick 2259 01:48:03,319 --> 01:48:09,210 trip location at the corner of Carroll and Eagle staff has 2260 01:48:09,210 --> 01:48:10,600 reviewed the 2261 01:48:10,600 --> 01:48:13,390 request and compared it against the criteria for approval 2262 01:48:13,390 --> 01:48:14,479 and does recommend 2263 01:48:14,479 --> 01:48:19,789 approval and let me get down to the with conditions that 2264 01:48:19,789 --> 01:48:21,720 the proposed development 2265 01:48:21,720 --> 01:48:25,260 substantially comply with the site plan landscape plan and 2266 01:48:25,260 --> 01:48:26,560 grading plan as they 2267 01:48:26,560 --> 01:48:29,529 have been submitted which includes and I'll summarize the 2268 01:48:29,529 --> 01:48:30,520 installation of a 2269 01:48:30,520 --> 01:48:35,880 curb inlet filter with an irreplaceable REM fog media pack 2270 01:48:35,880 --> 01:48:36,880 at the northwest 2271 01:48:36,880 --> 01:48:40,069 corner of the site and that it should be three reports 2272 01:48:40,069 --> 01:48:41,600 should be submitted to the 2273 01:48:41,600 --> 01:48:45,000 planning department per year demonstrating that it is being 2274 01:48:45,000 --> 01:48:49,770 maintained in accordance with the manufacturers 2275 01:48:49,770 --> 01:48:52,079 instructions that they 2276 01:48:52,079 --> 01:48:55,149 place a marked pedestrian connection between the the 2277 01:48:55,149 --> 01:48:56,640 sidewalk on North Carroll 2278 01:48:56,640 --> 01:49:00,699 and the retail building that they do relocate those 2279 01:49:00,699 --> 01:49:02,479 existing trees on the 2280 01:49:02,479 --> 01:49:05,739 site that can be saved and staff also recommends an 2281 01:49:05,739 --> 01:49:07,520 additional four two inch 2282 01:49:07,520 --> 01:49:11,439 caliper large canopy tree trees to be planted in accordance 2283 01:49:11,439 --> 01:49:12,159 with sub chapter 2284 01:49:12,159 --> 01:49:14,939 13 of the Denton Development Code I can stand for any 2285 01:49:14,939 --> 01:49:15,880 questions and the 2286 01:49:15,880 --> 01:49:23,029 applicant is also here so thank you chair hi Julie hi hey 2287 01:49:23,029 --> 01:49:23,920 just a question 2288 01:49:23,920 --> 01:49:29,079 back about that filter in the reports what is in those 2289 01:49:29,079 --> 01:49:31,159 reports or how did we 2290 01:49:31,159 --> 01:49:35,260 come up with three a year would would do and are we as a 2291 01:49:35,260 --> 01:49:36,439 city we're just in 2292 01:49:36,439 --> 01:49:40,000 trusting them to do that or we're gonna look at these 2293 01:49:40,000 --> 01:49:41,800 filters or just elaborate 2294 01:49:41,800 --> 01:49:46,130 on sure that's based upon the manufacturers specifications 2295 01:49:46,130 --> 01:49:46,359 for 2296 01:49:46,359 --> 01:49:51,310 maintenance and yes they would be submitted to planning if 2297 01:49:51,310 --> 01:49:52,359 if for some 2298 01:49:52,359 --> 01:49:56,000 reason they didn't work as they were supposed to or they 2299 01:49:56,000 --> 01:49:56,880 did not maintain 2300 01:49:56,880 --> 01:50:00,699 them in accordance with this SUPs can be revoked by the 2301 01:50:00,699 --> 01:50:03,159 City Council so there is 2302 01:50:03,159 --> 01:50:08,310 some some checks and balances with that do the reports come 2303 01:50:08,310 --> 01:50:08,720 from the 2304 01:50:08,720 --> 01:50:11,529 manufacturer or telling them what to put in they would come 2305 01:50:11,529 --> 01:50:12,560 from the applicant 2306 01:50:12,560 --> 01:50:16,039 just just reporting to us that they have maintained that's 2307 01:50:16,039 --> 01:50:16,840 all that that's 2308 01:50:16,840 --> 01:50:19,770 really gonna say is we've done it here's the date we've 2309 01:50:19,770 --> 01:50:21,279 done it yes ma'am yes ma'am 2310 01:50:21,279 --> 01:50:25,720 but we're not gonna check it well and hopefully we don't we 2311 01:50:25,720 --> 01:50:26,760 we don't always 2312 01:50:26,760 --> 01:50:30,829 have the manpower to go out there and do the inspections we 2313 01:50:30,829 --> 01:50:32,720 'd like to and and and 2314 01:50:32,720 --> 01:50:37,539 Deborah's here and she may be able to add she knows a lot 2315 01:50:37,539 --> 01:50:39,359 about the I swim and 2316 01:50:39,359 --> 01:50:46,930 best management practices for that good evening the Robiera 2317 01:50:46,930 --> 01:50:47,720 with environmental 2318 01:50:47,720 --> 01:50:50,840 services and sustainability pretty much what we have is a 2319 01:50:50,840 --> 01:50:52,279 control that is trying 2320 01:50:52,279 --> 01:50:55,640 to deal with two aspects the floatables and the pollution 2321 01:50:55,640 --> 01:50:57,579 in the water they the 2322 01:50:57,579 --> 01:51:01,449 media the filtering media that they're using is for fog 2323 01:51:01,449 --> 01:51:02,800 which stands for fat 2324 01:51:02,800 --> 01:51:06,579 oils and grease and pretty much what they're collecting is 2325 01:51:06,579 --> 01:51:07,640 all the oils that 2326 01:51:07,640 --> 01:51:11,569 my wash out from from that parking surface and then they 2327 01:51:11,569 --> 01:51:12,680 will call that 2328 01:51:12,680 --> 01:51:16,380 also the floatables this is a site that they're pretty much 2329 01:51:16,380 --> 01:51:17,680 retrofitting they 2330 01:51:17,680 --> 01:51:22,060 only have one curb inlet on site so that's what they're 2331 01:51:22,060 --> 01:51:23,560 using those 2332 01:51:23,560 --> 01:51:25,979 controls are good as long as they're maintained properly 2333 01:51:25,979 --> 01:51:26,739 according to the 2334 01:51:26,739 --> 01:51:30,750 manufacturer so it would be upon the the applicant to 2335 01:51:30,750 --> 01:51:32,840 actually keep them up it's 2336 01:51:32,840 --> 01:51:36,199 my understanding that the QT corporation have a maintenance 2337 01:51:36,199 --> 01:51:37,180 division who deals 2338 01:51:37,180 --> 01:51:39,970 with this type of controls these controls are not new to 2339 01:51:39,970 --> 01:51:40,800 them they have 2340 01:51:40,800 --> 01:51:43,520 using in other facilities as well so they're familiar with 2341 01:51:43,520 --> 01:51:44,840 it so with the 2342 01:51:44,840 --> 01:51:48,680 history of maintenance and knowledge about it staff feel 2343 01:51:48,680 --> 01:51:49,800 comfortable that they 2344 01:51:49,800 --> 01:51:52,399 will be able to proceed and do the maintenance accordingly 2345 01:51:52,399 --> 01:51:53,479 and we don't 2346 01:51:53,479 --> 01:51:57,810 have anything as a city that that checks checks on these at 2347 01:51:57,810 --> 01:51:59,880 all we currently don't 2348 01:51:59,880 --> 01:52:05,300 however when we don't see when when those controls are 2349 01:52:05,300 --> 01:52:06,760 start malfunctioning 2350 01:52:06,760 --> 01:52:10,960 it would be visible people will start complaining about it 2351 01:52:10,960 --> 01:52:11,960 so at that time 2352 01:52:11,960 --> 01:52:15,899 probably is when stuff will be able to go in and check for 2353 01:52:15,899 --> 01:52:16,880 those the other 2354 01:52:16,880 --> 01:52:22,159 thing is most of the time when we move from the design a 2355 01:52:22,159 --> 01:52:23,800 stage where the 2356 01:52:23,800 --> 01:52:28,340 engineers put them all those controls is up to the manager 2357 01:52:28,340 --> 01:52:30,399 or the owner of that 2358 01:52:30,399 --> 01:52:34,420 business to actually know about it perform their 2359 01:52:34,420 --> 01:52:36,479 maintenance and so on so I 2360 01:52:36,479 --> 01:52:41,270 think that it's a learning process not only from the design 2361 01:52:41,270 --> 01:52:42,560 you know you have 2362 01:52:42,560 --> 01:52:47,199 this you have for now on to follow up and that's I believe 2363 01:52:47,199 --> 01:52:48,399 is why staff is 2364 01:52:48,399 --> 01:52:51,979 required all those conditions to be put on the ordinance as 2365 01:52:51,979 --> 01:52:55,119 a reminder of what 2366 01:52:55,119 --> 01:52:58,520 is needed to be done 2367 01:53:01,199 --> 01:53:08,000 thank you chair I was just curious how many other I guess 2368 01:53:08,000 --> 01:53:09,159 sites or developments 2369 01:53:09,159 --> 01:53:12,619 in Denton currently have do some kind of reporting every 2370 01:53:12,619 --> 01:53:13,880 six months or years 2371 01:53:13,880 --> 01:53:17,050 well actually the razor range who have some specifications 2372 01:53:17,050 --> 01:53:18,640 about the reporting 2373 01:53:18,640 --> 01:53:22,520 of the BMPs that they have put in place the other 2374 01:53:22,520 --> 01:53:24,279 businesses that they have 2375 01:53:24,279 --> 01:53:29,039 controls like bio life they have a skirt inside the inlet 2376 01:53:29,039 --> 01:53:31,840 that is intended to 2377 01:53:31,840 --> 01:53:37,340 filtrate chewy have also a similar device on the parking 2378 01:53:37,340 --> 01:53:38,960 lot they are not 2379 01:53:38,960 --> 01:53:44,279 required to put controls I'm sorry they're not required to 2380 01:53:44,279 --> 01:53:45,560 provide reports 2381 01:53:45,560 --> 01:53:50,800 of it however as again in those instances where we have 2382 01:53:50,800 --> 01:53:52,840 seen malfunctioning or 2383 01:53:52,840 --> 01:53:55,890 evidence that they are not being properly maintained we 2384 01:53:55,890 --> 01:53:57,279 most of the time 2385 01:53:57,279 --> 01:54:00,779 approach whoever is the manager and as long as we tell them 2386 01:54:00,779 --> 01:54:01,960 hey do you know that 2387 01:54:01,960 --> 01:54:04,619 you have an alternative development plan or you have 2388 01:54:04,619 --> 01:54:05,960 something that makes you 2389 01:54:05,960 --> 01:54:10,479 maintain them they act on it sometimes because they they 2390 01:54:10,479 --> 01:54:13,399 don't know and so right 2391 01:54:13,399 --> 01:54:18,479 now you said razor ranch that that would be is that an MPC 2392 01:54:18,479 --> 01:54:20,079 no the razor range is 2393 01:54:20,079 --> 01:54:22,899 actually an overlay district okay so the so an overlay 2394 01:54:22,899 --> 01:54:25,560 district ADP or SUP are 2395 01:54:25,560 --> 01:54:30,199 those those are or maybe an ESA those are the only types of 2396 01:54:30,199 --> 01:54:30,680 his little of 2397 01:54:30,680 --> 01:54:34,050 instruments that would require this or do some general 2398 01:54:34,050 --> 01:54:36,000 drainage plans are not 2399 01:54:36,000 --> 01:54:39,130 actually it will be most of the time for example you can 2400 01:54:39,130 --> 01:54:40,479 have excess parking as 2401 01:54:40,479 --> 01:54:44,270 long as you use pervious surface okay so is in those 2402 01:54:44,270 --> 01:54:46,039 instances when you don't 2403 01:54:46,039 --> 01:54:48,569 provide the previous surfaces that you go through some sort 2404 01:54:48,569 --> 01:54:49,319 of alternative 2405 01:54:49,319 --> 01:54:55,649 mechanism so in this case have been overlay districts could 2406 01:54:55,649 --> 01:54:57,659 be NPCs master 2407 01:54:57,659 --> 01:55:01,039 plan communities specific use permits alternative 2408 01:55:01,039 --> 01:55:05,680 development plans any other 2409 01:55:05,680 --> 01:55:10,680 questions for Denver thank you 2410 01:55:12,880 --> 01:55:16,329 Julie I think you were going through some I think we got to 2411 01:55:16,329 --> 01:55:16,840 the first two 2412 01:55:16,840 --> 01:55:26,000 conditions I'll just repeat and then the marked pedestrian 2413 01:55:26,000 --> 01:55:26,840 connection we would 2414 01:55:26,840 --> 01:55:31,510 require that as part of it can as a condition to relocate 2415 01:55:31,510 --> 01:55:32,920 those existing 2416 01:55:32,920 --> 01:55:37,140 trees where those proposed parking spots would be and then 2417 01:55:37,140 --> 01:55:38,159 staff also is 2418 01:55:38,159 --> 01:55:43,789 recommending that they plant for two inch caliper trees in 2419 01:55:43,789 --> 01:55:44,880 accordance with 2420 01:55:44,880 --> 01:55:51,800 our sub chapter 13 requirements in order to to maintain the 2421 01:55:51,800 --> 01:55:52,960 tree canopy that 2422 01:55:52,960 --> 01:55:58,710 that's similar to the tree canopy that exists today 2423 01:55:58,710 --> 01:56:01,439 commissioner Tyler thank 2424 01:56:01,439 --> 01:56:05,460 you chair so when you say relocate you mean relocate that 2425 01:56:05,460 --> 01:56:08,079 exact tree not okay 2426 01:56:08,079 --> 01:56:13,239 was that hey is that a preferred solution or was that just 2427 01:56:13,239 --> 01:56:14,039 what the 2428 01:56:14,039 --> 01:56:16,979 applicant offered or that's what they offered and I know 2429 01:56:16,979 --> 01:56:17,960 Haywood talks to 2430 01:56:17,960 --> 01:56:21,159 applicants about that a lot that you can that you can reloc 2431 01:56:21,159 --> 01:56:22,279 ate trees if you if 2432 01:56:22,279 --> 01:56:25,939 you do it correctly and and make sure that you take care of 2433 01:56:25,939 --> 01:56:28,439 it so they can 2434 01:56:28,439 --> 01:56:30,949 save them and and they don't don't have to go away so that 2435 01:56:30,949 --> 01:56:31,720 was something that 2436 01:56:31,720 --> 01:56:36,439 they proposed normally we see shall be mitigated with or 2437 01:56:36,439 --> 01:56:37,319 shall be replaced by 2438 01:56:37,319 --> 01:56:40,630 so when it said relocated I just wanted to make sure that 2439 01:56:40,630 --> 01:56:42,439 wasn't the right 2440 01:56:42,439 --> 01:56:46,359 commissioner better monkey and on that so if trains 2441 01:56:46,359 --> 01:56:47,720 planning any of those they 2442 01:56:47,720 --> 01:56:52,359 die within a set period of time we can make them replace it 2443 01:56:52,359 --> 01:56:54,720 our our landscape 2444 01:56:54,720 --> 01:56:57,199 code does require that they maintain them and I believe it 2445 01:56:57,199 --> 01:56:58,000 's for a period of 2446 01:56:58,000 --> 01:57:00,300 three years that three years they're looked at and that 2447 01:57:00,300 --> 01:57:01,199 they have to irrigate 2448 01:57:01,199 --> 01:57:06,100 them and make sure that they stay alive okay thank you I'm 2449 01:57:06,100 --> 01:57:06,760 good if I'm current 2450 01:57:06,760 --> 01:57:14,130 on that any other questions for staff thank you Julie thank 2451 01:57:14,130 --> 01:57:17,439 you I have one 2452 01:57:17,439 --> 01:57:23,729 card for speaker I've got it right now I think John Piment 2453 01:57:23,729 --> 01:57:25,640 el if you'll give your 2454 01:57:25,640 --> 01:57:29,300 name and address and looks like you're in support and you 2455 01:57:29,300 --> 01:57:30,359 'll have four minutes 2456 01:57:30,359 --> 01:57:33,760 are you the applicant yes I don't have to do a car got ten 2457 01:57:33,760 --> 01:57:34,960 minutes or okay 2458 01:57:34,960 --> 01:57:40,640 perfect I go with the four John Pimentel address is 3708 2459 01:57:40,640 --> 01:57:41,840 Beatrice Drive here in 2460 01:57:41,840 --> 01:57:45,119 Denton I'm a real estate project manager for a quick trip 2461 01:57:45,119 --> 01:57:46,359 the reason why we're 2462 01:57:46,359 --> 01:57:49,050 wanting to do this is we're going back to our sites our 2463 01:57:49,050 --> 01:57:50,239 number one complaint 2464 01:57:50,239 --> 01:57:52,039 and it's kind of sound it's a good problem to have but it's 2465 01:57:52,039 --> 01:57:52,640 we're just too 2466 01:57:52,640 --> 01:57:56,649 busy particularly here in three out of our Denton three out 2467 01:57:56,649 --> 01:57:57,039 of four of our 2468 01:57:57,039 --> 01:58:00,670 Denton stores is top 20% in DFW I worked at stores for nine 2469 01:58:00,670 --> 01:58:01,560 years and I worked 2470 01:58:01,560 --> 01:58:04,670 at both stores that were this one and hopefully next month 2471 01:58:04,670 --> 01:58:05,640 the one on 35 2472 01:58:05,640 --> 01:58:09,479 there's busy stores and recently we don't have any here in 2473 01:58:09,479 --> 01:58:09,840 then 2474 01:58:09,840 --> 01:58:12,510 unfortunately but we have some of the sites with four entr 2475 01:58:12,510 --> 01:58:13,680 ances this one has 2476 01:58:13,680 --> 01:58:16,449 one so we just kind of causes a lot of congestion problems 2477 01:58:16,449 --> 01:58:17,399 in the store and if 2478 01:58:17,399 --> 01:58:19,470 you ever been to the store the 135 is just the lot 2479 01:58:19,470 --> 01:58:20,520 circulation is very poor 2480 01:58:20,520 --> 01:58:23,460 just don't have enough parking spaces and again that's our 2481 01:58:23,460 --> 01:58:24,960 number one complaint 2482 01:58:24,960 --> 01:58:27,859 that we received for these two stores and with that I just 2483 01:58:27,859 --> 01:58:28,800 really want to open 2484 01:58:28,800 --> 01:58:32,880 up to any questions you may have okay Commissioner Burke 2485 01:58:32,880 --> 01:58:35,800 thank you chair thank 2486 01:58:35,800 --> 01:58:40,899 you for your presentation fair warning I'm an opponent of 2487 01:58:40,899 --> 01:58:42,319 more and more parking 2488 01:58:42,319 --> 01:58:44,880 spaces I'm in fact I've tried to encourage city staff to 2489 01:58:44,880 --> 01:58:45,640 review didn't 2490 01:58:45,640 --> 01:58:48,069 development code and consider eliminating the required 2491 01:58:48,069 --> 01:58:49,880 parking space so 2492 01:58:49,880 --> 01:58:54,649 justify 16 parking spaces for that particular site keeping 2493 01:58:54,649 --> 01:58:55,239 in mind I 2494 01:58:55,239 --> 01:58:58,380 realize you'll have that door on one side but you've got a 2495 01:58:58,380 --> 01:58:59,279 lot of student 2496 01:58:59,279 --> 01:59:03,069 population there that's gonna ambulate you know they're not 2497 01:59:03,069 --> 01:59:04,439 gonna drive so 2498 01:59:04,439 --> 01:59:07,510 taking that into consideration do you really think it's 2499 01:59:07,510 --> 01:59:09,000 gonna require 16 2500 01:59:09,000 --> 01:59:12,789 parking spaces to handle what you suspected is gonna be oh 2501 01:59:12,789 --> 01:59:13,479 absolutely yes 2502 01:59:13,479 --> 01:59:16,439 sir if we could possibly put more you probably would we do 2503 01:59:16,439 --> 01:59:17,239 get a lot of foot 2504 01:59:17,239 --> 01:59:19,930 traffic at this door from the college students but we get a 2505 01:59:19,930 --> 01:59:20,880 lot of car traffic 2506 01:59:20,880 --> 01:59:23,680 as well and we're experiencing issues now with actually 2507 01:59:23,680 --> 01:59:25,159 parking at the pumps 2508 01:59:25,159 --> 01:59:27,739 when they're not actually needing to get gas I'm including 2509 01:59:27,739 --> 01:59:28,760 those college students 2510 01:59:28,760 --> 01:59:31,170 who don't need to get gas and they'll just park there and 2511 01:59:31,170 --> 01:59:33,319 it's just holding up 2512 01:59:33,319 --> 01:59:37,600 parking or a spot or a fueling position for our customers 2513 01:59:37,600 --> 01:59:40,239 okay thank you yes sir 2514 01:59:40,239 --> 01:59:45,670 Commissioner O'Zell thank you chair Commissioner Beck I've 2515 01:59:45,670 --> 01:59:46,680 frequented this 2516 01:59:46,680 --> 01:59:52,579 quick trip and so I can tell you at about 740 745 in the a. 2517 01:59:52,579 --> 01:59:54,039 m. I am frequently 2518 01:59:54,039 --> 01:59:58,319 parking at a pump or leaving this location because it is 2519 01:59:58,319 --> 01:59:59,560 slammed packed 2520 01:59:59,560 --> 02:00:03,890 and so I can totally I understand and I'm typically with 2521 02:00:03,890 --> 02:00:05,560 you at the reduction 2522 02:00:05,560 --> 02:00:08,920 of parking a lot of places but I can certainly see a need 2523 02:00:08,920 --> 02:00:10,560 for this because 2524 02:00:10,560 --> 02:00:13,550 they're certainly missing out on business because their 2525 02:00:13,550 --> 02:00:14,640 parking situation 2526 02:00:14,640 --> 02:00:22,479 is really it's bad in the mornings it is crazy and I would 2527 02:00:22,479 --> 02:00:22,840 like to say we 2528 02:00:22,840 --> 02:00:25,739 actually would not want to add more parking you know just 2529 02:00:25,739 --> 02:00:26,720 cost extra you 2530 02:00:26,720 --> 02:00:29,859 know but it's just again dictated by customer feedback and 2531 02:00:29,859 --> 02:00:30,640 need and this is 2532 02:00:30,640 --> 02:00:33,729 actually as busy as it is we have two other den stores that 2533 02:00:33,729 --> 02:00:34,560 are far busier 2534 02:00:34,560 --> 02:00:38,199 than than this one so the one on May Hill is our best store 2535 02:00:38,199 --> 02:00:39,039 in Dallas Fort Worth 2536 02:00:39,039 --> 02:00:44,729 that is not a travel center so Commissioner Hespeth yeah I 2537 02:00:44,729 --> 02:00:45,640 just want 2538 02:00:45,640 --> 02:00:50,079 to add one nugget I am concerned a little bit about and I 2539 02:00:50,079 --> 02:00:50,800 know you're 2540 02:00:50,800 --> 02:00:54,600 adding an entrance there so maybe it'll fix it but just for 2541 02:00:54,600 --> 02:00:56,640 to add a note I'm 2542 02:00:56,640 --> 02:00:59,000 curious about the security features from behind the 2543 02:00:59,000 --> 02:01:00,439 building because you have the 2544 02:01:00,439 --> 02:01:03,260 yeah the day labor center you have the people I mean I mean 2545 02:01:03,260 --> 02:01:03,960 the homeless 2546 02:01:03,960 --> 02:01:07,069 population in Denton is just growing right so so they kind 2547 02:01:07,069 --> 02:01:07,920 of hang out so if 2548 02:01:07,920 --> 02:01:09,729 you're looking at the front door they hang out to the left 2549 02:01:09,729 --> 02:01:10,359 there on the side 2550 02:01:10,359 --> 02:01:13,159 of the ice machine and so now you give them access around a 2551 02:01:13,159 --> 02:01:14,640 building and so if 2552 02:01:14,640 --> 02:01:17,039 I have college students walking up let's say or someone 2553 02:01:17,039 --> 02:01:18,359 from the laundry mat down 2554 02:01:18,359 --> 02:01:22,369 I just I would just I don't know what that's what that 2555 02:01:22,369 --> 02:01:23,680 looks like in practice 2556 02:01:23,680 --> 02:01:27,600 I would just say hey I am generally concerned about parking 2557 02:01:27,600 --> 02:01:28,319 around back if 2558 02:01:28,319 --> 02:01:31,420 there's not lighting or some other things done to try to 2559 02:01:31,420 --> 02:01:32,520 and again there's 2560 02:01:32,520 --> 02:01:34,590 gonna be entrance there so it's gonna be going in and out 2561 02:01:34,590 --> 02:01:36,680 sure I just I do have 2562 02:01:36,680 --> 02:01:41,329 some concern not enough doesn't rise to the level where I'm 2563 02:01:41,329 --> 02:01:42,119 against it it just 2564 02:01:42,119 --> 02:01:45,270 is a concern no it's a valid concern and actually I'm happy 2565 02:01:45,270 --> 02:01:45,800 you brought that up 2566 02:01:45,800 --> 02:01:48,010 because about two years ago we went through a whole 50 2567 02:01:48,010 --> 02:01:48,680 million dollar 2568 02:01:48,680 --> 02:01:51,529 security project and every square inch of the store is 2569 02:01:51,529 --> 02:01:52,800 filmed and monitored I 2570 02:01:52,800 --> 02:01:56,260 think in Tulsa and I think one per every ten stores or so 2571 02:01:56,260 --> 02:01:57,720 is being watched at 2572 02:01:57,720 --> 02:02:00,840 same time and it's it's and I'm not exaggerating it's the 2573 02:02:00,840 --> 02:02:01,760 best in retail 2574 02:02:01,760 --> 02:02:04,520 the Federal Reserve actually came to us and asked us how we 2575 02:02:04,520 --> 02:02:05,520 can go about it for 2576 02:02:05,520 --> 02:02:08,920 banks we hired a former general who running our security 2577 02:02:08,920 --> 02:02:10,159 team and it's bar 2578 02:02:10,159 --> 02:02:12,789 none of the best security system there so we're bragging 2579 02:02:12,789 --> 02:02:13,760 about that but it's 2580 02:02:13,760 --> 02:02:19,840 it's absolutely true no and I don't disagree but this is a 2581 02:02:19,840 --> 02:02:20,319 little pet peeve 2582 02:02:20,319 --> 02:02:22,659 of mine sure I'm going to tangent you can go you can go to 2583 02:02:22,659 --> 02:02:23,800 the post office and 2584 02:02:23,800 --> 02:02:26,029 you have great pictures of people are looking for finding 2585 02:02:26,029 --> 02:02:26,680 them is a tricky 2586 02:02:26,680 --> 02:02:30,810 part so so the fact that you capture on video you know you 2587 02:02:30,810 --> 02:02:32,279 got I mean I wanted 2588 02:02:32,279 --> 02:02:34,859 to be more preventative then we have a video of them and if 2589 02:02:34,859 --> 02:02:35,680 you see them call 2590 02:02:35,680 --> 02:02:38,739 us yeah and I'm not saying that's your practice I'm just 2591 02:02:38,739 --> 02:02:40,039 saying I don't I take 2592 02:02:40,039 --> 02:02:44,060 little comfort and when people I mean it happens often but 2593 02:02:44,060 --> 02:02:45,439 it and so I'll say it's 2594 02:02:45,439 --> 02:02:47,529 a pet peeve of mine but people say hey I have a video 2595 02:02:47,529 --> 02:02:49,640 system and there's pictures 2596 02:02:49,640 --> 02:02:52,529 of them but you can't you know you got to get them and so I 2597 02:02:52,529 --> 02:02:53,399 just want to I just 2598 02:02:53,399 --> 02:02:56,590 want to I think y'all are on top of it and that's great to 2599 02:02:56,590 --> 02:02:57,840 know because then I 2600 02:02:57,840 --> 02:03:02,899 wanted to champion you know what y'all are doing and for 2601 02:03:02,899 --> 02:03:03,960 our community that I 2602 02:03:03,960 --> 02:03:09,020 think so I appreciate that commissioner back it wasn't 2603 02:03:09,020 --> 02:03:11,119 brought up but we you'd be 2604 02:03:11,119 --> 02:03:16,300 adding lighting in the back there yes sir okay thanks any 2605 02:03:16,300 --> 02:03:17,600 other questions for 2606 02:03:17,600 --> 02:03:24,800 applicant thank you sir for your presentation 2607 02:03:25,199 --> 02:03:27,939 since there's no one else in the room I'm gonna take it 2608 02:03:27,939 --> 02:03:29,279 that there aren't any 2609 02:03:29,279 --> 02:03:32,500 more speakers and I'm gonna close the public hearing and 2610 02:03:32,500 --> 02:03:33,760 open the floor for 2611 02:03:33,760 --> 02:03:38,840 discussion or a motion Commissioner Hesbuth I move approval 2612 02:03:38,840 --> 02:03:39,960 with the 2613 02:03:39,960 --> 02:03:43,640 conditions yes with the the conditions that staff is as 2614 02:03:43,640 --> 02:03:45,239 laid out okay 2615 02:03:45,239 --> 02:03:49,159 Commissioner Rozelle second okay we have a first and a 2616 02:03:49,159 --> 02:03:51,159 second for approval with 2617 02:03:51,159 --> 02:03:54,439 the conditions that are in the backup and that staff has 2618 02:03:54,439 --> 02:03:55,760 read into the record 2619 02:03:55,760 --> 02:04:01,659 with the first and second on any discussion or other 2620 02:04:01,659 --> 02:04:03,960 questions the only 2621 02:04:03,960 --> 02:04:06,260 question I have is when I meant to ask the applicant when 2622 02:04:06,260 --> 02:04:07,279 you were up you can 2623 02:04:07,279 --> 02:04:11,439 just shake your head were you okay with all the criteria 2624 02:04:11,439 --> 02:04:12,439 that we had for approval 2625 02:04:12,439 --> 02:04:15,800 conditions if you don't mind if you've got comment if you 2626 02:04:15,800 --> 02:04:16,460 'll give it to the 2627 02:04:16,460 --> 02:04:19,159 mic I'm sorry 2628 02:04:22,359 --> 02:04:25,010 thank you I thought about saying something on my way back 2629 02:04:25,010 --> 02:04:25,720 to the seat 2630 02:04:25,720 --> 02:04:28,539 we can comply with all of them the only one I would I would 2631 02:04:28,539 --> 02:04:29,560 ask maybe to deviate 2632 02:04:29,560 --> 02:04:32,140 from is to add the four extra trees the only reason I say 2633 02:04:32,140 --> 02:04:33,199 that kind of goes to 2634 02:04:33,199 --> 02:04:36,210 your concern as if you kind of look at the site plan back 2635 02:04:36,210 --> 02:04:37,239 there we kind of have 2636 02:04:37,239 --> 02:04:39,779 a bunch of trees there and with the kind of long crew 2637 02:04:39,779 --> 02:04:41,039 problem that we have at 2638 02:04:41,039 --> 02:04:44,010 that store we kind of don't want them hanging out behind in 2639 02:04:44,010 --> 02:04:44,840 that area 2640 02:04:44,840 --> 02:04:48,340 specifically not only that but in in for the future if we 2641 02:04:48,340 --> 02:04:49,640 want to expand even 2642 02:04:49,640 --> 02:04:53,399 more kind of expand to more so our current store if we're 2643 02:04:53,399 --> 02:04:54,560 able to acquire 2644 02:04:54,560 --> 02:04:57,430 more land it just would kind of make it easier on us just 2645 02:04:57,430 --> 02:04:58,880 kind of make it easier 2646 02:04:58,880 --> 02:05:02,140 for us to be able to develop and not have to remove those 2647 02:05:02,140 --> 02:05:03,920 trees as well I'll 2648 02:05:03,920 --> 02:05:07,069 follow up I think we have somewhere in here about moving 2649 02:05:07,069 --> 02:05:08,319 some existing trees 2650 02:05:08,319 --> 02:05:11,100 you know what size the existing trees are approximately I 2651 02:05:11,100 --> 02:05:12,439 do not not off the 2652 02:05:12,439 --> 02:05:17,920 top my staff would know how big the existing trees are 2653 02:05:20,640 --> 02:05:24,399 okay so you're moving for six inch trees you don't have a 2654 02:05:24,399 --> 02:05:26,520 problem with that 2655 02:05:26,520 --> 02:05:30,529 you're asking about for two inch trees adding those yeah 2656 02:05:30,529 --> 02:05:32,159 absolutely and really 2657 02:05:32,159 --> 02:05:36,170 I just wanted to state that even with their removing some 2658 02:05:36,170 --> 02:05:37,439 trees were still 2659 02:05:37,439 --> 02:05:40,729 five and square feet of square feet over the canopy on the 2660 02:05:40,729 --> 02:05:42,239 parking area and 48 2661 02:05:42,239 --> 02:05:45,930 hundred square feet as a whole for the entire development 2662 02:05:45,930 --> 02:05:47,159 so well over other 2663 02:05:47,159 --> 02:05:53,880 what dent requires okay I'll ask motioning Commissioner if 2664 02:05:53,880 --> 02:05:54,279 you want to 2665 02:05:54,279 --> 02:06:00,729 amend your motion for the four two-inch trees or leave as 2666 02:06:00,729 --> 02:06:04,560 is can I call Hayward 2667 02:06:04,560 --> 02:06:09,800 up was that absolutely yeah mr. Hayward 2668 02:06:17,720 --> 02:06:22,800 does eight inches of tree matter what which give me give me 2669 02:06:22,800 --> 02:06:26,399 your thought on 2670 02:06:26,399 --> 02:06:36,340 you like that awesome I'm proud of me well the additional 2671 02:06:36,340 --> 02:06:39,600 trees of course as 2672 02:06:39,600 --> 02:06:39,600 canopy to the city being an area where there's a lot of 2673 02:06:39,600 --> 02:06:44,239 traffic a lot of 2674 02:06:44,239 --> 02:06:48,640 emissions they help you know to purify their clean air so 2675 02:06:48,640 --> 02:06:50,399 of course it matters 2676 02:06:50,399 --> 02:06:53,449 because it's this future tree canopy for the city there are 2677 02:06:53,449 --> 02:06:54,560 a number of mature 2678 02:06:54,560 --> 02:06:59,279 trees on the site of alone that believes the south boundary 2679 02:06:59,279 --> 02:07:00,119 one thing when you're 2680 02:07:00,119 --> 02:07:02,819 looking at managing trees you look at you know having a 2681 02:07:02,819 --> 02:07:03,840 diversity of age of 2682 02:07:03,840 --> 02:07:07,119 your your trees on a site or in a city so as some of those 2683 02:07:07,119 --> 02:07:08,159 older trees are 2684 02:07:08,159 --> 02:07:10,640 dying off you have some of the younger trees to take their 2685 02:07:10,640 --> 02:07:11,439 place so it's kind 2686 02:07:11,439 --> 02:07:18,819 of a circle of life type thing we're having discussion have 2687 02:07:18,819 --> 02:07:19,520 you got a 2688 02:07:19,520 --> 02:07:23,529 military finish have you got another follow-up or comment 2689 02:07:23,529 --> 02:07:24,920 with Haywood no so 2690 02:07:24,920 --> 02:07:29,119 I'm just thinking out loud I'm gonna leave the four trees 2691 02:07:29,119 --> 02:07:32,000 but I would be 2692 02:07:32,000 --> 02:07:35,430 willing to have Hayward in the applicant discuss location 2693 02:07:35,430 --> 02:07:36,359 because I think his 2694 02:07:36,359 --> 02:07:40,279 point is valid and I take him at his word that if they're 2695 02:07:40,279 --> 02:07:41,079 expanding if 2696 02:07:41,079 --> 02:07:45,130 they're doing something to kind of place them where it's it 2697 02:07:45,130 --> 02:07:46,880 's user-friendly and 2698 02:07:46,880 --> 02:07:52,369 easy on them and still doesn't lower the requirement or a 2699 02:07:52,369 --> 02:07:54,560 request okay so you 2700 02:07:54,560 --> 02:07:56,680 were not going to amend the most we're gonna leave it as is 2701 02:07:56,680 --> 02:07:57,319 I think the site 2702 02:07:57,319 --> 02:08:01,609 plan had a designation for the trees went to I believe the 2703 02:08:01,609 --> 02:08:02,720 four trees have 2704 02:08:02,720 --> 02:08:06,229 removed yes but I'm saying if that if that location does 2705 02:08:06,229 --> 02:08:07,520 not work for the 2706 02:08:07,520 --> 02:08:10,630 applicant and there is a different location that the 2707 02:08:10,630 --> 02:08:12,159 applicant then is more 2708 02:08:12,159 --> 02:08:17,649 at peace with than they they can work that out okay I don't 2709 02:08:17,649 --> 02:08:19,800 know if that's we 2710 02:08:19,800 --> 02:08:22,720 have any concerns legal 2711 02:08:28,239 --> 02:08:32,619 the site plan for consideration by council thank you okay 2712 02:08:32,619 --> 02:08:34,760 no then I'll 2713 02:08:34,760 --> 02:08:42,189 leave it as is and just leave it okay thank you do we have 2714 02:08:42,189 --> 02:08:42,520 any other 2715 02:08:42,520 --> 02:08:48,119 discussion we have a motion and a second for approval with 2716 02:08:48,119 --> 02:08:48,880 all the 2717 02:08:48,880 --> 02:08:53,949 conditions that were listed as as in the backup and per 2718 02:08:53,949 --> 02:08:55,520 staff am I correct on 2719 02:08:55,520 --> 02:08:58,760 your motion that is correct and I welcome discussion okay 2720 02:08:58,760 --> 02:09:00,479 any discussions 2721 02:09:00,479 --> 02:09:06,369 before we take a vote on the board you know Commissioner 2722 02:09:06,369 --> 02:09:07,399 else thank you chair 2723 02:09:07,399 --> 02:09:09,199 I'll just say what I was going to say but I'm glad you're 2724 02:09:09,199 --> 02:09:09,920 not changing your 2725 02:09:09,920 --> 02:09:13,590 motion just you know what we need the trees here I mean we 2726 02:09:13,590 --> 02:09:14,479 were just you know 2727 02:09:14,479 --> 02:09:17,500 graded as one of the worst heirs in DFW I mean we need 2728 02:09:17,500 --> 02:09:18,880 trees you know so the 2729 02:09:18,880 --> 02:09:21,770 suggestion by staff I think is a good one to to add the 2730 02:09:21,770 --> 02:09:22,960 trees and I hope you 2731 02:09:22,960 --> 02:09:28,189 can do that and thank you Commissioner Taylor thank you 2732 02:09:28,189 --> 02:09:29,520 chair and I do think 2733 02:09:29,520 --> 02:09:32,420 there are opportunities but I'm just looking at the the 2734 02:09:32,420 --> 02:09:33,520 landscape plan as it 2735 02:09:33,520 --> 02:09:38,159 is now and the species isn't specified so they could be 2736 02:09:38,159 --> 02:09:39,000 smaller they could and 2737 02:09:39,000 --> 02:09:43,380 there are places along the road frontage you have a pretty 2738 02:09:43,380 --> 02:09:44,800 steady canopy but 2739 02:09:44,800 --> 02:09:47,699 there are gaps in the canopy and around the new parking 2740 02:09:47,699 --> 02:09:48,760 area there's a big 2741 02:09:48,760 --> 02:09:52,000 island it's about a 15 or 20 foot diameter island put one 2742 02:09:52,000 --> 02:09:53,920 over there and I 2743 02:09:53,920 --> 02:09:58,020 mean I just feel like there are places to put to plant four 2744 02:09:58,020 --> 02:09:59,319 trees of a medium 2745 02:09:59,319 --> 02:10:03,239 variety without adding to the forest behind the building 2746 02:10:03,239 --> 02:10:05,000 necessarily so those 2747 02:10:05,000 --> 02:10:09,010 were going to be my comments on it okay Commissioner Rizzo 2748 02:10:09,010 --> 02:10:11,239 to both Mr. Ellis and 2749 02:10:11,239 --> 02:10:15,000 Commissioner Taylor's point I I would might ask 2750 02:10:15,000 --> 02:10:17,239 Commissioner Hussbett to make 2751 02:10:17,239 --> 02:10:21,409 an amendment to free up it's my understanding that the the 2752 02:10:21,409 --> 02:10:22,079 motion on the 2753 02:10:22,079 --> 02:10:24,489 table right now would actually define those trees are 2754 02:10:24,489 --> 02:10:26,640 placed correct not the 2755 02:10:26,640 --> 02:10:30,060 new trees just the ones that are being relocated so the way 2756 02:10:30,060 --> 02:10:30,960 the motion has been 2757 02:10:30,960 --> 02:10:38,939 placed these four additional the site plan only delineates 2758 02:10:38,939 --> 02:10:39,960 where the trees are 2759 02:10:39,960 --> 02:10:43,170 to be relocated but the four new trees it does not have a 2760 02:10:43,170 --> 02:10:44,600 space for correct 2761 02:10:44,600 --> 02:10:49,930 it does it does it's actually eight trees total it's four 2762 02:10:49,930 --> 02:10:52,319 moved and then four new 2763 02:10:52,319 --> 02:10:55,239 those in the side plan that those are the relocated trees 2764 02:10:55,239 --> 02:10:56,199 yes sir those are 2765 02:10:56,199 --> 02:11:00,039 the relocated so the new trees they have discretion yes sir 2766 02:11:00,039 --> 02:11:02,600 okay then I take back 2767 02:11:02,600 --> 02:11:16,000 everything I I did want to staff did in there in our yes 2768 02:11:16,000 --> 02:11:21,479 yeah okay my only 2769 02:11:21,479 --> 02:11:24,930 comment is I'm gonna go ahead and vote for approval with 2770 02:11:24,930 --> 02:11:26,279 the conditions but I 2771 02:11:26,279 --> 02:11:30,289 do want to bring up for the applicants point they're still 2772 02:11:30,289 --> 02:11:31,560 25 percent and 2773 02:11:31,560 --> 02:11:35,470 they're only required 20 so they're above and beyond what's 2774 02:11:35,470 --> 02:11:36,520 required and I 2775 02:11:36,520 --> 02:11:39,270 know the reason for that was because of the parking number 2776 02:11:39,270 --> 02:11:41,199 of parking spaces but 2777 02:11:41,199 --> 02:11:46,250 as far as a minimum they are already above so with that I'm 2778 02:11:46,250 --> 02:11:48,600 going to call for 2779 02:11:48,600 --> 02:11:54,560 a vote hand sign all those in favor of approval with 2780 02:11:54,560 --> 02:11:56,119 conditions please raise 2781 02:11:56,119 --> 02:12:01,670 your right hand all those opposed same sign seeing none 2782 02:12:01,670 --> 02:12:03,079 motion carries six zero 2783 02:12:03,079 --> 02:12:05,609 for approval with the conditions congratulations and good 2784 02:12:05,609 --> 02:12:06,159 luck with your 2785 02:12:06,159 --> 02:12:17,640 project that will take us to our project matrix and conclud 2786 02:12:17,640 --> 02:12:21,239 ing items okay I did 2787 02:12:21,239 --> 02:12:24,270 get the request from the last meeting and I have 2788 02:12:24,270 --> 02:12:26,479 communicated that information 2789 02:12:26,479 --> 02:12:30,250 to Deborah Vieira in Earl's so you should expect an update 2790 02:12:30,250 --> 02:12:31,479 sometime in the 2791 02:12:31,479 --> 02:12:36,119 near future on the ESA request and also the the street 2792 02:12:36,119 --> 02:12:39,000 improvements I'm gonna I 2793 02:12:39,000 --> 02:12:43,739 want to gauge your interest for Trico because that is going 2794 02:12:43,739 --> 02:12:45,159 to be coming back 2795 02:12:45,159 --> 02:12:51,829 not for discussion but just for scheduling purposes we've 2796 02:12:51,829 --> 02:12:53,119 we are trying 2797 02:12:53,119 --> 02:12:57,609 to plan an additional work session before we bring the item 2798 02:12:57,609 --> 02:12:58,319 back for 2799 02:12:58,319 --> 02:13:03,340 consideration and I'm wondering do you guys want to do that 2800 02:13:03,340 --> 02:13:04,640 on a regularly 2801 02:13:04,640 --> 02:13:08,560 scheduled work session or would you be open to a special 2802 02:13:08,560 --> 02:13:10,000 call just for trees 2803 02:13:10,000 --> 02:13:16,069 I'm just gonna suspend the rules just we'll do discussion 2804 02:13:16,069 --> 02:13:17,800 yeah so my primary 2805 02:13:17,800 --> 02:13:21,970 thought on that is we need to in the legal world you take a 2806 02:13:21,970 --> 02:13:23,119 deposition to 2807 02:13:23,119 --> 02:13:26,899 nail down people's testimony right and I think so I 2808 02:13:26,899 --> 02:13:28,840 parallel that to the tree 2809 02:13:28,840 --> 02:13:32,239 ordinance I just I don't care when we meet my only 2810 02:13:32,239 --> 02:13:34,039 requirement and request is 2811 02:13:34,039 --> 02:13:38,229 that we nail down a meeting with the certain number of 2812 02:13:38,229 --> 02:13:39,840 developers and get 2813 02:13:39,840 --> 02:13:46,020 their thoughts captured because last time they came and 2814 02:13:46,020 --> 02:13:47,159 talked to us and 2815 02:13:47,159 --> 02:13:49,579 they were all over the place they didn't agree with each 2816 02:13:49,579 --> 02:13:50,880 other and I just want to 2817 02:13:50,880 --> 02:13:54,560 try to solidify that at least get it some sort of record 2818 02:13:54,560 --> 02:13:55,760 get them on record 2819 02:13:55,760 --> 02:13:59,199 before we have to then listen to them tell us how crazy we 2820 02:13:59,199 --> 02:14:01,640 are and and and and 2821 02:14:01,640 --> 02:14:04,590 it's not based on anything so I would like for staff to 2822 02:14:04,590 --> 02:14:06,199 meet and Heyward to 2823 02:14:06,199 --> 02:14:10,340 meet with them and pin them down and then at least we have 2824 02:14:10,340 --> 02:14:11,319 some sort of 2825 02:14:11,319 --> 02:14:14,890 record to say well on Tuesday you said and now that somehow 2826 02:14:14,890 --> 02:14:16,119 that's changed but 2827 02:14:16,119 --> 02:14:20,130 I just the fluidity is in my opinion the problem that they 2828 02:14:20,130 --> 02:14:21,600 kind of vacillate so 2829 02:14:21,600 --> 02:14:25,109 more we could pin them down and whatever that number is it 2830 02:14:25,109 --> 02:14:27,119 is but just to get 2831 02:14:27,119 --> 02:14:30,079 them static and then we can kind of move forward so I'd 2832 02:14:30,079 --> 02:14:31,359 like for staff to meet 2833 02:14:31,359 --> 02:14:35,760 with whatever developers to kind of get a feel for their 2834 02:14:35,760 --> 02:14:37,279 thoughts and then 2835 02:14:37,279 --> 02:14:43,510 before it comes to us I'm personally with Christian Oats 2836 02:14:43,510 --> 02:14:45,000 mith I can meet any 2837 02:14:45,000 --> 02:14:48,840 time it needs to be a special call it seems to make sense 2838 02:14:48,840 --> 02:14:50,000 to me just to do it 2839 02:14:50,000 --> 02:14:54,680 on a Wednesday before maybe it's selfishly but I have the 2840 02:14:54,680 --> 02:14:55,199 calendar of my 2841 02:14:55,199 --> 02:14:58,579 kind of Wednesdays afternoons blocked off but if I mean 2842 02:14:58,579 --> 02:14:59,520 given lead time 2843 02:14:59,520 --> 02:15:09,760 special calls fine okay okay yeah my preference would also 2844 02:15:09,760 --> 02:15:11,840 be just a work 2845 02:15:11,840 --> 02:15:16,520 session item instead of a special meeting okay and and we 2846 02:15:16,520 --> 02:15:17,920 if we know it's 2847 02:15:17,920 --> 02:15:21,689 coming and it runs over our hour and a half or whatever we 2848 02:15:21,689 --> 02:15:22,840 might have I'd also I 2849 02:15:22,840 --> 02:15:26,260 would prefer just to come in at 9 you know stay after the 2850 02:15:26,260 --> 02:15:27,520 meeting go back into 2851 02:15:27,520 --> 02:15:32,340 work session at the end then spread it out over a month or 2852 02:15:32,340 --> 02:15:35,720 two okay so you all 2853 02:15:35,720 --> 02:15:41,479 want a special session workshop and then you are wanting a 2854 02:15:41,479 --> 02:15:43,119 regular work session I 2855 02:15:43,119 --> 02:15:47,890 guess to clarify I'm just prefer to be on a Wednesday if we 2856 02:15:47,890 --> 02:15:48,359 need with the work 2857 02:15:48,359 --> 02:15:51,619 session up to four to accommodate that's on a regularly 2858 02:15:51,619 --> 02:15:52,640 scheduled day not 2859 02:15:52,640 --> 02:15:56,039 yes yes but I'm with the Commissioner Taylor I'm fine 2860 02:15:56,039 --> 02:15:57,439 pulling a late night if 2861 02:15:57,439 --> 02:16:01,069 if the Commission needs to meet at five and on a whole can 2862 02:16:01,069 --> 02:16:02,720 't meet earlier yeah 2863 02:16:02,720 --> 02:16:06,560 I think I'm the same and I think if we do some stuff on the 2864 02:16:06,560 --> 02:16:08,399 front end it'll 2865 02:16:08,399 --> 02:16:16,750 shorten a lot of the the conversations well having looked 2866 02:16:16,750 --> 02:16:17,760 at a preliminary 2867 02:16:17,760 --> 02:16:21,600 draft of it it's quite lengthy so we may need to do that 2868 02:16:21,600 --> 02:16:22,920 several times or we can 2869 02:16:22,920 --> 02:16:26,619 knock it out with just a special call workshop okay like we 2870 02:16:26,619 --> 02:16:27,239 did the oil and 2871 02:16:27,239 --> 02:16:40,850 gas so it's up to you all yeah I would think two hours two 2872 02:16:40,850 --> 02:16:43,399 hours and so if it's 2873 02:16:43,399 --> 02:16:46,700 okay we can just go ahead and do a full background for 2874 02:16:46,700 --> 02:16:48,239 Commissioner Ellis and 2875 02:16:48,239 --> 02:16:51,729 Commissioner Sullivan at that meeting and then pick up 2876 02:16:51,729 --> 02:16:52,920 where we left off the 2877 02:16:52,920 --> 02:16:56,370 last time does that make sense or do you guys have any 2878 02:16:56,370 --> 02:16:58,959 preference so so is it so 2879 02:16:58,959 --> 02:17:02,260 is it dramatically changed or is it similar to what we saw 2880 02:17:02,260 --> 02:17:02,799 in the summer 2881 02:17:02,799 --> 02:17:07,440 it's changed okay and so we're gonna have to reintroduce it 2882 02:17:07,440 --> 02:17:11,719 to the DCA the 2883 02:17:11,719 --> 02:17:16,680 developers is it what's the anagram for it BCDA thank you 2884 02:17:16,680 --> 02:17:18,680 in order to get some 2885 02:17:18,680 --> 02:17:22,379 feedback from them and then we'll bring it forward and and 2886 02:17:22,379 --> 02:17:23,600 do a page turn like 2887 02:17:23,600 --> 02:17:26,719 we did I think that would be helpful a page turn don't you 2888 02:17:26,719 --> 02:17:28,159 okay so do like a 2889 02:17:28,159 --> 02:17:31,639 three-hour work session on a Wednesday okay I think that 2890 02:17:31,639 --> 02:17:32,000 would be more 2891 02:17:32,000 --> 02:17:34,520 beneficial that way you're not coming back again and again 2892 02:17:34,520 --> 02:17:35,360 and having to stay 2893 02:17:35,360 --> 02:17:38,559 late again and again in just one work session not a series 2894 02:17:38,559 --> 02:17:39,479 well yeah and we'll 2895 02:17:39,479 --> 02:17:42,520 see how we stand at that point if we can get through it 2896 02:17:42,520 --> 02:17:43,520 okay 2897 02:17:43,520 --> 02:17:47,700 y'all I'm able to do a special call and try to get through 2898 02:17:47,700 --> 02:17:49,879 it not December right 2899 02:17:49,879 --> 02:17:57,079 this would be it's next year I can see your mind twirling 2900 02:17:57,079 --> 02:17:58,920 no we're not gonna 2901 02:17:58,920 --> 02:18:05,159 interfere with vacations so maybe a Wednesday where you don 2902 02:18:05,159 --> 02:18:05,680 't have a 2903 02:18:05,680 --> 02:18:09,040 regularly scheduled meeting but you know between go ahead 2904 02:18:09,040 --> 02:18:09,799 and do a special 2905 02:18:09,799 --> 02:18:13,229 session and this be after first year sometime January or 2906 02:18:13,229 --> 02:18:15,159 February right we 2907 02:18:15,159 --> 02:18:23,069 need some time to present it to DCDA to present to them or 2908 02:18:23,069 --> 02:18:26,280 present to us okay 2909 02:18:26,280 --> 02:18:33,129 so special call sometime in January maybe towards the end 2910 02:18:33,129 --> 02:18:34,040 of January between 2911 02:18:34,040 --> 02:18:36,700 our second and fourth like the third Wednesday that way 2912 02:18:36,700 --> 02:18:37,760 maybe the first part 2913 02:18:37,760 --> 02:18:43,409 you can get with DCDA and does that talk about calendars is 2914 02:18:43,409 --> 02:18:44,799 where I want to get 2915 02:18:44,799 --> 02:18:47,100 their calendar out right quick and kind of see what that 2916 02:18:47,100 --> 02:18:48,600 looks like that would 2917 02:18:48,600 --> 02:18:56,200 be and help me with that that would be January when are our 2918 02:18:56,200 --> 02:19:00,000 meetings in January 2919 02:19:02,000 --> 02:19:08,760 they said the 18th is actually not good for me yeah don't 2920 02:19:08,760 --> 02:19:09,959 we have a joint session 2921 02:19:09,959 --> 02:19:12,479 that's trying to happen with council in January - do you 2922 02:19:12,479 --> 02:19:13,399 have the new meetings on 2923 02:19:13,399 --> 02:19:17,420 your schedule I think and the January didn't she said 11 2924 02:19:17,420 --> 02:19:21,200 okay so we could do 2925 02:19:21,200 --> 02:19:25,850 it the 18th or the first I have a conflict on the 18th at 6 2926 02:19:25,850 --> 02:19:27,860 p.m. we could 2927 02:19:27,860 --> 02:19:30,340 do it February 1st and that'll give us the whole month of 2928 02:19:30,340 --> 02:19:31,280 January to get with 2929 02:19:31,280 --> 02:19:38,299 developers and get go back and forth on it well I think it 2930 02:19:38,299 --> 02:19:46,879 's reasonable okay 2931 02:19:47,879 --> 02:19:52,989 tentatively February 1st is probably gonna be a problem for 2932 02:19:52,989 --> 02:19:55,479 me so I'm sorry if 2933 02:19:55,479 --> 02:19:59,040 we cannot it's my daughter's 18th birthday it would be 2934 02:19:59,040 --> 02:19:59,959 really tough for me 2935 02:19:59,959 --> 02:20:03,600 to be here talking about trees which I love trees but that 2936 02:20:03,600 --> 02:20:04,840 would be a tough day 2937 02:20:04,840 --> 02:20:10,959 for me February 1st but everyone else is okay so could we 2938 02:20:10,959 --> 02:20:12,440 could we just not have 2939 02:20:12,440 --> 02:20:21,760 anything contentious on the January 25th agenda and so well 2940 02:20:21,760 --> 02:20:24,879 it's just that 2941 02:20:24,879 --> 02:20:29,159 council only has one meeting in January and so there's 2942 02:20:29,159 --> 02:20:30,639 gonna be a race for 2943 02:20:30,639 --> 02:20:34,440 everybody to get recommendations here to go to council so I 2944 02:20:34,440 --> 02:20:36,000 'm just thinking ahead 2945 02:20:36,000 --> 02:20:44,959 that we might have an issue so we'll get with you more than 2946 02:20:44,959 --> 02:20:45,760 likely sometime 2947 02:20:45,760 --> 02:20:48,959 unfortunately sound like maybe February and not the first 2948 02:20:48,959 --> 02:20:50,120 and we'll let you guys 2949 02:20:50,120 --> 02:20:55,200 get some dates and figure that out just one comment if I 2950 02:20:55,200 --> 02:20:55,239 could sure can we get 2951 02:20:55,239 --> 02:20:57,959 an update on the staff list there's a few changes in there 2952 02:20:57,959 --> 02:20:58,719 including this 2953 02:20:58,719 --> 02:21:04,409 Jarvis so we could get an update on changes so you need an 2954 02:21:04,409 --> 02:21:05,319 updated contact 2955
