Our Planning and Zoning Commission meeting for July 13th. This will be our work session. This meeting has been duly posted and we do have a quorum present. Our first order of business today is going to be to receive a report of our clarification of agenda items and I will turn it over to Manal for presentation. Thank you Chairperson Strange. We have several plots on our agenda. We have two preliminary plots, some final plots and some replots as well. We also have an additional item for presentation. So if there are any questions associated with plots, we'll call upon the specific staff member to make that presentation for you. Commissioner Bet. Thank you Chair. I do want a couple of them. Okay. And the first one is with the symbiosis edition. So this one kind of raised a red flag with me. And I may as Mike Bell likes to point out, be overthinking this. Sorry about that. But I see an area here that we're coming in and we're building the plan set up. The guy has intentions of doing a multifamily dwelling. And we're in an area where there's some, it looks like it's an older housing neighborhood. There's some, a couple of houses just to the north of this property. Some along Johnson Street and some on the south side too. So what this raises is a red flag for me. So somebody walk me through this if they can. Because I. I'll have Julie Wyatt come in and go over the preliminary plot. And then I believe Julie, the final plot is on tonight's agenda too. So we'll address both and go over what is before you as it relates to the subdivision ordinance. Okay. And then we'd be happy to answer any questions that you have. Okay. If I can just, I think my main concern here is I get this sense of this being an issue with gentrification. So that's kind of where I'm going with this. Right. So in terms of what's before you is the preliminary plot and the final plot. In our background information, we indicated that the property is being plotted to multi-family development. That being said, everything based on the Denton Development Code is in order. The zoning is in place. So maybe the bigger question as a future agenda item is to revisit the bigger question that you have of gentrification, which would not be associated with this plot. Okay. So. If that makes sense. When you say, address it as a future item, then you're saying in a public hearing or at another meeting? We can discuss that when we go to our future agenda items as it relates to the agenda after while we're in regular meeting. Okay. Concluding items, you could bring that up. Okay. Okay. And I got you there. On the Worsham Valley estates, just quick question there. This parcel has a water tank or pond on it. Will it be preserved? Do we know? Yes, the easement is there to protect that. Okay. Okay. Just we. The Beaver Creek addition, for some reason, I thought what we were dealing with in the past was on the east side of Stewart, but this is on the west side, I gather, from what I've seen. And this has an AES. So what does this AES entail? Sure. Are we making some big changes here? No changes. It's in conformance with the preliminary plot that was approved recently. Yeah. In their preliminary plot, they had phases that were den oted on that plot. They also had a phasing plan. So this is just the beginning of the development. So this is section 1A, be the first lots, and then they're going to come through with other sections. So let me pull it up. All right. I'll rotate it so it looks like it does on the ground. So yes, here is Stewart and here is loop 288. Down in this area. So it's in the same configuration that was proposed in the preliminary plot, or approved in the preliminary plot. Where is the environmental sensitive area that we-- This doesn't actually affect that. It's going to come in in the subsequent plots. So that was something we looked at during the review to make sure. So this is-- it conforms to that preliminary plot, and then the ESA is going to start rolling in in the subsequent phases because it's going to start-- the next phases are going to start being in those areas that would affect it and that those open space lots are going to be dedicated. So it's not an area of concern for this agenda item? Not tonight. It will be an upcoming one. Yes, sir. Okay. And lastly, the Preserved Pecan Creek. Can we get just a brief discussion on how the public drainage and the floodplain easement will be developed? This area feeds into Lake Louisville, so are they the developers who are going to build all these houses, are they going to take advantage of that and make kind of a nice park out of it, or do we not? Let me pull that up and I'll-- I can discuss what's being proposed, and then we may need Earl to supplement my conversation, but the FEMA area, the floodplain area, all of this is going to be open space. So that burrow is going to go through it, and then these houses are behind. So those-- there's the creek right there, and it's-- the housing part is going to stay out of the FEMA area. So they won't drain into that? I'm going to let Earl discuss how they're going to drain. This entire subdivision does drain to the floodplain by curb and less and storm piping. Okay, and that makes sense. All right, thanks, Earl. Okay, I'm done. Thank you. Any other questions on plaques? We do have a zoning case, Mr. Jefferson Strange, which Mike Bell is going to present to us. This really is a fairly straightforward rezoning, or initial zoning, that is. It's Z16A, it's off of Geesling Road. The request is an initial zoning, an initial zoning because it was just annexed last month, so it doesn't have an official zoning designation yet. This would be the first, and they're requesting employment center industrial, or ECI. The property is kind of shown here in yellow. It's on the west side of Geesling Road, just south of the university. And you can see the United Copper up here to the north. Safety clean over here. And this is Cooper Creek and Mayhill Road. As I said, it was annexed in June 16th. It was part of the 2010 annexation plan, had a non-annex ation agreement through 2020, which restricted use of the property only to agriculture. It has a new owner, they want to develop it, so then therefore they annexed. The current zoning is the RD5X placeholder district, and they're proposing ECI. ECI is consistent with the future land use designation, which is business innovation. That area supports both ECI and ECC, Employment Center Commercial, so it's consistent with the future land use map. City Council did approve the annexation earlier this month. It was made full aware at the time that their intent was to do kind of white manufacturing uses. Council saw in the HUSHIE with that, so we factored that in our consideration, as well as it being consistent with the future land use plan. So we didn't receive any notices back. I'll stand for any questions. Oh, I also would point out that the applicant will be here tonight, but he does not wish to make a presentation. So for the order of tonight's proceedings, he won't be. He'll just answer any questions if you have them. So when this item comes up, just ask, go straight for staff presentation then? Correct. Any questions for Mike? Commissioner Beck, sorry. Chair, in your backup information down here at the bottom of the first page, it says the tributary of Cooper Creek that flows through O sa at the property is encumbered by FEMA, by the FEMA floodplain, as well as water-related and upland habitat, environmental sensitive area. So when you say encumbered, is that not an active tributary then? It is. It's both FEMA and ESA, so they cannot develop in it . Okay. They have no intent to. If they should, it would have to come before you as an alternative ESA plan. Okay. So this light manufacturing we're doing, I guess we're sensitive to that, that whatever they do can 't. Correct. The Beatty property, where you see Beatty Street there, do they still live there? I knew the Beatty's a long time ago. I do not know that. Okay. And this is not going to hamper them. I notice they've got a pretty good buffer area there, but nothing from them at all on this. Okay. That's it. Thank you, Mike. Thank you. Okay. One item the Chair is going to ask to add to the agenda. Then our next item in our work session will be to receive a report from Ron Magida on DIN Plan 2030. Thank you, Chair, members of the Commission. Give me a few minutes to pull up the PowerPoint presentation when we get started. And while you're getting set up, about how long will your presentation be? Probably 20 minutes. Okay. Hopefully it won't be too long. It depends on the questions. Well, now we have food, so if this is our last item and it might go a little long, we might take a break, but since it's going to be that long , let's go ahead with the presentation if that's fine with everybody else, and we'll eat afterwards. Okay. Thank you. Do you know what long it is? Oh, you should have told me. It was saved in five minutes. Thank you, Julie. Well, thank you for the Commission for the opportunity to present to you the update to the action plan. This was part of the DIN Plan 2030 comprehensive plan. As you all are familiar, in the back of your DIN Plan 2030 is an action plan that basically lists all the actions within the plan, prepares who the department that's responsible for it, prepares a timeline as well as any other partners that are going to help with that implementation of that action plan. We're going to discuss that. As you all know, this DIN Plan 2030 was adopted last year, February 2015, and again in the implementation and monitoring element, which is the last element, there is an action plan. That action plan, as you see here, was also included in your backup, has, we talked about, relatively establishes the timeframe and the relative priority of each action. There is frameworks for guiding decision making within the action itself, with regards to the responsible department as well as the timeline. Lastly, the action plan has over 285 action synthesized actions. So these are actions that are combined with multiple actions where they were common in the elements. We put them together. As you can see in this exhibit here, action two actually has numerous actions from the plan. So again, that's the reason why there's 285. The process in which this update was put together involved the technical advisory committee. As you all know, this technical advisory committee is made of approximately 26 senior staff members. Each technically experts in their own field. And as you all know, the comprehensive plan is not just one technical aspect. It's got multiple different, from engineering to environmental to police and fire. So we involve those folks in the process of updating the action plan, because they are really the people that are involved in implementing the plan. So as we started this effort, we reached out to them and they're the primary persons or people that help put this plan or this action update plan together. As you can see, this is not in your DEN Plan 2030. There's a status column and this was included in your backup. That's the primary entry in which the technical advisor committee provided their status, their progress in the actions that they've been assigned. And we'll get into more details as far as what has transp ired within the past year. Some key accomplishments, also any impediments that were encountered, and other recommendations that the technical advisory committee feels that needs to be done. These recommendations are primarily related to who's responsible. If there was some addition to the responsible department, another recommendation may be if there were other partners that we can enlist to help implement these actions. And then maybe also if the timeframe is a little bit off, they can certainly recommend updates on how to either speed it up or maybe postpone it for whatever reason they think is necessary. So with that, before I get to some of the key accomplishments, I want to give the commission an opportunity, did you all have any questions with regards to the statuses? Do you have an opportunity to read it and form any questions that I can answer at this point? Or if not, I can continue with the PowerPoint presentation. All right, so the first key accomplishment is the initiation of an economic development partnership action team. This is a strategic action or plan that the economic development department has initiated. They started this early in 2015 as the DEN Plan 2030 update was wrapping up. There's six teams that make up this partnership team. It's teams that focus on recruitment, Code DEN, which is a technical team that looks at technology, partnerships. There's culture and unique to DEN. They focus on those actions. And then also, I believe it's, I'll take my notes real quick. Outreach as well. So those are the key or the teams that make up this economic development partnership team. And again, they're currently in place and are working towards implementing actions to help in their respective action teams. In January as well, the last year, again, as the DEN Plan 2030 was wrapping up, the community development department finished up their, I'm sorry, not the community development department, but the PCO, Public Communication Office, finished up their communication plan. And this is in working concert with not only with the City of DEN, but with other entities within the communication field that puts together how we are going to communicate to the general public. So it's a plan that they are using to implement their objectives and their strategies moving forward. Technical Services has launched a free Wi-Fi. So if you're around the DEN Square, again, this was back in March, they've launched this. So there is now free Wi-Fi. So that's a key accomplishment. That's one of the things that was mentioned in the DEN Plan 2030 as an action item. This is the Community Development Department or Division. They completed their consolidated plan for the next five years. This consolidated plan is a fairly thick document as well. Again, this is a plan which they are using to strategize on how they're going to implement their specific tasks. And a couple of those specific tasks involve the implementation of some grant programs. HUD offers a CBD grant that is included in this consolidated plan, also a home grant. So it basically outlines how this division is going to work towards implementing their strategies and their objectives as well. So as you can see, just in a few examples, we've already seen several different departments use the comprehensive plan to develop or finalize and fine tune their plan to move forward on some of their actions that they're looking to accomplish. Again, in later that year, 2015 August, the City Council adopted the Code Amendments to the Gas, Well, and Production section of the DDC. That was again back late, mid to late August of last year. In September, the Plan Department started the existing land use database. And as you know, in order to be able to plan, we need to be able to understand what we have on the ground. And for the longest time, we have never had an existing land use or at least kept it maintained. I can say that our GIS division has started that up and it 's actually maintaining this database. So if when we need data, we're able to compile it within a reasonable, timely manner. And we have this readily available for any future studies that we may be looking at doing in the near future. Again, September of last year, we initiated or we created the Planning Zoning Subcommittee, which is to look at rezoning potentials within the city. And that committee has met several times. Members of this commission have participated in that. And we've identified several locations within the city that we feel that should be initiated as staff to bring forward as a rezoning. We are also going to be talking to our City Council in the near future to give them an update on this specific because ultimately, those rezoning that staff is going to propose are going to go to the City Council for their consideration . So an upcoming meeting with the City Council is scheduled for later this year. Community Improvement Services, CIS, has started an enhanced right-of-way maintenance program. This started October of last year where they were granted some funds to work with a private contractor to look at how they can improve and beautify existing right-of-ways. Currently, it's my understanding that there are 33 areas that they maintain as we speak. And hopefully that program continues. I have a list of those areas if you'd like. I don't have it readily available with me, but I can certainly provide that to the commission. Commissioner Bec. Thank you, Chair. These right-of-ways, are these where roads next to the R&D model were? These roads? No, these are existing roads. I'm reading my notes here. 33 total streets, and they're in both TexDOT and City right -of-way. So there's a partnership with TexDOT to identify some areas where maybe we want to enhance those areas more than what their current scheduled maintenance is . So that's the effort is to improve those areas. Okay, thank you. Commissioner Detovits. Ron, you said there's three that you have? 33 right-of-way areas, yes. You can give us a list of those? I can, yes. At some other point in time? Yeah, I don't have that, I just have a note that there are 33 areas that the CIS folks are looking, are working on. They include both DOT and? City right-of-ways. City and what about county? I don't know. All I know is that it involves City and TexDOT right-of- ways. Yeah, I think county, you're looking at further out the city. I think what we're trying to focus on, again, assuming that that's what the CIS folks are doing is more internally into the city's city limits. Okay. Economic Development has initiated a Den Arts Walk of Fame and as you all are familiar, if you are walking down Hickory Street, there are plaques on Hickory Street that identify key members of our community that were instrumental in the arts and other avenues to enhance Den. Total, there are 12 currently that have been installed, sorry, last year. The program is an annual program. My understanding is that next year they're looking at adding six more plaques. So a subcommittee or a committee has been identified and is working in identifying who should be on that next list and so annually there will be another six or so plaques installed along Hickory Street. The plan department has started the initiation of a small area plan update, one that we'll be bringing forward to the subcommittee or to the commission, sorry, soon. It's an area that we've seen some activity. This is the Hickory area next to Fry. That scope in that area is what we're looking at and again, there is an existing Fry small area plan. It was completed back in, I want to say, '99 so it's somewhat outdated and we're looking at updating it in efforts to identify what we can do to improve that area or help improve that area. Chair? Commissioner Bruegel. Thank you, Chair. Ron, have there been other neighborhoods that have approached the planning department to work on small area plans? I know several years ago there was a talk about the neighborhood Ector and Bonnie Bray somewhere in that area and more recently the neighborhood by T.W.U. along Austin Street. There was talk for a while about, so have other neighborhoods approached the planning department? The Ector folks, as you all know, there was a rezoning recently along the university so those folks did approach and I think you were one of those that were given that opportunity and we did connect with some members of the neighborhood along Ector Street. That small area plan had been drafted, never finalized. We're looking at reviving that small area plan and hopefully we can bring that forward as well. Other areas where we see that there's a need for a small area study plan has been south of downtown. There's an area there that we 're looking at also starting but the one in Austin, I have not heard anything. If you would like, I can maybe touch base with you. I'll find it maybe we can explore that area as well and that's certainly an area we can follow up as well. That'd be great and as I understand it, it's primarily the impetus is on the neighborhood to come to you. It's not the city saying we think that this would be a great place for small area plans. It's neighbors getting together and then reaching out to the planning department. It's both. I mean if the city staff feels that there's an opportunity to look at an area where we feel that there's ways we can help, we'll propose that and that's something that we did for the one just south of downtown. There's an area there that the Stroud area neighborhood. That's something that we're looking at just because we see that development is coming from Eagle North as well as Elm and west. So we feel that that's an area we can look at again. What was that process like? Did you all just have like a neighborhood meeting and reach out to the neighbors and there was a program that existed? Yeah, we haven't really started it yet but that is an area that we're focusing to start soon. So that one will probably involve some neighborhood meetings where we'll invite the entire neighborhood, identify some issues, constraints that we can address and we already identified a few things that we can help and maybe the community can bring a little bit more input into that. Yeah, I think that 's great and I know that staff resources are very limited. I get that but I think making yourselves more available and more visible because I think there's a lot of, there are several neighborhoods in town that probably do feel somewhat like they could use some support and maybe don't quite know where to go. Sure. And I imagine those that are informed probably reach out to their city council person but there's probably a lot of people that may not even know that this even exists. So I would encourage more initiative like that reaching out to the neighborhoods. I think that's great. Well no, I appreciate that and just as we know last year we started the long-range planning section and myself along with Cindy Jackson who's here have initiated a number of long-range projects which was the Stroud neighborhood as well as the reviving of the Ector Street small area plan . So there are ones that are coming. Great. Julie Wyatt is heading the effort on the Fry Street overlay or the small area plan. So we'll start to see more projects and again it's not something that we will say. We will actually go out and hopefully get some projects going. That's great. Thank you. Commissioner Hatchbeth. Thanks Chair. What is the, so we have development pending there on Fry Street. What is the process assuming the small area plan is upgraded or changed and there's a project on the books. What does the transition look like for an applicant? We, this project that you're referring to Commissioner H atchbeth has been in the process or in the queue for some time. They're actually going through the review process right now. So we can't stop them from going forward. We can only you know recommend that you know we wait till the study is done but they're moving forward. We're not going to you know prevent them from moving forward. So you'll see this project that you're referring to prior to this study being complete is my assumption. Okay. Okay. Again something that you all were involved in the mobility plan. 2016 January is when it was adopted. That kind of set the stage for what PS's you know efforts in adopting a road impact piece but this was something that was needed to be done. Again this was done or completed and adopted in January of this year. Also early this year the airport adopted or was able to adopt their airport master plan. Again this master plan is to help them plan and strategize their efforts over at the airport. So this was something that was well needed. I'm not sure if this was an update or rather a new one but I think this was something that they were anticipating and hopefully that can help their expansion efforts over at the airport. Commissioner Beck. Thank you Chair. Is this master plan available online for people to? I don't know for sure if it is but if it's not we can certainly make it available. I'll have to follow up with the airport folks to make sure that it is available. I can't confirm it is or it is not. Okay thanks. This is an exciting recognition of the League of American Bicyclists gave the City of Den an honorable mention back in February of this year. The the city applied for a bicycle friendly I guess recognition and unfortunately we weren't able to get a bronze or silver or gold. I think the highest is applying them but we did get an honorable mention. Our intent is to reapply again next year and hopefully we can get another opportunity to come back and tell you that we got platinum. So that's the goal at least. So that's that's our charge. So Julie Anderson was in charge of this and she was able to at least get us an honorable mention. Again I mentioned earlier road impact fees. This was done just this past month or last last month that is. It was adopted by council. So I 'm not too purview as to the process in which we are going to move forward but if you all don't know the council did recommend or a part of their adoption to have a fee of two thousand dollars per SFE single-family equivalent. I don't know if Earl has anything to add as far as the process but my understanding is still early early and the process is being defined as we speak. That same night the council also approved the resolution regarding the den I'm sorry the renewable den plan. This is for DME to start their work and efforts to look at a location and move forward with their plans for a a plant that would help their their their efforts in getting 70 percent renewable energy. Last I think of these accomplishments is the public arts master plan. This was presented last month. It was not adopted. The council directed the staff to go back and prepare for a work session. The council just needed more time and information before they can consider this. I think this is a a key accomplishment because this sets the stage as far as what type of art program or art that we want in the city specifically in the downtown area. So hopefully this will be done in the next city council meeting. Some ongoing implementation. We continue to implement the sustainability plan. We're also working on the environmental services programs which is headed by Dr. Kenny Banks. KDB has a number of programs something that's very familiar to some of you all. One of examples is the tree giveaway but they do a lot more than than just that. Water and wastewater system capacity programs. Our departments are looking at how we can conserve water and and be a little bit more efficient in those regards. And lastly solid waste and recycling program. You know that recycling is a big deal in our community and so continuing with those efforts is what the solid waste department is doing. So what does this mean? This was an annual update. I'm sorry before I move forward were any other questions or any questions before I get to my closing statement? None? Great. The next step or moving forward we are going to continue to monitor and evaluate these actions. We will be working myself included with the technical advisor committee to continue to document any key accomplishments. If there are any impediments we will make sure we mention that and obviously if there are any updates that we need to present we will do so as well. We will continue to use the DEM plan 2030 as our guiding document in decision making. We will coordinate with other departments such as you know water, DEM and any other departments to help improve or enhance their city programs. And lastly we will be back or I will be back to present to this commission hopefully next year and give you a little bit more update on where we have what we've done this coming year. Property was just annexed last month, therefore it does not have an official zoning district. This would be its first. The location is on the west side of Giesling Road, just south of 380. The proposed zoning district is consistent with the future land use plan and compatible with the surrounding land use pattern. Is the road considered enough of a barrier between those two? Is there any, was there any concern of that from a staff perspective? What we'll do is we'll pull up the zoning map and speak to that to show you the physical separation of the zoning district associated with the subject site. So the NR6 you're referring to is right here. We do oftentimes see employment centers and even industrial centers, but residential zoning quite often . Okay. And of course the ordinance has specific parameters in terms of separation through the buffer requirement, depending on what type of use is adjacent to to the subject property.
